KOCH, JR. COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD, GULF STREAM, FLORIDA. I. CALL TO ORDER Chairman Murphy called the meeting to order at 8:00 A.M. II. Public Hearing A. Declaration of Ex-Parte Communication There was none. B. Administer Oaths Town Clerk Basel swore in Nicholas Goldblatt, Richard Brummer, and Joe Pehota. C. Applications for Development Approval - continued from October 27, 2022. 1. An application submitted by Ocean Avenue Custom Homes LLC, as agent for Benedetto DiCicco, owner of property located at 2775 Avenue au Soleil, Gulf Stream, Florida, legally described as Lot 93 Place au Soleil and 4-46- 43. a. Level 3 Architectural/Site Plan Review to allow the construction of a new 6,970 sq. ft. Colonial West Indies single-family home with two -car garage and swimming pool. Mr. Nicholas Goldblatt, on behalf of Shane Ames, gave a PowerPoint presentation and noted that he had taken into consideration all the suggestions from the Board at the last meeting. He also provided samples of the house color, shutter color and wood for the garage, outlookers, and front door. He added that he also brought options for the columns as he wasn't sure if they were on board with the tile columns or if they wanted them the same color as the house. Board Member Smith preferred the all -white columns as it kept the house more traditional. The remaining board members agreed. Town Clerk Basel brought up the window frames that the Board had asked to be changed from bronze to which Mr. Minutes of ARPB Special Meeting & Public Hearing Held 11-01-2022 @ 8:00 A.M. Goldblatt noted they had changed it to white. The Board agreed it looked cleaner than the bronze. Board Member Smith made a motion to recommend approval of a Level 3 Architectural/Site Plan Review to permit the construction of a new 6,970 sq. ft. one-story Colonial West Indies -style single-family dwelling with a two -car garage and swimming pool, as submitted, with the following conditions: 1. Any minor modifications to the approved landscaping shall be submitted to the Town Manager for review and approval and any major modifications shall be brought back to the ARPB for review and approval, prior to commencement of landscaping. Vice Chairman Dockerty seconded the motion with all voting AYE at roll call. 2. An application submitted by Richard Brummer, Architect for Opus Homes D & E, as Agent for Joseph and Laura Pehota, 996 Pelican Lane, Gulf Stream, Florida, legally described as S/D OF 9-46-43 NLY 109 FT OF WLY 94.52 FT OF E 227.50 FT OF LT 25. a. Demolition Permit to demolish existing structure. b. Land Clearing Permit to clear existing vegetation from the building site. C. Special Exception under Section 70-72(b) to increase the maximum permitted FAR by 96 square feet. d. Level 3 Architectural/Site Plan Review to permit the construction of a new 3,698 sq. ft. two-story Anglo-Caribbean-style single family dwelling with two -car garage, four bedrooms, bonus room, covered loggia and swimming pool. Mr. Richard Brummer, Architect, began his presentation by stating they had taken all the recommendations from the Board and Commission and felt they were now in compliance with what everyone requested. He stated they reduced the master bedroom sliding glass door from a three -pane to a two -pane. Mr. Brummer stated they reduced the amount of glass on the rear elevation from 380-8 to 32% and added they changed the pitch of the roof on the first floor to match the second -floor roof pitch. He noted they added more details around the windows and added shutters to the back windows as well as changed the front door to be half wood and half glass. Mr. Pehota stated that he liked the look of the door with % glass instead of % glass and thought it flowed better with the windows. The Board agreed. Mr. Pehota reiterated that no one could see the house because of the vegetation, and it was on a non -traveled road. Mr. Brummer noted they had framed the sliding doors in the rear, which had reduced the glass, as well as put vertical muntins on all the sliders for a more traditional look. Chairman Murphy asked about the maximum height to which Mr. Brummer stated it had not increased. Town Manager Dunham stated that it 2 Minutes of ARPB Special Meeting & Public Hearing Held 11-01-2022 @ 8:00 A.M. had been discussed at a prior meeting to put two Chippendale features on the front balcony and Mr. Pehota didn't remember that being a requirement and stated he would rather keep it with just one Chippendale. The Board agreed that one Chippendale feature was enough and asked if the Commission had made it a requirement to which Mr. Dunham stated it had been a suggestion, not a requirement. Board Member Smith then brought up the rear balcony that had been a Chippendale design at one time and had now changed to clear glass panes. She commented this was very modern. Town Attorney Nazzaro agreed that it was modern and a house in Place au Soleil had recently been approved