A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, AUTHORIZING
THE EXPENDITURE OF AN AMOUNT NOT TO EXCEED
TEN THOUSAND ($10,000) DOLLARS , FROM THE LAW
ENFORCEMENT TRUST FUND FOR THE POLICE
MEMORIAL IN WASHINGTON D.C.; PROVIDING FOR
EFFECTIVE DATE.
WHEREAS, a plan for a police memorial in Washington, D.C. (the "Memorial"), has been
put into place; and
WHEREAS, the Memorial will consist of not only a memorial site but also a training and
educational facility; and
WHEREAS, the monies for the proposed expenditure are the result of seized assets from
joint investigations between the Village of Key Biscayne Police Department and other local Law
Enforcement Agencies, not from tax revenue; and
WHEREAS, since this expenditure is from said forfeited properties, this Police Department
need may be satisfied at no cost to our residents; and
WHEREAS, pursuant to Village Charter Section 7.05, related to grants and charitable
contributions, in order for the Village to grant these funds to the Memorial all seven (7) Council
Members must approve the contribution; and
WHEREAS, the Chief of Police has recommended that this expenditure be made from the
Village's Law Enforcement Trust Fund for "Other Law Enforcement Purposes", as authorized by
law, ; and
WHEREAS, costs for "Other Law Enforcement Purposes" is an authorized expenditure of
the Florida Contraband Forfeiture Act; and
WHEREAS, the Chief of Police has requested the adoption of this Resolution and has
certified that the proposed expenditure complies with F.S.S. § 932.7055, the Florida Contraband
Forfeiture Act.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF KEY
BISCAYNE, FLORIDA AS FOLLOWS:
Section 1. Recitals Adopted: That each of the recitals stated above are hereby adopted
and confirmed.
Section 2. Contribution Authorized. That the Chief of Police is hereby authorized to
expend ten thousand ($10,000) dollars as a contribution for the Police Memorial in Washington,
D.C.. The funds for this expenditure shall come solely from the Law Enforcement Trust Fund
Account.
Section 3. Effective Date: That this Resolution shall take effect immediately upon the
approval of the adoption of this Resolution by the affirmative vote of all seven council members.
PASSED AND ADOPTED this 27th day of November, 2007, by a vote of 7-0 affirmative
vote.
