HomeMy Public PortalAboutPolicy Resolution-34 R2015-055RESOLUTION R2015-55 POLICY RESOLUTION NO. 34 POLICY RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NAPA, STATE OF CALIFORNIA, APPROVING THE OFFICIAL CITY LOGO AND OFFICIAL CITY SEAL WHEREAS, on August 25, 1987, the City has approved a City Logo (which may be referred to in this resolution as the “Current City Logo”) which is generally used in identifying City activities, programs, and property. The Current City Logo is shown on Exhibit “C,” attached hereto and incorporated herein by reference. WHEREAS, the City has previously approved a City Seal (which may be referred to in this resolution as the “Current City Seal”) which is generally used in memorializing official City records. The Current City Seal shown on Exhibit “D,” attached hereto and incorporated herein by reference. WHEREAS, the City Council desires to approve an update to the official City Logo, and an update to the official City Seal, to be used by the City as documented in this resolution. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Napa, as follows: 1. The City Council hereby approves the City Logo (which may be referred to in this resolution as the “Updated City Logo”), as shown on Exhibit “A,” attached hereto and incorporated herein by reference. 2. The City Council hereby approves the City Seal (which may be referred to in this resolution as the “Updated City Seal”), as shown on Exhibit “B,” attached hereto and incorporated herein by reference. 3. The City Clerk shall be the custodian of the City Logo and the City Seal, consistent with California Government Code Section 40811. 4. The City Seal shall be used solely for purposes determined by the City Clerk to be necessary or appropriate to memorialize official records of the City. 5. The City Logo shall be used solely by the City, for purposes directly connected with the official activities, programs, or property of the City, as authorized by the City Council or the City Manager. 6. The City Manager is hereby authorized and directed to transition the use of the City Logo from the Previous City Logo to the Updated City Logo in a cost effective manner, so that some uses may be promptly implemented (such as electronic uses), Policy Resolution No. 34 R2015-55 Page 1 of 3 May 19, 2015 Page 1 of 7 but other uses will be implemented over time (such as uses on City vehicles and City property). 7.The City Clerk is hereby authorized and directed to promptly transition the use of the City Logo from the Previous City Seal to the Updated City Seal. 8.The City Clerk is hereby authorized to register the City Logo and the City Seal with the California Secretary of State, and to keep that registration updated, pursuant to California Business and Professions Code Section 14217. 9.No person shall use the City Seal (whether the Previous City Seal or the Updated City Seal, and no person shall use the City Logo (whether the Previous City Logo or the Updated City Logo) unless the use is authorized in accordance with this resolution. For the purpose of interpreting the requirements of California Government Code Section 34501.5, the City shall consider both the City Seal and the City Logo to be “the seal of the city.” Consistent with California Government Code Section 34501.5, no person shall use a reproduction or facsimile of the City Seal or the City Logo in a manner that creates a misleading, erroneous, or false impression that the document or activity is authorized by the City. 10. Administrative Regulations. 10.1. The City Manager is hereby authorized to establish and maintain written administrative regulations to implement the policies set forth in this resolution, in accordance with the requirements of the City Charter, the Napa Municipal Code, and this resolution. The City Manager may delegate the duties and authority set forth in this resolution to the City Clerk or other qualified City employees, to be documented as a part of the administrative regulations. 10.2. A copy of the administrative regulations shall be maintained in the office of the City Clerk. The administrative regulations shall be recommended for approval by the City Clerk, and subject to approval as to form by the City Attorney. 11. This Resolution shall take effect immediately.
