The Council of the City of Medina met in regular session on Tuesday, January 16, 1979 14 9
et 7:35 P.M.
Members present: Mayor, Thomas Anderson; Councilmembers, Nancy Laurent, Sarah Lutz,
William Reiser, Thomas Crosby; Clerk, Donna Roehl; Planning and Zon-
ing Administrator, Robert Derus; Police Chief, Charles Hoover; Public
Works Director, Ron Duran; Attorney, Richard Schieffer
1. Minutes of January 3, 1979
Thomas Crosby asked that Item 1, page 144, "Holasek Ditch", line 11, be changed by adding
"prior" before the word "permission."
At the suggestion of James Lane, representing George Hansen, the following was added to
Item 3, page 145: at the end of first paragraph: Mr. Lane said Mr, ansen has no present
plans to build upon the 3.25 acre parcel being acquired, but may, in the future use it for
access to easterly 60 acres of the property. The Council noted that an additional dwelling
would not be added to what will then be a 4.5 acre tract, without platting or variance.
Motion by Reiser, seconded by Lutz to accept minutes of January 3, 1979, as corrected.

2. POLICE DEPARTMENT
Open Burning Ordinance
Richard Schieffer reported that Iledina's ordinance does not meet standards of the state
ordinance and complaints have been received from a Medina resident regarding open burning,
thm the state wants the ordinance enforced.
Motion by Crosby, seconded by Lutz to authorize the attorney to compare the city ordinance
with that of the state and return to the February 6th meeting with advice as to proper pro-
cedure.
Motion declared carried
3. PUBLIC WORKS DEPARTMENT
Northwestern Bell Telephone Co.
Motion by Crosby, seconded by Reiser to approve Resolution 79-2, allowing Northwestern Bell
Telephone Co. to bury cable on Hamel Rd. and on Elm Creek Dr.
Motion declared carried
Paul Winter
Richard Schieffer reported on a hearing notice that had been received regarding a determination
being made on Janwary 30th as to whether or not a second hearing regarding unemployment comp-
ensation would be allowed. Mr. Winter did not appear at the originally scheduled hearing.
Motion by Luarent, seconded by Crosby to authorize the attorney to attend the January 30th
hearing.
Motion declared carried
Right -Of -Way Alteration Ordinance
Discussion of prepared ordinance as it would apply to farmers tilling to the edges of roads.
Attorney stated that this ordinance does not cover that type of situation.
Nancy Laurent suggested talking to people inxolved before preparing an ordinance to cover.
Motion by Reiser, seconded by Lutz to adopt urdinance No. 177, regarding alteration in Road -
right -of -way.

4. NORTHRIDGE ESTATES( WESTRIDGE PLAT)
Robert Denis reported that in researching documents only an easement on the west side of
Tamarack (Deer Hill Rd.) can be located, therfore, no easement vacation would be necessary.
He asked if the JacQues-Reiser easement could be used to serve the entire plat, it then could
be connected to Cherokee Rd. He stated that it is listed as a non-exclusive easement in Mr.
Jacques deed.
Thomas Crosby stated that he felt that it could not be used unless an agreement with Mr.
Jacques was reached.
Derus also asked for clarification as to length of cul-de-sac restrictions in the zoning code.
Richard Schieffer reported that cul-de-sacs cause problems with snow plowing, safety,
150 etc. In this situation all vehicles would need to use Co. Rd. 24 as an entrance which
may cause traffic problems.
Phil Zietlow asked if a blanket requirement of mound septic systems should be approved for
the entire plat; also what is the definition of buildable soil and expressed the concern
of the property owners to the south as to water run. -off that may be created.
Engineer Gary Gabriel of Northridge stated that the developer would like a determination
by Council of the septic system requirement and he explained that the Minn.ehaha Creek
Watershed district had tole them that they connot create more water run-off than is
presently created.
Concensus of the council was that the Planning Commission should review and suggest what is
considered a buildable site and the developer should resolve the cul-de-sac issue.
5. MARK PETERSON
Mr. Peterson presented a site plan indicating the following set -backs of his propmed house;
140 ft. from Co. Rd. 24; 65 ft. from the west lot line; 100 ft. from the rear lot line;
caboose to be 30 ft. from the house. Plan also indicated that screening would be provided
on the north and east sides of the caboose.
Thomas Anderson stated that if the building were allowed to remain state building codes
would need to be complied with.
Mr. Peterson stated that he had gotten direction from the building inspector as to the
requirements.
William Reiser asked what type of structures could be denied if the caboose were allowed
to remain.
Thomas Anderson stated that all structures would need to apply to the present ordinances unless
another ordinance is adopted forbidding types of esthetic structures.
Thomas Crosby asked what type of flexibility Medina would have if ordinance were adopted out-
line esthetic structures.
Richard Scheffer explained that it could be tied to the zoning code.
Thomas Crosby stated that to be consistent with the present zoning code fir. Peterson would
need to remove the caboose.
Motion by Crosby, seconded by Reiser to deny request for designation of caboose as an
accessory building and require that Mr. Peterson remove the caboose from the property
on Co. Rd. 24, within 6 months.
Sarah Lutz inquired as to whether Mr. Peterson could declare the caboose an artistic struc-
ture because motion has designated it as an accessory building.
Richard Schieffer explained that the applicant could apply under another section of the zoning
code.
Mrs. Peterson asked if they could build a shed fashioned after a caboose.
Thomas Crosby stated "Yes", the city does not have architectual control.
Mr. Peterson explained that the structure far exceeds building requirements if one were to
build such a structure and if it meets building code why would it not be allowed?
Mr. Crosby stated that council was dealing with the interpretation of the zoning code, not
the building code.
Mayor Anderson called for a vote on the motion.