for this feature but felt it had slipped through staff review, and with only three members in attendance at that Commission meeting. He added it was not in keeping with the architectural style and thought the Commission would prefer it to be more traditional. Mr. Pehota stated he was at that meeting and stated this look on his house was a totally different look than the one that was approved. The Board was unified in that the glass panes were too modern of a look. Mr. Nazzaro reiterated that the Commission did not like the glass and suggested once again that they look at this house on its own merit and not compare it to the one that was approved. Mr. Brummer and Mr. Pehota both tried to defend the glass panels stating the balcony was small and wedged between the two roofs. Mr. Nazzaro stated it wasn't about compromising but about staying with the architectural style. Chairman Murphy stated the applicant had made so much effort in making this house Anglo- Caribbean, what would be the option in replacing the glass pane to which Mr. Brummer stated they would put in Chippendale. Mr. Pehota wanted to hold out hope to make a case to the Commission. Mr. Pehota brought up the fact, once again, that no one could see the back of the house. Board Member Smith stated she didn't think they were supposed to take into consideration the account that the house could not be seen by anyone when deciding to which Mr. Nazzaro agreed. The Board did not believe the Commission would approve the glass panels and guided the applicant in that direction. Mr. Pehota continued to argue that since they had approved the one in Place au Soleil, he felt they would approve this once they saw it. Town Clerk Basel cautioned Mr. Pehota about comparing houses and reminded him again that each house stood on its own merit. Mr. Pehota repeated that it couldn't be seen from anywhere in Gulf Stream and thought that should be considered with everything else they had compromised on the house. Chairman Murphy stated he understood where Mr. Pehota was coming from but at the end of the day hey had to go with the architectural style. Board Member Roach stated it did not look Anglo-Caribbean with the glass panels. The Board agreed that all the changes that had been made were remarkable and the only thing standing in the way was the glass panel balcony in the rear. Chairman Murphy stated he had walked around the property and neighborhood and with the changes that had been made to the house, he felt it was no longer dissimilar and would fit in nicely with the area. The Board agreed with Chairman Murphy. Board Member Smith asked if the 3 Minutes of ARPB Special Meeting & Public Hearing Held 11-01-2022 @ 8:00 A.M. applicant was open to changing the balcony and Mr. Pehota stated if the Board felt that strong about it then they would change out the glass panels. Town Manager Dunham brought up the lanterns on the house as being stainless steel and Mr. Brummer stated they weren't a shiny steel. Mr. Pehota stated they liked the light fixtures and would like them to remain. The Board didn't think it was a horrible lamp and since there was no guidance for Anglo-Caribbean and it was more personal taste. Board Member Smith made a motion to recommend approval of a Demolition Permit to demolish existing structure. Vice Chairman Dockerty seconded the motion with all voting AYE at roll call. Board Member Smith made a motion to recommend approval of a Land Clearing Permit to clear existing vegetation from the building site. Board Member Roach seconded the motion with all voting AYE at roll call. Board Member Smith made a motion to recommend approval of a Special Exception to allow 96 sq. ft. of covered, unenclosed floor area that exceeds the maximum permitted floor area ratio. Vice Chairman Dockerty seconded the motion with all voting AYE at roll call. Board Member Smith made a motion to recommend approval of a Level 3 Architectural/Site Plan Review for construction of a 3,698 sq. ft. two- story, Anglo-Caribbean-style, single-family dwelling with a two -car garage, four bedrooms, bonus room, covered loggia, and swimming pool with the following conditions: 1. Prior to applying for any permits related to these approvals, the applicant will record a unity of title for the parcels that are part of the Town's Annexation Ordinance 22/8. 2. Any minor modifications to the approved landscaping shall be submitted to the Town Manager for review and approval and any major modifications shall be brought back to the ARPB for review and approval, prior to commencement of landscaping. 3. Prior to the issuance of a certificate of occupancy or certificate of completion, the owner of the property shall prepare and record a deed restriction which, at a minimum, shall provide that all roof projection areas required to remain unenclosed as per approval of this special exception shall remain so for as long as the structure is in existence or exceeds the maximum permissible FAR.
