RESOLUTION NO. 2000-05
A RESOLUTION OF SUMMARY VACATION OF THE TOWN COUNCIL OF THE TOWN OF
TRUCKEE CONVEYING DEED OF A PORTION OF THE RICHARDS BOULEVARD
RIGHT-OF-WAY TO FRANK KAVKA
WHEREAS, the To~vn of Truckee has received a request to vacate and abandon approximately 3,920
square feet of land within the Richards Boulevard right-of-way to be consolidated with the adjoining parcel
(APN 18-550-08, Kavka);
WHERAS, a subsequent professional land survey in support of the abandonment resulted in an actual
4,221 square feet of right-of-way area to be abandoned, determined to be substantially consistent with the
approved abandonment and maintaining an adequate resultant Richards Boulevard right-of-way width;
WHEREAS, the abandonment is directly associated ~vith a concurrently approved lot line adjustment
involving the configuration of two legal parcels from the existing three legal lots currently described and
assessed under one Assessor's Parcel Number 18-550-08 owned by Kavka;
WHEREAS, recordation of the necessary title documents to complete the right-of-way conveyance
and to reconfigure the existing three legal lots into two developable parcels shall constitute a Certificate of
Compliance pursuant to the requirements of the State of California Subdivision Map Act;
WHEREAS, the Town Council adopted Resolution of Intention to Vacate 2000-01 approving the
vacation of said portion of the Richards Boulevard right-of-way on January 6, 2000;
WHEREAS, the applicant has adequately completed all necessary actions required to proceed with
the conveyance of the subject right-of-way property;
NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF
TRUCKEE,
In exchange for the determined $2,500 fair market value of the land, the Town of
Truckee will dispose of that portion of Richards Boulevard as described in Exhibit A
for the purpose of adding this portion of right-of-way land to the adjoining parcel (APN
18-550-08, Kavka).
The Town Clerk shall be authorized to have recorded a deed of transfer of the area to
be vacated by the Town of Truckee to Kavka.
The foregoing Resolution of Summary Vacation was introduced at a Regular Meeting of the Truckee
Town Council, held on the 20th day of January, 2000, by Councilmember Drake, who moved its adoption, and
which motion was duly seconded by Councilmember Florian, was upon roll call carried and the Resolution
adopted by the following vote:
