Thereupon it was moved by Councilman Neil O'Kones and seconded by Councilman H. L. Luwe that the laws and rules providing that ordinances shall be fully and distinctly read on three different days be suspended and be dispensed with and that Ordinance No. 132 be placed upon its last reading. UPON ROLL CALL Councilmen voted upon said motion as follows: Lester Huisman VOTED Aye Chas. Starr VOTED Aye H. L. Luwe VOTED Aye Neil O'Kones VOTED Aye Mayo Tjaden VOTED Aye All members of the Council being present and having voted "Aye," Mayor Groninga thereupon declared the motion carried and Ordinance No. 132 was then placed upon its last reading and was read the last time. Luwe VOTED Aye Neil O'Kones VOTED Aye ,dayo Tjaden VOTED Aye at the Northeast (NE) corner of Block Nine (9) of the Official Plat of the Town of L�1e11sburg, Iowa, and as set out in Section One (1) of Ordinance No. 122 of the revised Ordinances of the Town of TtiTellsburg, Iowa, being an Ordinance establishing the grade of certain streets for said Town. SECTION II. CtiLCUL.�^lED FROM DATUM PLANE. That all sidewalk grades established by this Ordinance, or that may hereafter be established shall be calculated from datum plane established by Section I hereof, and shall be calculated far the top surface of the edge of the walk nearest the lot line of the streets on which the�� are established. SECTION III. CALCULATED IN FEET. That all sidewalk grades shall be calculated in feet and decimals of feet and that the elevations given below shall be the established grade for sidewalks at the following indicated points; SECTION IU. SLOPE TO STREET. That all sidewalks shall have a uniform slope toward the street of one-fourth (1�4) of an inch to the foot. SECTION VII. ELEVATION BET'.�1�'Ei; POINTS. That the elevation for sidewalks between the points indicated above shall be a direct line between said points. SF,C'fION VIII. REPEALING CLAUSE. That all ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. SECTION IX. TIi� OF TAKIPvG EFFECT. Starr offered Ordinance No. 132 of which the following is a copy: ORDINANCE NO. 132 AN ORDINANCE ESTABLISHING A STREET GRADE ON FOURTH STRE�YI' FROM LI1vCOLN STREET EAST TO COiiPORATE LIMITS, ALL IN THE TOIrdN OF �r�ELLSBU'itG, IOWA Be it ordained by the Town Council of the Incorporated Town of Wellsburg, Io�n�a; SECTIOIu I. BASE OF LEVEi�. That the base of levels or datum plane used for establishing sidewalk grades on the street on Fourth Street of the Incorporated Town of 6ti'ellsburg, Iowa, shall be and is hereby established to be One Hur_dred Twelve and eighteen hundredths feet (112.1g ft) below the top surface of the North (N) corner of the concrete foundation of the Northwest (Nti-�') leg of the Tivater Tower of the Town of Wellsburg, located - � - requiring in the aggregate more than one hour• of service, which said service is hereby deemed extraordinary. SECTION VII - TOWN AT'I'ORNEY The Town Attorney shall receive an annual salary of �50.00 to be paid in a single annual payment and such officer shall in addition hereto rec�lve fair and reasonable compensation for any service rendered requiring in -the aggregate more than one hour of service, which said service is hereby deemed extraordinary. SECTION VIII - R.EPEALEk CLAUSE A11 Ordinances or parts of Ordinances in conflict with the provisions of this Ordinance are hereby repealed, this Ordinance specifically repealing Ordinance No. 125 adopted the 2ncl day of December, 1957• SECTION IX - SAVING CLAUSE In any section, provision or part of this Ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. SECTION X - 1N EFFECTIVE This Ordinance shall be in full force and effect from and after its final passage, approval and publication. as provided by law. The following Councilmen were present: Lester Huisman, Chas. � Starr, H. L. Luwe, Neil O�Kones and Mayo Tjaden. The minutes of the previous meeting of the __1i day of �sJ�2�� 1959, were read for approval and correction and approved as read. Councilman Lester Huisman offered Ordinance No. 131 of which the following is a copy: - ORDINANCE NU. 131 ORDINAN CE TO ESTABLISH THE SALARY OF MUNICIPAL OFFICERS BE IT ENACTED BY THE COUNCIL OF THE TOTrdI�T OF WELLSBURG, COUNTY OF GRUNDY, STATE OF IOWA: SECTION I - COUNCILMEN The salary of each Councilman shall be �3.00 for �aeb meeting of the Council and in no event shall he be paid more than �y125.00 in any one year. SECTION II - MAYOR The Mayor shall receive, in lieu of salary and statutory fees, an annual salary of �360.00 to be paid in equal monthly installments. SECTION III - CLERK The Clerk shall receive an annual salary to be paid in equal monthly installments in such amount as the Town Council shall by resolution establish as the annual salary in its regular January meeting as is held each year. - SECTION IV - TREASURER The Treasurer shall receive an annual salary of �125.00 to be paid in equal monthly installments. SECTION V - MARSHALL The Marshall shall receive, in lieu of salary and statutory fees, an annual salary to be paid in equal monthly installments in such amount as the Town Council shall by resolution establish as the annual salary in its regular January meeting as is held each year. SECTION VI - HEALTH OFFICER The Health Officer shall receive an annual salary of �p25.00 to be paid in a single annual payment, and such officer shall in addition hereto receive fair and reasonable compensation for any service rendered
