A SPECIAL ORDINANCE VACATING A DEDICATED ROADWAY
WHEREAS, Living Word Christian Fellowship has petitioned the Common Council of
Richmond, Indiana, requesting a portion of a platted, but unused, dedicated
roadway at West Main Street and Northwest 20th Street. A copy of a map
showing the parcel to be vacated is attached hereto as "Exhibit A"; and
WHEREAS, the only abutting landowner is as follows:
(a) Living Word Christian Fellowship, 1990 West Main Street, Richmond,
Indiana 47374.
WHEREAS, Common Council, pursuant to Indiana Code § 36-7-3-12, conducted a public
hearing on said petition 12/6 , 2004, after publishing legal notice thereof
at least ten (10) days in advance of said hearing as required by statute; and
WHEREAS, the Richmond Advisory Plan Commission, pursuant to Richmond Code §
155.04(b), conducted a public hearing on said petition 11/19 , 2004
after publishing legal notice thereof at least ten (10) days in advance of said
hearing as required by ordinance; and
WHEREAS, it is desirable to vacate said dedicated roadway.
NOW, THEREFORE, be it ordained by the Common Council of the City of
Richmond, Indiana, that subject to the preservation of easements for existing utilities, the
portion of dedicated roadway described in attached Exhibit A is hereby vacated and that
ownership of such land shall vest in the abutting property owner.
Passed and adopted this 6th_ day of December 2004, by the Common Council of the
City of Richmond, Indiana.
