The motion was seconded by Mr. Ciriello and it passed unanimously.  An informal discussion was held with Mr. Mina Gaber, Ash Street Homes LLC; Mr. Raouf Mankarious, Alpha Omega Engineering; Mr. Robert Murphy, R.G. Murphy & Associates, about placing a Conservation Easement, instead of a Conservation Restriction as previously determined, on the demarcated four subdivided lots and to remove the existing culvert on Lot 3, Chestnut Street, this coming dry season. The Commission noted they were amenable to a Conservation Easement being placed on the lots and issuing an enforcement order to condition the removal of the culvert and restoration of the intermittent stream. Mr. Harrow arrived at this time. Mr. Mankarious noted the restoration work would be performed mostly by hand. Mr. Murphy noted the soils above and below the culvert could be analyzed to estimate the soil conditions to be exposed from the removal of the culvert. If needed to stabilize the streambed, adequate amounts of gravel, cobbles and stones would be brought in and available to install when the culvert is removed. Mr. Murphy noted adequate erosion and sedimentation controls shall be utilized during the restoration. 7:45 PM Hopkinton Parks & Recreation, 0 Hayden Rowe (U24 10 0) DEP File No. 188-1653 0 Hayden Rowe (U24 10 A), 192 Hayden Rowe Notice of Intent – continuation The applicant requested a continuation to 31 July 2018. 7:45 PM Parsons, 19 John Matthew Road DEP File No. 188-1651 Notice of Intent – continuation Joseph P. Marquedant, J.D. Marquedant & Associates; Ernest Parsons, owner/applicant Hopkinton Conservation Commission 05 June 2018 Page 2 of 5 Mr. Parsons provided a historical overview of the property under his ownership and noted the public uses the existing path. He noted they want to continue allowing the public to use the path but not to allow motorized vehicles. He noted his concerns with the potential for the existing retaining walls to collapse and that the proposed terracing is designed to address the issue. Mr. Marquedant noted that approximately 1,200 square feet of area is proposed to be planted with native vegetation as mitigation for the amount of trees to be removed for the terracing work. A discussion was held regarding enhancing the plantings or installing boulders to discourage motorized vehicle use. The Commission noted that a permanent immovable barrier would be required as discussed. Mr. Harrow made a motion to close the hearing and issue an Order of Conditions, subject to the submission of a revised plan, with the standard and noted special conditions. The motion was seconded by Mr. Ciriello and it was approved by everyone except Mr. Barker-Hook who opposed. ***The Commission signed a signature page for the Order of Conditions.*** 8:13 PM Global Corp., 84, 86, 88, 92 West Main Street DEP File No. 188-1650 Notice of Intent – continuation Jesse Johnson, Bohler Engineering; Tom Danieluk, Global Corp. A discussion was held regarding the BETA Group comments, dated 23 may 2018. It was noted that an increase in native plantings have been added to the plan as previously discussed. The Commission noted that the existing monitoring wells will need to be properly abandoned. Mr. Danieluk noted they are considering installing solar panels on the proposed canopies and an electric vehicle charging station. A discussion was held about the locating a permanent immovable barrier behind the basin and in front of the plantings. Mr. Barker-Hook made a motion to close the hearing and issue an Order of Conditions, subject to the submission of a revised plan, with the standard and noted special conditions. The motion was seconded by Mr. Ciriello and it passed unanimously. *** The Commission signed a signature page for the Order of Conditions.*** 8:25 PM Takacs, 9 Cedar Street Extension DEP File No. 188-1657 Notice of Intent – continuation The applicant requested a continuation to 26 June 2018. 8:25 PM Takacs, 15 Cedar Street Extension DEP File No. 188-1658 Notice of Intent – continuation The applicant requested a continuation to 26 June 2018. 8:26 PM Nation, 0 Whisper Wy (R16 26 1), 5 Whisper Way, DEP File No. 188-1647 0 Wood Street (U14 28 0), 0 Wood Street (U14 28 A), 129 Wood Street Abbreviated Notice of Resource Area Delineation - continuation Craig and Chris Nation, 20th Century Homes; Thomas Rebula; Goddard Consulting Hopkinton Conservation Commission 05 June 2018 Page 3 of 5 Mr. Rebula provided an overview of the revised resource plans dated 29 November 2017, with a final revision date of 25 May 2018. Mr. Ciriello made a motion to close the hearing and issue an Order of Resource Area Delineation. The motion was seconded by Ms. Wronka and it passed unanimously. ***The Commission signed a signature page for the Order of Resource Area Delineation.*** 8:32 PM Gonzalez, 34 Oakhurst Road RDA 2018-4 Request for Determination of Applicability Anthony Gonzalez, owner/applicant Mr. Gonzalez provided an overview of the Request for Determination of Applicability and sketch plan received on 11 May 2018. A discussion was held about removing the existing addition and constructing a new, larger addition. A discussion was held regarding three trees that will need to be removed during construction. It was noted that they would prune a few other adjacent trees as well. A discussion was held regarding the Lucas Environmental memo dated 04 June 2018. It was noted that the downed trees could be chipped and have some mulch placed along the equipment access way. The Commission determined that an erosion control barrier will be required. Mr. Ciriello made a motion to close the hearing and issue a Negative Determination of Applicability, subject to the submission of a revised plan, with the standard and noted special conditions. The motion was seconded by Ms. Wronka and it passed unanimously. ***The Commission signed a signature page for the Determination of Applicability.