APPROVING PROGRESS PAYMENT ESTIMATE NO. 6
& CHANGE ORDER #1
2018 ROAD IMPROVEMENT PROGRAM
WHEREAS, the Governing Body of the Borough of Carteret has previously awarded a contract to S
Brothers, Inc. in the amount of $2,747,521.00 for the 2018 Road Improvement Program; and
WHEREAS, the Borough's Consulting Engineer for the project, CME Associates, has advised the
Governing Body that a modification of the contract is reasonable and necessary and has recommended that
the aforesaid contract be modified in accordance with Progress Payment Estimate #6 & Change Order #1
(see attached); and
WHEREAS, Progress Payment Estimate No. 6 & Change Order #1 include a change in the description of
work and/or to decease quantities to c as

$234,214.90, resulting in a revised contract price of $2,981,735.90 including all previously approved
change orders; and
WHEREAS, the Borough's Consulting Engineer, CME Associates has advised that the above described
changes and/or modifications to the project were unforeseen at the time of the award of the original
contract.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Carteret as
follows:
1. That Progress Payment Estimate No. 6 & Change Order #1 attached hereto and
made a part hereof, resulting in a net increase of $234,214.90 and resulting in a
revised contract price of $2,981,735.90 is hereby approved.
2. That the appropriate Borough Officials are hereby authorized to execute
Progress Payment Estimate No. 6 & Change Order #1, and issue payment
thereon, based upon the recommendation of the Borough Engineer and subject
to attorneys review of the maintenance bond.
3. A copy of this resolution and a fully executed copy of Progress Payment
Estimate No. 6 & Change Order #1 be forwarded to the Borough's Purchasing
Department and CME Associates for distribution to S. Brothers, Inc.

and certified as a true copy of the
original on August 23, 2019.

NOTICE O AWARD OF CHANGE ORDER
Please be advised that on August 22, 2019 the Borough Council of
the Borough of Carteret, Middlesex County, New Jersey, adopted a
Resolution authorizing Change Order #1 providing for a net
increase in the contract amount of $234,214.90 resulting in a
revised contract price of $2,981,735.90.
The Change Order specifically was for S. Brothers, Inc. with regard
to the 2018 Road Improvement Program.
The Borough's Engineer has certified that the changes were
necessary and not anticipated at the beginning of the project.
