A regular meeting of the Mayor and Council was held at 7:30 PM on June 8,2023, in the Municipal
Building.
Meeting Called to Order
Roll Call
The following Council Members and Professional Staff responded to the roll call:
Mayor Kahwaty, Councilmember Ansh, Council President Bonagura, Councilmember Cardenas,
Councilmember Kelly, Councilmember Lambrix, and Councilmember Sheppard. Also present
were Borough Administrator Hart, Borough Attorney Smith and Borough Clerk Rulli.
Sunshine Law Statement:
The Borough Clerk read the Sunshine Law Statement: In compliance with the Open Public
Meetings Law, notification of this meeting has been sent to our official newspapers and notice has
been posted on the Bulletin Board at Borough Hall.

Time for Public Comment
Motion to open the time for public comment was made by Councilmember Kelly, seconded by
Councilmember Lambrix. On voice vote, all in favor.
Laurie Burnette, 746 Lawlins Road, asked if the June 20'h hearing will be postponed and asked
Mr. Hart to look into the eleven additional trees to be planted at Mill Pond.

Mr. Hart stated that he is not aware of postponement of the hearing and stated there has not been
any mediation.
Motion to close the time for public comment was made by Councilmember Sheppard, seconded
by Councilmember Kelly. On voice vote, all in favor.
Engineers Report
Eileen Boland reported contracts will be awarded for the Olentangy Road Flood Mitigation Project
and the Old Mill Road and 2023 Road Program. The Mayor and Council discussed options on
how to best utilize the remaining $150,000 of funds. Ms. Boland outlined the process of selecting
roads to be paved. Mr. Hart suggested in addition to committee discussion to get recommendations
from the DPW.
Mr. Hart reported he received a resident's complaint regarding mosquitos near Hopper's Pond.
Ms. Boland reported there was a recent site inspection and stated the owner can be asked to have
it dredged. There being no objections, Mr. Hart will follow up with Oakland.

BE IT RESOLVED that the following resolutions, placed on this agenda by consent, require no
discussion and the same having been previously reviewed by each Governing Body member, be
and are hereby adopted in their entirety by the Mayor and Council of the Borough of

Mayors Report
Mayor Kahwaty announced that Frank Pedone,who served on the Council from 2011-2013,passed
away in Nevada. He reported he will attend a meeting of the NWBC Mayors on Saturday, and
stated that the Lions' Club, along with the Borough, hosted a successful carnival.
Committee/Liaison Reports
Mayor Kahwaty asked Gary Goodman to discuss the Quality of Life Hires. Mr. Hart provided an
overview of the proposed support request and its impact on the budget. Discussion ensued on the
State law of the department not generating revenue. Councilmember Sheppard expressed support
for the program stating it helps maintain adherence to Borough ordinances.
Mr. Goodman provided an example of a recent incident of a homeowner building without permits
and emphasized that there can be major safety issues if things are not done correctly. He feels the
Quality of Life Hires are a good way to avoid these types of situations and at this time there is not
enough staff to inspect and enforce the code. The Mayor and Council were in favor.
Planning and Development
Councilmember Sheppard reported the Planning Board ran until 11:20 PM to allow all those who
attended the opportunity to speak. Mr. Madaio is putting together a letter to the Mayor and Council
outlining the Planning Boards recommendations. He stated that generally the concerns and
comments included, but were not limited to: noise, light, sound, smell, design, signs, and height.
The Planning Board will review with Borough Planner McManus and seek her advisement.
Administration and Finance
• Amendment to Cat Licensing Ordinance
Mr. Hart stated the language in the Ordinance is being updated.
• Bergen County Community Development Representatives
• Bergen County Open Space Representatives
Mr. Hart stated these are annual resolutions appointing members to represent the Borough at
meetings at the County level.

