HomeMy Public PortalAbout2007-51 800 Crandon Boulevard Parking RequirementsRESOLUTION NO. 2007-51 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, APPROVING A VARIANCE OF PARKING REQUIREMENTS FOR THE PROPERTY LOCATED AT 800 CRANDON BOULEVARD, KEY BISCAYNE, FLORIDA; PROVIDING FOR RECORDING; PROVIDING FOR IMPLEMENTATION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, TRC Real Estate Investment, Inc. is the owner of the Property located at 800 Crandon; and WHEREAS, TRC Real Estate Investment, Inc. has applied for a variance from applicable Village of Key Biscayne Zoning Code regulations, Section 30-184 to permit the use of the Property with 27 parking spaces where 34 are required; and WHEREAS, the Village Council has held the properly noticed public hearing required under the Village of Key Biscayne Zoning and Land Development Regulations; and NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS: Section 1. Recitals Adopted. That the recitals as set forth above are hereby adopted and confirmed. Section 2. Variance Approval and Conditions. The variance is hereby granted, subject to the conditions outlined below: 1. Soil within 5 feet of all trees in the parking lot shall be removed and replaced with new soil that is free of rocks and debris. The trees are to be planted in holes that are 4 ft. deep and 5 ft. in diameter. 2. The new trees shall have a trunk diameter of 3 inches, 6 ft. of clear trunk, and 14 ft. height. VILLAGE ATTORNEY 3. The owner shall demonstrate to staff that the irrigation system is in working condition and that it is automatically activated when watering is required. 4. The above work shall be completed and approved by the Village within 60 days of the date of this Resolution. Section 3. Recording. This Resolution shall promptly be recorded by the applicant at its expense, in the Public Records of Miami -Dade County. A copy of the proof of recordation shall be submitted to the Building, Zoning, and Planning Department. Section 4. Implementation. The Building, Planning, and Zoning Directors are hereby directed to make the necessary notations on the maps and records of the Village of Key Biscayne Building, Zoning and Planning Department and to issue all permits in accordance with the conditions of this Resolution. A copy of this Resolution shall be attached to any building permit application documents. Section 5. Effective Date. That this Resolution shall be effective immediately upon its adoption.
