APPROVING CHANGE ORDER #1
TARHEEL ENTERPRISES -
IMPROVEMENTS TO INDUSTRIAL ROAD
WHEREAS, the Governing Body of the Borough of Carteret has previously
awarded a contract to Tarheel Enterprises based upon an original
contract bid price in the amount of $308,167.75 for improvements to
industrial Road - Phase I, Contract No.: 98-12; and
WHEREAS, the Borough's Consulting Engineer for the project has advised
the Governing Body that a modification of the contract is necessary to
reflect as-built contract quantity adjustments and the replacement of
certain guide rail end treatment; and
WHEREAS, the Borough's Consulting Engineer has recommended that
the contract with Tarheel Enterprises be modified in accordance with
Change Order No. 1 (See attached Change Order), and has further
recommended that the Borough authorize final payment upon said
Contract in accordance with Payment Application No. 3; and
WHEREAS, the Governing Body has reviewed Change Order No. 1 (See
attached Change Order No. 1 and Payment Application No. 3); and
whereas the Governing Body has reviewed Change Order No. 1 and
Payment Application No. 3 which reflect a net reduction of $10,970.80 in
the overall amount of said Contract.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough
Council of the Borough of Carteret, County of Middlesex, State of New
Jersey, as follows:
1. Contract Change Order No. 1, attached hereto and made a
part hereof, resulting in a net decrease of $10,970.80 in the overall
contract price; and the payment of the revised contract price for the
Industrial Road Improvements - Phase I, Contract No.: 98-12, including
said Change Order, in the total amount of $297,196.95 is hereby
approved.
2. The Mayor is hereby authorized to execute Change Order
No. 1.
3. The appFopFiate BOFOUgh officials are heFeby authoFized to
pFOCeSS final payment to Tarheel EnteFpFises in accoFdance
with Payment Application No. 3.
4. That a copy of this Resolution and an executed copy of
Change Order No. 1 be forwarded to Ki[lam Associates.