• Resolution Supporting 5-3906
Mr. Hart explained that Franklin Lakes was one of the municipalities that received a letter from
Senator Kristin M. Corrado requesting support of this resolution for debt reduction. The Borough's
share would be $3,575,000. No objections.
0 Urban Farms 2023-2024 Liquor License Renewal
The Mayor and Council discussed the non-use of the license and despite pressure to utilize it,
Urban Farms has filed for another extension from the State of NJ. Mr. Smith will file an objection.
Public Works
Councilmember Kelly complimented the DPW for the Veterans Day decorations. She stated they
work 30 minutes longer than employees in the Borough Hall and don't get paid for lunch. Mr. Hart
stated no employees are paid for lunch. Mr. Smith responded that these questions should be
addressed during contract negotiations.
Parks and Recreation
Councilmember Ansh stated the Recreation and Parks meeting was cancelled due to the coaches'
schedules. Councilmember Sheppard reported that the Lacrosse teams won three (3)
championships. Councilmember Kelly reported Sterling Shepard was here last weekend and the
football camp was well attended.
• Parsons Pond Park Planning Committee Recommendations
Mr. Hart reported on recommendations made by the Parson Pond Park Planning Committee to
move forward with appropriations. Councilmember Sheppard stated that the options were to make
the building operational or razing it altogether, and he believes the park is underutilized and
outlined the suggestions they discussed to make it operational. He stated by repurposing the
building, it can be used by the Recreation Department as meeting rooms, for storage, and for public
bathrooms. Mr. Hart added that costs can be reduced by managing the project internally. There
being no objections, a Capital Ordinance will be introduced on June 20, 2023 to appropriate funds.
Mr. Hart stated the Borough needs to spend the Bergen County Municipal Grant money this year.
Suggestions included using it for a band shell, a bridge, updating the basketball and pickle ball
courts, Lacrosse fields, and picnic areas. Discussion ensued that addressed noise levels, clean up
and maintenance, amount of usage and staffing. Mr. Hart and Community Director Dina Robinson
will bring these up to the committee for additional discussion and return with their
recommendations.
Environmental & Community Affairs/Library

Councilmember Cardenas reported that there were 853 trees taken down; a tree planting has been
scheduled for Fall and the Ramapo Indian Hills Board of Education met and announced that their
new attorney has resigned. The Library Board has hired a search firm to find a Director and have
praised the group leaders in the absence of a Director. The Environmental Commission has a
student volunteer; Board of Health met and the new Sanitarian was in attendance; and there was a
big increase in marriage licenses in May.
Public Safety
0 School Security
Mr. Hart met with the K-8 schools for a general discussion on what other districts doing, and
options that would be beneficial to Franklin Lakes. He is waiting to hear back on what they may
request from the Borough.
0 Countywide Fire Mutual Aid Agreement
In response to Council President Bonagura's inquiry, Mr. Hart confirmed the Fire Chief is in
support of the agreement.
• Fire Department Capital and Recruitment
Council President Bonagura reported there are concerns there are not enough volunteers which
could lead to the Borough having to implement a paid Fire Department at a huge expense. He
stated other towns have had success with incentive programs and Fire Chief Bohny is working on
an incentive package. Mr. Hart stated a Bond Ordinance will be introduced June 20, 2023.
Mayor Kahwaty noted that the Ambulance Corps was experiencing the same concerns. Council
President Bonagura reiterated that the Ambulance Corps needs a new vehicle. Councilmember
Lambrix stated it is in the Capital Plan.
0 No Parking—Pulis Avenue, Aspen Way and Linden Way
Mr. Hart stated the Police recommendation is no parking and he outlined the parking issues.
Councilmember Kelly asked where people will park for the football games if there is no parking
on these streets. Mr. Hart stated they will begin to park further out and on side streets. Council
President Bonagura inquired if a shuttle bus from Vet Park was an option. Mr. Hart and Mayor
Kahwaty will explore this in more detail.
• Police Hiring Process
Council President Bonagura reported Captain McCombs met with other towns to discuss their
procedures and has outlined a new procedure for the Borough. He stated he supports the
recommendation. Mr. Hart to prepare a resolution for the June 20, 2023 meeting.

Borough Administrator's Report
Mr. Hart reported that former resident, Jack Wallace, played with the United States National Sled
Hockey Team and won a 6 h World Championship. Mr. Hart recommended honoring Jack with a
proclamation at a future meeting. All were in agreement.

