HomeMy Public PortalAbout012-2012 - Resolviong the cost of the Sewer Project will notfl CONFIRMATORY RESOLUTION OF THE BOARD OF SANITARY COMMISSIONERS OF THE RICHMOND SANITARY DISTRICT RESOLUTION NO. 12 -2012 WHEREAS, the Board of Sanitary Commissioners ( "Board ") of the Richmond Sanitary District ( "District "), at a meeting of the Board held on July 24, 2012, adopted a declaratory resolution ( "Declaratory Resolution ") determining that it is necessary for the public health and welfare and will be of public utility and benefit to construct certain additions and improvements to the sewage works of the District as more firlly described on Exhibit A attached hereto and incorporated herein by reference ( "Projects "), together with necessary appurtenances, related improvements and equipment, and the incidental expenses in connection with the Projects and the issuance of bonds therefor; WHEREAS, the Board published notice of a public hearing to be held on August 14, 2012, which notice was published in the Palladhan -Item and stated that a public hearing would be held by the Board on this date for the purpose of receiving and hearing remonstrances from persons interested in or affected by these proceedings, including persons owning real or personal property located within the District and persons owning land which may be injuriously affected by these proceedings, and at which hearing the Board would take final action to determine the public utility and benefit of the Projects; WHEREAS, the Board on August 14, 2012, held such hearing and received and heard any remonstrances presented from persons interested in or affected by these proceedings and considered the evidence presented at such hearing; and 112908597.1 WHEREAS, the cost of proceeding with the Projects of the District, including the incidental costs associated therewith and with the issuance and sale of bonds to provide funds therefor is estimated not to exceed $40,000,000; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SANITARY COMMISSIONERS OF THE RICHMOND SANITARY DISTRICT, THAT: Section 1. The Board finds and determines that it will be of public utility and benefit to undertake the proposed Projects, as described in the Declaratory Resolution and confirmed by this Confirmatory Resolution. Section 2. The estimated cost of the Projects will not exceed $40,000,000. The estimated cost includes all necessary expenses to be incurred in connection with the proceedings and the Projects, including a sum sufficient to pay the costs of supervision and inspection during construction, the costs of necessary records, engineering expenses, specifications, contingencies, inspections, publication of notices, the issuance and sale of bonds to provide funds for the Projects and expenses and fees incurred in connection therewith and other necessary expenses to be incurred in connection with the letting of contracts with regard to the Projects. Section 3. In all respects the Declaratory Resolution is hereby confirmed. Section 4. This resolution will be open to inspection by all persons interested in or affected by the Projects. These included a comprehensive Combined Sewer Overflow (CSO) Long Term Control Plan (LTCP), a Stormwater Management plan and a Sanitary Sewer plan. The CSO LTCP was updated in 2010. Included in these plans were projects for the conveyance system and improvements at the wastewater treatment plant. Specific projects that now need to be funded include: replacement of the East Side interceptor, phase III, South "H" Street Collector Sewer Improvements and South "G" Street Collector Sewer Improvements, NW 13th Street Interceptor Sewer Improvements and Wastewater Treatment Plant Activated Sludge Process Modifications and Improvements. The East Side Interceptor includes the replacement of the existing sewer with a larger sewer starting at the wastewater treatment plant (WWTP) and extending to the new Chester Blvd Interceptor siphon near North 8th Street. Phase III runs from South "G" Street to the Chester Boulevard Siphon near North 8 Street. South "H" Street and South "G" Street Collector Sewer improvements include new storm and sanitary sewers for separation. NW 13th Street Interceptor Sewer improvements include replacement of a portion of the existing sewer and Inflow /Infiltration (III) work. Wastewater Treatment Plant Activated Sludge Process modifications and improvements include upgrades to the aeration basin blower and other associated activated sludge process equipment. Other components of projects in the improvements, Chester Boulevard Interceptor, Improvements, Round Barn Road Interceptor improvements and several other Wastewater projects. master plans include: West Side Interceptor Phase I11, North/Far Noilh Richmond Collector improvements, Midwest Industrial Park sewer Creatment Plant projects and collection system -4- 1/2908597.1