*** 8:47 PM Nation, 191 Lumber Street DEP File No. 188-1660 Notice of Intent Ron, Craig and Chris Nation, 20th Century Homes; Tom Rebula, Goddard Consulting Mr. Rebula provided an overview of the Notice of Intent and site plan dated 03 May 2018. A discussion was held about the extent of proposed disturbance within the buffer zone. A discussion was held about how the parcel was recently subdivided from a larger parcel and the need for a cumulative analysis. It was noted that the other lots are proposed to be developed outside the resource areas. The hearing was continued to 17 July 2018. Ms. Wronka recused herself and left the meeting at this time. 9:06 PM Town of Hopkinton, 0 Hayden Rowe (U24 10 0), DEP File No. 188-1652 0 Hayden Rowe (U24 10 A), 192 Hayden Rowe Notice of Intent - continuation Peter LaGoy; Robert Weidknect, Beals and Thomas Mr. LaGoy provided an overview of the revised site plan dated 20 February 2018 with annotated plan changes dated 05 June 2018. He noted a meeting was previously held with the neighbors and the Board of Selectmen (BOS), and the spur trail to access Deer Run is no longer proposed to be constructed. Mr. Hopkinton Conservation Commission 05 June 2018 Page 4 of 5 Lagoy noted that they are now proposing to install the wooden footbridge over the existing granite block crossing any stockpiling would be located outside the buffer zone. A discussion was held about the need to coordinate in the future with the construction contractors to determine if the site could be fully accessed from Hayden Rowe. It was noted that if the existing crossing were conducive then it would be protected with swamp mats and or timbers no wider than 10-feet. It was noted that the mats/timbers could be in place for a maximum of 4 months. It was noted that if construction access from Hayden Rowe proved unfeasible then temporary access from Deer Run and adequate restoration could be reviewed as a project change request. Mr. Weidknect noted that if temporary access from Deer Run was needed, it would not need to be ADA compliant and probably could be located outside the buffer zone. Mr. Richard Whitehouse, 13 Blackthorne Circle, noted he does not want the spur trail to be constructed onto Deer Run and is satisfied with installing a footbridge over the crossing from Hayden Rowe. Ms. Joan McCowan, 12 Deer Run, requested the site plan to be revised to reflect the discontinuation of the spur trail to Deer Run. Mr. Doug Nixon, 11 Blackthorne Circle, noted that the BOS put a moratorium on any use of that section of Deer Run. Mr. LaGoy noted the BOS will be forming a committee to review recreational trails on a town-wide basis. The Commission noted any Order of Conditions would not include construction of the spur trail. Mr. Barker-Hook made a motion to close the hearing and issue an Order of Conditions, subject to the submission of a revised plan, with the standard and noted special conditions. The motion was seconded by Ms. Recos and it passed unanimously. ***The Commission signed a signature page for the Order of Conditions.*** Ms. Wronka returned to the Commission at this time. 9:33 PM Commission Business – continued  A discussion was held with Mr. Jim Venicasa, owner, and Mr. Dave Marquedant, J.D. Marquedant & Associates, regarding a project change request for 29/31 Stoney Brook Road (188-1619). It was noted that the reconfigured house location, driveway, and minor septic changes would equate to approximately 277 less square feet of disturbance. Mr. Ciriello made a motion to determine the project change to be insignificant. The motion was seconded by Mr. Harrow and it passed unanimously.  The Commission reviewed an exemption request from Gattonini, 37 Chamberlain Street, for a second floor addition whereas the building footprint would not change. The Commission determined the project would qualify as an exempt activity.  The Commission determined to schedule public meetings for 17 July and 31 July 2018 and to cancel the public meeting scheduled for 24 July 2018.  The Commission reviewed an exemption request from Flannery, 296 Hayden Rowe, for the removal of two trees. The Commission determined the removal of the trees would qualify as an exempt activity Hopkinton Conservation Commission 05 June 2018 Page 5 of 5  The Commission reviewed a project change request from Faramarzi, 10 Downey Place (RDA 2017- 11), to reconfigure the location of the garage no closer to the lake than previously approved. Mr. Barker-Hook made a motion to determine the project change to be insignificant. The motion was seconded by Mr. Ciriello and it passed unanimously.  The Commission reviewed an exemption request from Compass Builders, 54 Downey Street, to install a new footing onto an existing deck and stairs leading away from the lake. The Commission determined the project would qualify as an exempt activity.  The Commission reviewed a draft one year consultant agreement for Lucas Environmental to serve as the Conservation Scientist. Ms. Recos made a motion to approve the one year consultant agreement as drafted. The motion was seconded by Ms. Wronka and it passed unanimously.  A discussion was held regarding the standard ongoing condition subject to restricting pesticide use. The Commission determined to table further discussion to a future meeting.