Councilmember Ansh asked about televising meetings. Discussion ensued about costs. Mr. Hart
will look into it and report back.
Resolution For Closed Session
BE IT RESOLVED, by the Mayor and Council of the Borough of Franklin Lakes, County of
Bergen and State of New Jersey that a Closed Meeting be held on Thursday, June 8, 2023 which
begins at 7:30 PM, in the Conference Room at the Municipal Building to discuss the following:
• Pending Litigation—Cigna Property (Affordable Housing Attorney to Attend)
• Contractual—Hovnanian Sewers
BE IT FURTHER RESOLVED that the discussion conducted in closed session shall be disclosed
to the public once the matter involving the confidentiality of the above no longer requires that
confidentiality, then the minutes can be made public.
NOW, THEREFORE BE IT RESOLVED, that the public be excluded from this meeting.
Motion to go into Closed Session was made at 8:45 PM by Council President Bonagura, seconded
by Councilmember Lambrix. On voice vote, all in favor.
The Mayor and Council returned to open session at 10:06 PM.

Resolution 166-23 Accept Report of Finance Committee
BE IT RESOLVED, by the Mayor and Council of the Borough of Franklin Lakes that the report
of the Finance Committee be accepted and recommendations adopted;that the report be made part
of the record of this meeting; and the proper Borough Officials are hereby authorized and directed

to issue warrants in the amount of$5,495,001.52 as shown on the Claims Bill List; $12,026.50 as
shown on the Soil Account Bill List; and $1,814.00 as shown on the Developers Escrow List.
BE IT FURTHER RESOLVED, that the payroll of May 25, 2023 in the amount of$275,391.86
be hereby ratified and approved.
Resolution 167-23 Authorize 2023-2024 Liquor License Renewals
WHEREAS, the licensees, herein named, filed renewal applications of their Plenary Retail
Consumption Licenses and Plenary Retail Distribution License for the period from July 1, 2023 to
June 30, 2024; and,
WHEREAS, said applicants made payment electronically to the Alcoholic Beverage Control
Commission, Tax Clearance Certificates have been received, and the required municipal fee of
$2,500.00 paid for said licenses,
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of

Resolution 168-23 Authorize Lead Grant Application
WHEREAS, effective July 22, 2022, the Legislature enacted P.L. 2021, c. 182, "An Act
concerning certain lead-based paint hazard, and residential rental property, and establishing lead-
based paint hazard programs, supplementing P.L. 2003, c. 311 (C. 52:27D-437.1 et al.) amending
various parts of the statutory law, and making an appropriation;" and,
WHEREAS, pursuant to N.J.S.A. 52:27D-437.16(b)(1), a municipality that maintains a
permanent local agency for the purpose of conducting inspections and enforcing laws, ordinances,

and regulations concerning buildings and structures, is required to inspect for lead-based paint
hazards in certain specified single-family, two-family, and multiple rental dwellings, at the time
periods set forth in the statute; and,
WHEREAS,pursuant to N.J.S.A. 52:27D-437.16(b)(2)a municipality that does not maintain such
a permanent local agency must hire a lead evaluation contractor, certified to provide lead paint
inspection services by DCA, or enter a shared services agreement as permitted by law, for the
purpose of conducting the inspections for lead-based paint hazards; and,
WHEREAS,pursuant to Section 9 of P.L. 2021, c. 182,the State of New Jersey has allocated the
sum of$3,900,000 to effectuate the purposes of P.L. 2021, c. 182 (C. 52:27D-437.16). Further,
pursuant to the FY 2023 Appropriations Act(P.L. 2022, Chapter 49), DCA received a grant-in-aid
amount of$3,900,000 for P.L. 2021, c. 182,for a total of$7,800,000 in appropriations to effectuate
the purpose of the Act.
WHEREAS, DCA has allocated $7,000,000 of this appropriation to the development of the Lead
Grant Assistance Program ("LGAP") for the issuance of grant funds to municipalities for the
purpose of assisting in municipal compliance with P.L. 2021, c. 182.
WHEREAS, the Division of Local Government Services (DLGS), within DCA, administers the
LGAP; and,
WHEREAS, the LGAP exists to provide funding to help off-set the costs to municipalities to
provide the required inspections at stipulated times of certain single-family, two-family, and
multiple rental dwelling units for lead-based paint hazards, pursuant to P.L. 2021, c. 182; and,
WHEREAS, an authorized municipal officer must execute the attached grant agreement in order
to receive LGAP funding.
NOW, THEREFORE, BE IT RESOLVED, that the governing body of the Borough of
Franklin Lakes does hereby authorize Mayor Charles J. X. Kahwaty to sign the attached grant
agreement, and thus bind the Borough of Franklin Lakes to the grant agreement's terms in order
to receive the $3,200.00 grant from the DLGS.
Resolution 169-23 Authorize NJDOT Grant Application for Hampton Hill Road and
Terrace Road Project
WHEREAS,the Franklin Lakes Borough is requesting funding from the New Jersey Department
of Transportation Municipal Aid Program.
NOW,THEREFORE,BE IT RESOLVED that Council of the Franklin Lakes Borough formally
approves the grant application for the above stated project.
BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby authorized to submit an
electronic grant application identified as MA-2024-Hampton Hill Road and Terrace Road-00014
to the New Jersey Department of Transportation on behalf of the Franklin Lakes Borough.

BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby authorized to sign the grant
agreement on behalf of the Franklin Lakes Borough and that their signature constitutes acceptance
of the terms and conditions of the grant agreement and approves the execution of the grant
agreement.
Resolution 170-23 Award Contract—2023 Municipal Aid and 2023 Road Resurfacing
Program
WHEREAS, the Borough of Franklin Lakes advertised for and opened bids on June 2, 2023 for
the 2023 Municipal Aid and 2023 Road Resurfacing Program; and,
WHEREAS,the Mayor and Council wish to award this contract to the lowest responsible bidder;
and,
WHEREAS, eight contractors submitted a bid for said project; and,
WHEREAS, the lowest bid was submitted by J.A. Alexander, Inc., 130-158 John F. Kennedy
Drive North, Bloomfield, New Jersey 07003, for Base Bid 1 and Base Bid 2 totaling $799,635.20;
and,
WHEREAS, the Borough Engineer and Borough Attorney have reviewed the bid submitted and
has determined that the bid meet the specifications;
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of
Franklin Lakes, County of Bergen, State of New Jersey that the contract for the 2023 Municipal
Aid and 2023 Road Resurfacing Program be and is hereby awarded to J.A. Alexander, Inc., as
follows:
• Base Bid 1 $151,035.39
• Base Bid 2 $648,599.81
• Total $799,635.20
BE IT FRUTHER RESOLVED that the Chief Financial Officer has certified the availability of
funds for this purchase,

Resolution 171-23 Award Contract—Olentangy Road Flood Mitigation Project
WHEREAS, the Borough of Franklin Lakes advertised for and opened bids on June 2, 2023 for
the Olentangy Road Flood Mitigation project; and,
WHEREAS,the Mayor and Council wish to award this contract to the lowest responsible bidder;
and,
WHEREAS, five contractors submitted a bid for said project; and,
WHEREAS, the lowest bid was submitted by Mike Fitzpatrick Contractors, 16 Cozy Lake Road,
Suite 1, Oak Ridge, New Jersey 07438, for the amount of$53,000.00; and,
WHEREAS, the Borough Engineer and Borough Attorney have reviewed the bid submitted and
has determined that the bid meet the specifications;
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of
Franklin Lakes, County of Bergen, State of New Jersey that the contract for the Olentangy Road

WHEREAS, N.J.S. 40AA-87 provides that the Director of the Division of Local Government
Services may approve the insertion of any special item of revenue in the budget of any county or
municipality when such item shall have been made available by law and the amount thereof was
not determined at the time of the adoption of the budget; and,
WHEREAS, the Director may also approve the insertion of an item of appropriation for an equal
amount; and,

WHEREAS, the Borough of Franklin Lakes has received a $35,309.64 Clean Communities
Grant and wishes to amend its 2023 Budget to include said amount as a revenue;

of Franklin Lakes, that permission be requested by the Director of the Division of Local
Government Services to approve the insertion of an item of revenue in the 2023 Budget in the
sum of$35,309.64 which will be available as a revenue from:

WHEREAS, N.J.S. 40AA-87 provides that the Director of the Division of Local Government
Services may approve the insertion of any special item of revenue in the budget of any county or
municipality when such item shall have been made available by law and the amount thereof was
not determined at the time of the adoption of the budget; and,
WHEREAS, the Director may also approve the insertion of an item of appropriation for an equal
amount; and,
WHEREAS, the Borough of Franklin Lakes has received a $6,952.48, 2023 Distracted Driving
Crackdown Grant and wishes to amend its 2023 Budget to include said amount as a revenue;
NOW THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough
of Franklin Lakes, that permission be requested by the Director of the Division of Local
Government Services to approve the insertion of an item of revenue in the 2023 Budget in the

