HomeMy Public PortalAbout1999-18 Vacate Public Right-of-WayORDINANCE 1999 -18 An Ordinance Approving the Petition to Vacate Public Right -of -Way Located in the City of Greencastle, Putnam County, Indiana WHEREAS, Jack M. Dalton and Shirley N. Dalton are the owners of certain real estate which is located in an area under the jurisdiction of the Common Council of the City of Greencastle; and WHEREAS, there are certain public ways contiguous to said real estate; and WHEREAS, the abutting landowners to the public way to be vacated are as follows: Jack M. & Shirley N. Box 66 Greencastle IN 46135 Cente point IN 47810 ® WHEREAS, all of the public way to be vacated lies wholly with in the jurisdiction of the Common Council of the City of Greencastle, Indiana; and WHEREAS, the Plan Commission of the City of Greencastle, Indiana, did at its regular meeting held September 27, 1999, approve the petition of Jack M. Dalton for the vacation of certain public streets and alleys located in the City of Greencastle, Indiana; and WHEREAS, the Common Council of the City of Greencastle, Indiana, pursuant to law, published notice that this matter would come before the Common Council for public hearing at the regular meeting of the Common Council to be held on Tuesday, October 12, 1999 at 7:00 p.m. at the Putnam County Public Library, 103 East Poplar, Greencastle, Indiana; and WHEREAS, the adjoining property owners have consented or have been notified pursuant to statute as to the vacation of the public ways; and WHEREAS, the Common Council of the City of Greencastle, Indiana, has, after public hearing, determined that closing of the following described public ways is in the public and economic interest of the City of Greencastle, such closing will not unreasonably interfere with the flow of traffic on the City of Greencastle road system and that the relief prayed for in said Petition should be granted and that the portion of the described public ways located in the City of Greencastle, Indiana, should be vacated. S NOW, THEREFORE, be it ORDAINED by the Common Council of the City of • Greencastle, Indiana, that the following public streets and alleys located in the City of Greencastle, Putnam County, Indiana, and more particularly described as follows: Situate in the State of Indiana, county of Putnam and being a part of Block 6, Silver's Survey, a Subdivision of Lots #54, 55 and 56 of Railroad Enlargement to the City of Greencastle, more particularly described to -wit: Beginning at the Northwest corner of Lot #1, Block 6 in Silver's Survey, a Subdivision of Lots #54, 55 and 56 of Railroad Enlargement to the City of Greencastle; thence South 290 feet with the East right -of -way line of Water Street to the Southwest corner of Lot 48; thence East 290 feet with the North right -of -way of a 20 foot wide street to the Southeast corner of Lot #5; thence South 20 feet tot he south right -of -way line of a 20 foot wide street; thence West 310 feet with said South right -of -way line to it's intersection with the West right -of -way of Water Street; thence North 310 feet with the West right -of -way line of Water Street; thence East 20 feet to the point of beginning, containing 0.28 acre, more or less. Also, the alleys running North and South and East and West through Block #6 described as follows: Beginning at the Southwest corner of Lot #1, Block #6 in Silver's Survey, a Subdivision of Lots #54, 55 and 56 in the Railroad Enlargement to the City of Greencastle; thence East 140 feet to • the Southeast corner of Lot #2; thence North 139 feet to the Northeast corner of Lot #2; thence East 10 feet to the Northwest corner of Lot 43; thence South 139 feet to the Southwest corner of Lot #3; thence East 140 feet to the Southeast corner of Lot #4; thence South 12 feet to the Northeast corner of Lot 45; thence West 140 feet to the Northwest corner of Lot #6; thence South 139 feet to the Southwest corner of Lot #6; thence West 10 feet to the Southeast comer of Lot #7; thence North 139 feet tot he Northeast corner of Lot #7; thence West 140 feet to the Northwest corner of Lot #8; thence North 12 feet to the point of beginning, containing 0.16 acre, more or less. Containing a total of 0.44 acre to be vacated. are hereby vacated as a public right -of -way of the City of Greencastle, Putnam County, Indiana, and that such lands shall cease to be a public street, alley or right -of -way and that title to such vacated land shall revert to law to Jack M. Dalton and Shirley N. Dalton, Phillip L. and Sharon K. Skinner, Skelton Skinner Lumber Co., and Stuart Moore Oil Company, pursuant to law. This Ordinance shall have the full force and effect of law immediately upon its passage by the Common Council of the City of Greencastle, Indiana.
