HomeMy Public PortalAbout70-126 ORDINANCE NO . 70-126 AN ORDINANCE OF THE CITY OF CARSON CHANGING CERTAIN REGULATIONS OF PEDDLERS WITHIN THE CITY AND AMENDING THE CARSON MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF CARSON DOES HEREBY ORDAIN AS FOLLOWS: Section 1 . The Carson Municipal Code is hereby amended by adding to Article VI, Chapter 3, a Section 6305 to read as follows: 6305. Amendment to License Ordinance. Notwithstanding the provisions of Section 6300 of the Carson Municipal Code, Sections 603 and 604 of the License Ordinance are amended to read as follows: Sec. 603 Exceptions to Section 602. Section 602 does not apply to: (a) Merchants having a fixed place of business in the City of Carson. (b) Employees of such merchants. (c) Farmers selling farm products produced by them. "A fixed place of business" as that term is used in this Section is any structure permanently affixed at a particular site in compliance with the provisions of Article VIII of the Carson Municipal Code and with the provisions of the Health Code of the City of Carson. Sec. 604 Peddlers--Must Keep Moving. A person engaged in the business of peddling, selling, or de ivering liquids or edibles for human consumption from packs, baskets, handcarts, wagons, or other vehicles, or temporary stands, either retail or wholesale, shall not remain or permit his pack, basket, handcart, wagon or other vehicle, or temporary stand to remain in any one location for the purpose of sale or display of liquids or edibles for more than thirty (30) minutes during any twenty-four (24) hour period or return to the same location within any twenty-four (24) hour period. Section 2. The Carson Municipal Code is further amended by adding a new Section 6306 to read: 6306. Further Amendments to License Ordinance. Notwithstanding the provisions of Sections 6300 and 6305 of the Carson Municipal Code, an exception to the provisions of Section 604 of the License Ordinance is automatically granted to a person licensed under Section 602 of the License Ordinance who on April 1, 1970, held a lease on land in the City for maintenance of such a vehicle or temporary stand, for a period not to exceed six (6) months or the remaining life of such lease, whichever is the lesser.
