BACKGROUND: On April 26, 2022, the City Council adopted Resolution No. 22-26 awarding a construction contract to D'Arcy & Harty Construction, Inc. (Contractor) in the amount of $1,612,250 for the Project and approved a Project contingency amount of $242,000. A Notice to Proceed was issued to the Contractor in July 2022. The Contractor began work soon after issuance of the Notice to Proceed and has successfully completed all contract work, including replacement of approximately 4,600 linear feet of 6 -inch and 8 -inch diameter sanitary sewer main with new high - density polyethylene (HDPE) pipe, lower laterals, cleanouts, manhole frames and covers, sewer flow control, and other improvements within the Upper Hillcrest Subbasin 4 area, which includes the following streets: Palm Avenue, Hazel Avenue, Laurel Avenue, Taylor Boulevard, Ashton Avenue, Almenar Street, and El Paseo. As part of the construction, the Contractor replaced additional sewer mains and re -aligned several lower laterals which were too flat originally by open trench method. The total contract change orders for the Project was $11,374. The Project's change order are as follows: • Contract Change Order No. 01 - $18,580: Additional pipe replacement at the rear easement of 800 block of Almenar Street by open trench method due to the poor condition of existing pipe; additional pipe replacement by open trench method at Taylor easement between MH 313049 & MH 314047 due to unforeseen abandoned pipe that was protruding into the sewer main. Page 1 of 2 19465534.1 Page 2 of 2 19465534.1 • Contract Change Order No. 02 – credit of $7,206: Various Extra Work Items and Final Quantity - Quantity adjustments for lateral replacement types such as open cut instead of trenchless method due to unforeseen ground condition and utility conflicts; additional pipe & manhole replacement due to the poor condition; abandonment of existing sewer mains and the repair of sewer laterals by open trench method due to inadequate slope. In addition, due to the elimination of some planned work that was identified to be unnecessary, less linear footage of sewer main was installed and fewer sewer lateral reconnections were required; therefore, a credit was applied to the contract. Staff performed the Project’s final inspection and determined that all work has been satisfactorily completed in accordance with the project plans and specifications. Staff recommends that the City Council accept the Project as complete and authorize filing of a Notice of Completion with the San Mateo County Recorder’s Office. FISCAL IMPACT: There is no fiscal impact to this action. The final cost of this Project is below the Council approved budget. A summary of costs is outlined below: Original Construction Cost $ 1,612,250 Contract Change Order No. 01 $ 18,580 Contract Change Order No. 02 $ (7,206) Final Construction Cost with Change Order $ 1,623,624 The final construction cost was $1,623,624 and was below the total authorized construction cost of $1,854,250. Quantities for contract bid items were required to be adjusted due to changes in site conditions and actual footage for mainline sewer main replaced and lower sewer laterals. COUNCIL ACTION: Adopt a resolution accepting the Upper Hillcrest Subbasin 4 Sewer Rehabilitation Project as complete and authorizing filing of a Notice of Completion with the San Mateo County Recorder’s Office. 19465596.1 CITY OF MILLBRAE, COUNTY OF SAN MATEO STATE OF CALIFORNIA *** RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MILLBRAE ACCEPTING THE UPPER HILLCREST SUBBASIN 4 SEWER REHABILITATION PROJECT AS COMPLETE AND AUTHORIZING THE FILING OF A NOTICE OF COMPLETION WITH THE SAN MATEO COUNTY RECORDER’S OFFICE WHEREAS, on April 26, 2022, the City Council adopted Resolution No. 22-26 awarding a construction contract to D’Arcy & Harty Construction, Inc. (Contractor) in the amount of $1,612,250 for the Upper Hill Crest Subbasin 4 Sewer Rehabilitation Project (Project) and approving a Project contingency of $242,000; and WHEREAS, a Notice to Proceed was issued to the Contractor on July of 2022, and work began work soon thereafter; and WHEREAS, Contractor has successfully completed all contract work, including replacing approximately 4,600 linear feet of existing 6-inch and 8-inch diameter sanitary sewer main with new high-density polyethylene (HDPE) pipe, lower laterals, cleanouts, manhole frames and covers, sewer flow control, and other improvements within the area; and WHEREAS, two (2) change orders totaling $11,374 were issued for quantity adjustments for lateral replacement types, sewer main work and extra items; and WHEREAS, the final construction cost was $1,623,624 and was below the total authorized construction cost of $1,854,250; and WHEREAS, staff performed the final inspection on the Project and determined all work has been satisfactorily completed with the Project plans and specifications; and WHEREAS, staff recommends that the City Council accept the Project as complete and authorize the filing of a Notice of Completion with the San Mateo County Recorder’s Office. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF MILLBRAE accepts the Upper Hillcrest Subbasin 4 Sewer Rehabilitation Project as complete and authorizes the filing of the Notice of Completion with the San Mateo County Recorder’s Office.
