HomeMy Public PortalAbout2007-58 621 North Mashta DriveRESOLUTION NO. 2007-58 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, APPROVING A VARIANCE OF DOCK SIZE FOR THE PROPERTY LOCATED AT 621 NORTH MASHTA DRIVE, KEY BISCAYNE, FLORIDA; PROVIDING FOR RECORDING; PROVIDING FOR IMPLEMENTATION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, J. Barclay Collins, is the owner of the Property located at 621 North Mashta Drive, Key Biscayne, FL and legally described as Lot 8, Block 1, Mashta Island Subdivision as recorded in Plat Book 65, Page 65; and WHEREAS, the owner has applied for a variance from applicable Village of Key Biscayne Zoning Code regulations, Section 30-100 (e)(3)(a)(5) to permit the construction of a boat dock extending 14 feet into the adjacent waterway where 10 is permitted; and WHEREAS, the Village Council has held the properly noticed public hearing required under the Village of Key Biscayne Zoning and Land Development Regulations; and NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS: Section 1. Recitals Adopted. That the recitals as set forth above are hereby adopted and confirmed. Section 2. Variance Approval and Conditions. The variance is hereby granted, subject to the condition outlined below: 1. The dock shall be constructed substantially in compliance with the dock as shown on that certain plan entitled 621 North Mashta Drive as prepared by Robert E. Samara, P.E. containing 1 page and dated August 16, 2007. Section 3. Recording. This Resolution shall promptly be recorded by the applicant at its expense, in the Public Records of Miami -Dade County. A copy of the proof of recordation shall be submitted to the Building, Zoning, and Planning Department. Section 4. Implementation. The Building, Planning, and Zoning Directors are hereby directed to make the necessary notations on the maps and records of the Village of Key Biscayne Building, Zoning and Planning Department and to issue all permits in accordance with the conditions of this Resolution. A copy of this Resolution shall be attached to any building permit application documents. Section 5. Effective Date. That this Resolution shall be effective immediately upon its adoption.
