Approx. 3000 N Federal Hwy, just north of the entrance into Place Au Soleil
Dear Rita:
Previously my client, Mr. O'Hare, had asked Mr. Thrasher to see if the Town could do something
about the trash that has been accumulating in large quantities on the above property along N
Federal Highway. Besides being an eyesore to those who live within the Place Au Soleil
subdivision and pass by the property every day, Mr. O'Hare believes that the present condition of
the property lowers the property values of its neighbors. When Mr. Thrasher said he didn't think
he could accurately determine whether the trash was located within the Federal Highway right of
way or on the adjacent property, Mr. O'Hare provided him with information supporting his
belief. Mr. Thrasher then responded that he "[would] not base [his] actions on matters by [Mr.
O'Hare's] belief of where the property line is. A survey is required."
On May 22 Mr. O'Hare informed Mr. Thrasher that a survey of this property had been made by
O'Brien, Suiter & O'Brien and an FDOT right of way map and Palm Beach County records were
available which showed the boundary between the FDOT right of way and the adjacent property
to be the eastern edge of the sidewalk - which means that the trash Mr. O'Hare had complained
about was indeed located on the property east of Federal Highway within the Town of Gulf
Stream, not within the Federal Highway right of way. Mr. O'Hare then asked Mr. Thrasher how
he intended to proceed; but Mr. Thrasher has not yet responded.
Nothing seems to have been done to date in order to cure the situation, and the trash piles are still
there. Can Mr. Thrasher please provide an update on his efforts to get the property in
compliance?
In the meantime, pursuant to the Public Records Act, Chapter 119 of the Florida Statutes, I am
herewith making a public records request for the following:
A list of any and all surveys, property maps, boundary maps, plats, easements, etc. located
in the Town's records available for Parcel No. 20- 43-46- 04 -00- 000 -1010, Town of Gulf
Stream, FL.

If you refuse to provide this information, Chapter 119 requires that you advise me in writing and
indicate the applicable exemption to the Public Records Act. Also, please state with particularity
the reasons for your decision, as required by Section 119.07(2)(a). If the exemption you are
claiming only applies to a portion of the records, please delete or redact that portion and provide
a list of the remainder of the records, according to Section I I9.07(2)(a).
If you can provide said list of the above requested documents, my client could then decide which
documents he wished to have duplicated. We could then submit that to you for an estimate of
the cost of duplicating the documents he desires. If acceptable, he is willing to pay the actual
cost of duplication as defined in Section 119.07(1)(a). However, if you anticipate that in order to
produce the list requested, "extensive use" of information technology resources or extensive
clerical or supervisory assistance as defined in Section I I9.07(1)(b) will be required, we would
ask that you please provide a written estimate and justification.
I would ask that you provide all the above requested records no later than this coming
MONDAY. JUNE 27, 2013.