6. PLANNING COMMISSION
Motion by Reiser, seconded by Lutz to appoint Ronald Fortin to fill the unexpired planning
commission term of Tom Anderson, term to expire March 1, 1979•

7. BLACKE'OOT TRAIL
Mary Weinzierl and Phil Roe appeared to request clarification of the Blackfoot Trail
development contract regarding blacktopping.
Mr. Roe, a potential buyer of one of the lots, inquired as to the requirement if the
owner of the property to the west were to use the easement to entrance on Blackfoot Tr.
If that owner were considered an additional unit using the road it would have 8 units using
as entrance and contract provides that any unit over 7 would necessitate blacktopping.
Attorney explained that property owner to the west was not considered a part of the original
covenant.
Council determined that properties outside of lots A through G would not be included
in calculating blacktopping requirement as set forth in the development contract
with Mr. Berthiaume.
8. SIEVE MUTH
Mr. Muth discussed with council his purchase of property on Hwy. 55 from Mssr. Lamkin-LaCrosse,
securing an easement from Fidel Eckes to enter from Arrowhead, and building a road to city
specifications. He inquired if the city would accept the road at some future date and if
a variance for length of cul-de-sac could be gotten.
Council requested that Mr. Muth supply an easement to his north property line if rationale
indicates such an easement is needed. Justification should be supplied for granting of a
variance.
9. MEDINA - MORNINGSIDE SEWER
Lyle Swanson reported that Long Lake has adopted a resolution allowing construction of the
sewer line through Long Lake. They ask that the size of the line be increased from 8 to 10
inches. Also Orono should pay cost of the line that will serve Eackberry Hill.
Engineer advised that a public hearing be set to discuss and explain the proposed sewer.
Motion by Reiser, seconded by Crosby to hold a public hearing on Tuesday, February 20, 1979
at 8:00 p.m. to discuss proposed plans for Medina,-Morningside sewer.

Discussion and revision of format of study committees.
Motion by Reiser, seconded by Lutz to accept committee outline as amended.

Motion by Crosby, seconded by Reiser to allow committees to add additional members not to
exceed. 10 people on any committee.

11. CITIZENS ADVISORY COMMITTEh
Motion by Crosby, seconded by Lutz to recommend Joe Bizzano as an alternate representative
to the Citizens Advisiory Committee.

12. CIGARETTE LICENSES
Motion by Reiser, seconded by Crosby to grant 1979 cigarette licenses to Pat's Liquor, Big
Woods Saloon, and Colonial Drive In Theatre.

13. NORTHWEST CINEMA CORPORATION
Motion by Crosby, seconded by Reiser to grant the Colonial Drive In Theatre (Northwest Cin-
ema Corporation) license to operate during 1979•

14. SPRINGER LAND DIVISION
Motion by Crosby, seconded by Reiser to authorize the Mayor and Clerk to enter into indemnity
agreement with owners involved in building a road into the Springer land division.

15. HENNEPIN COUNTY CRIMINAL JUSTICE COUNCIL
Motion by Reiser, seconded by Laurent to reject the resolution allowing for election of
directors to the Justice Council by members of the Association of Metropolitan Municipalities.

16. BOARD OF REVIEW MEETING
Motion by Crosby, seconded by Reiser to hold the annualBoard of Review meeting on Tuesday,
June 5, 1979 at 7:00 p.M.

18. JUMNILE OFFICERS SEMINAR
Motion by Laurent, seconded by Lutz to authorize attendance

Motion by Lutz, seconded by Crosby to request the following

20. PICK-UP TRANSMISSION
Ron Duran presented 2 quotes for repair of transmission of 1969 Pickup truck:
Chunk Swensons Garage $400.00; Medina Automotive, $304.40.
Motion by Laurent, seconded by Crosby to authorize Greg Dubay of Medina Automotive to repair
the transmission in the 1969 Chevrolet pickup for $304,40, using a rebuilt transmission plus
any additional parts, not listed, at additional cost.

21. BUDGET 11;00 P.M.
Motion by Crosby, seconded by Laurent to join the league of Minnesota Cities at a cost
of $498.00 through August of 1979.

Regarding salaries Mayor Anderson reported that an increase of 10.275 would be needed to
keep up with'inflation. He also stated that a 15% increase would put Jerome LaFond in
the average salary catagory of comparable police in the surrounding eommunites but Chief
Hoover and Officer Rouillard would -still be low.
Various other budget items were agreed upon.
Motion by Reiser, seconded by Laurent to hold a special meeting on Tuesday, January 23rd.
at 8:00 p.M. to discuss budget only.