Resolution 175-23 Chapter 159 2023 Private Donation—Vander Plaat-Vermeulen
Memorial Home
WHEREAS, N.J.S. 40AA-87 provides that the Director of the Division of Local Government
Services may approve the insertion of any special item of revenue in the budget of any county or
municipality when such item shall have been made available by law and the amount thereof was
not determined at the time of the adoption of the budget; and,
WHEREAS, the Director may also approve the insertion of an item of appropriation for an equal
amount; and,
WHEREAS, the Borough of Franklin Lakes has received a $500.00, Private Donation—Vander
Plaat-Vermeulen Memorial Home and wishes to amend its 2023 Budget to include said amount
as a revenue;
NOW THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough
of Franklin Lakes, that permission be requested by the Director of the Division of Local
Government Services to approve the insertion of an item of revenue in the 2023 Budget in the
sum of$500.00 which will be available as a revenue from:

Resolution 176-23 Redeem Tax Lien Certificate—148 Pulis Avenue
WHEREAS, at the Tax Sale held on August 20, 2020 the Borough of Franklin Lakes sold a tax
lien on Block 1609, Lot 2.01, known as 148 Pulis Avenue, Franklin Lakes, NJ 07417, for
delinquent 2019 taxes, property owned by Kazimir Theresa; and,
WHEREAS, this Tax Lien Certificate 420-00004 became a municipal tax lien to the Borough of
Franklin Lakes, 480 DeKorte Drive, Franklin Lakes, NJ 07417 at zero percent interest rate, and a
premium of$0.00; and,

WHEREAS, Lereta, LLC on behalf of Reverse Mortgage, has redeemed Certificate 420-00004,
in the amount of$305.10;
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of
Franklin Lakes, County of Bergen and State of New Jersey that the Chief Financial Officer is
hereby authorized and directed to issue a check in the amount of $305.10 to the Borough of
Franklin Lakes, Current Account,whose address is 480 DeKorte Drive, Franklin Lakes,NJ 07417.

Resolution 177-23 Amendment to Concession Contract—Trail Signage
WHEREAS, the Mayor and Council, by resolution adopted on August 17, 2021, awarded a
contract to Smart Outdoor, Inc., 3 Ernhoffer Drive, Carmel, New York 10512, for the installation
of trail signage at various locations for two years,with a Borough option for an additional two year
period; and,
WHEREAS, Smart Outdoor, Inc., has proposed an Amendment to Concession Agreement,which
amends certain terms of the Agreement between Smart Outdoor, Inc., and the Borough; and,
WHEREAS,the Borough Administrator and the Community Director recommend that the Mayor
and Council approve the Amendment to Concession Agreement;
NOW THEREFORE,BE IT RESOLVED by the Mayor and Council of the Borough of Franklin
Lakes, County of Bergen, and State of New Jersey that the recommendation of the Borough
Administrator and Community Director is hereby approved and the Amendment to Concession
Agreement with Smart Outdoor, Inc., for the installation of trail signage at various locations
throughout the Borough for a two year term be and is hereby approved, as described therein;
BE IT FINALLY RESOLVED that a copy of this resolution be forwarded to Smart Outdoor,
Inc. and the Community Director.

Resolution 179-23 Facilities Use Permit—Simms Complete QB Camp
WHEREAS, Matthew Simms has requested the use of the Pulis Field for a Simms Complete QB
Camp to be held from 4:30 p.m. to 8:30 p.m. on June 2, 2023; and from 10:00 a.m. to 2:00 p.m.
June 24 and 25, 2023; and,
WHEREAS, the Mayor and Council are satisfied that the proposal for use of Borough facilities
meets the requirements of the Borough's field use ordinance;
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of
Franklin Lakes, County of Bergen and State of New Jersey that Matthew Simms is hereby granted
permission to use Borough facilities, Pulis Field, for a Simms Complete QB Camp to be held from
4:30 p.m. to 8:30 p.m. on June 2, 2023; and from 10:00 a.m. to 2:00 p.m. June 24 and 25, 2023,
subject to compliance with all other Borough ordinance requirements as determined by the
Community Director; and,
