HomeMy Public PortalAbout2007-60 Public Beach-Sand Dune Restoration ProjectRESOLUTION NO. 2007-60 A CAPITAL PROJECT AUTHORIZING RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, CONCERNING THE PUBLIC BEACH, SAND DUNE RESTORATION PROJECT (THE "PROJECT"); AUTHORIZING PURCHASE OF SAND AND SAND TRANSPORT AND DELIVERY SERVICES; AND AUTHORIZING PURCHASE OF ADDITIONAL SERVICES CONCERNING PLACEMENT OF SAND FOR IMPLEMENTATION OF THE PROJECT; AUTHORIZING VILLAGE MANAGER TO EXECUTE PURCHASE ORDERS AND RELATED DOCUMENTS AND AGREEMENTS FOR THE PROJECT; AUTHORIZING EXPENDITURE OF FUNDS; AUTHORIZING IMPLEMENTATION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Village Council, upon the recommendation of the Village Manager, desires to restore the sand dunes at a portion of the public beach situated in the Village (the "Project") pursuant to the plans prepared by the Project engineer, Coastal Systems International, Inc.; and WHEREAS, the Village Council finds that the purchase of the sand, the transport of the sand to the public beach site, and the placement of the sand on the public beach for the Project, are in whole or in part, exempt from competitive bidding pursuant to Village Code Section 2-86, as being based upon a bid awarded by Miami -Dade County, and that, in any event, the Council hereby further finds that pursuant to Village Code Section 2-85 competitive bidding is impractical for the Project and does hereby waive competitive bidding for the purchase, transport, delivery and placement of the necessary sand and for related activities for the Project; and WHEREAS, the Village Council finds that the Project is necessary for the enhancement of the use and enjoyment of the public beach and is in the best interests of the Village. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS: Section 1. Recitals Adopted. That each of the recitals stated above is hereby adopted and confirmed. Section 2. Capital Project Authorizing Resolution. A. That pursuant to Village Charter Section 3.07(b), this Resolution shall constitute a Capital Project Authorizing Resolution. The Capital Project is the implementation of the above described Project at a total cost not to exceed Three Hundred Thousand ($300,000) Dollars. B. That the components of the Project consist of the following: (1) The purchase of approximately 3,500 cubic yards of sand; (2) The transport and delivery of all of the purchased sand to the public beach staging area of the Project site; and (3) The preparation, placement and contouring of sand placed at the dune restoration area of the Project site. Section 3. Project Authorized; Transaction Approved. A. That the Project is hereby authorized. The Project is further described in the Project Engineer's plans, a copy of which are on file with the Village Clerk. B. That the Village Council hereby authorizes the Village Manager to provide for the completion of the Project for a cost which is consistent with this Resolution, to be funded from the funding source which is identified in the Village Manager's memorandum which accompanies this Resolution. 2 C. That the Village Manager is hereby authorized to execute the necessary purchase orders and related documents and agreements for the Project, once approved by the Village Attorney as to form and legal sufficiency. D. That the Village Manager is authorized to expend Village funds or third party funds obtained for such purpose for the accomplishment of the Project in accordance with Village budget appropriations and this Resolution. E. That the Village Manager is authorized to take any action which is necessary to implement the Project, including, but not limited to, arranging for the provision of engineer inspections of the Project work by the Project Engineer. The project cost is not to exceed $300,000 as per the attached resolution. Funding will be obtained from the capital outlay beach renourishment line item. BACKGROUND Due to past hurricanes, the dune areas in front of the Silver Sands Motel and the Ocean Club have been compromised. The dunes need to be restored and enhanced. Coastal Systems International, inc. (Coastal Systems) is pleased to submit this addendum proposal relative to the above referenced project. This scope of services is for the construction administration and surveying required for the dune restoration project. Specifically. the following, presents a detailed scope of work for additional sere ices to be provided by Coastal Systems for the Village of Key Biscayne (Village): PART 27 — DUNE CONSTRICTION ADMINISTRATION a. Dune Construction Administration: Coastal Systems will provide construction administration services for the dune restoration project. The restoration project will be procured through approved Miami -Dade vendors, and no bid process will he conducted. These services \vill include the following during the estimated construction schedule of 1.5 months. as applicable: • Attend one ( 1 ) Pre -Hid Meeting with approved Vendors • Prepare construction budget based on Vendor unit rates and estimated quantities • Attend one ( 1 ) Preconstruction Meeting • Attend t\ () (2) construction progress meetings • Sand samplinu and testing with five (5) gradation tests • Coordinate survey efforts under Part 28 services • Weekly email updates to Client on Construction Progress • Responses to Requests for information (RFIs) • Prepare and process DEP Progress Reports • Reviev. and approval of payment applications. Dune Construction Site Visits: Coastal Systems skill make fifteen (15) site visits to observe the construction progress over the estimated 1.5 month construction schedule. These site visits will occur approximately 3 times per week. or as directed by the Client. Coastal System, will observe construction progress to ensure the work is conducted in accordance with the construction documents and permits. Photographs will be obtained to document the ongoing construction. Held reports will he prepared with representative photographs incorporated for distribution to the Client. PART 28 — DUNE CONSTRICTION SURVEN {1G a. Pre -Construction Dune Restoration Survey: Coastal Systems wilt conduct beach profile surveys of the proposed dune restoration project areas within 30 days prior to construction. Profiles will he surveyed from the landward edge of the dune out to wading depth. and survey data will he obtained with total station or RTK (BPS equipment. 'Temporary survey control will he established and provided to the contractor for use in construction staking, and the limits of the project delineated in the field. The survey data will be processed in the office and compared to the dune design data. Estimated volumes to fill the dune design template will he updated and compared to the contract quantities. The quantities will be reviewed with the Client, and updated cross sections provided to the contractor as applicable. Deliverables: Permit Sketches with updated profiles and dune fill volumes b. Post -Construction Dune Restoration Survey: Coastal Systems will conduct beach profile surveys of the proposed dune restoration project areas within 15 days after completion of construction. Profiles will he surveyed from the landward edge of the dune out to wading depth, and survey data will be obtained with total station or RTK GPS equipment. The survey data will he processed in the office and compared to the pre -construction survey and dune design data. DEP Permit Close -Out: Subsequent to completion of construction. Coastal Systems will schedule and attend one (1) on -site Final Inspection meeting with the City, DEP Field Representative and Project Contractor, as required by the Special Permit Conditions outlined in the DEP Permit modification. Coastal Systems will distribute copies of the DEP Final Inspection Report to the project team and follow up with the DEP to confirm that close-out of this phase of the permit is documented in their system. If any project elements are not built in compliance with the DEP permit and additional coordination and/or meetings are required. these services will he provided under a separate scope. (1. DEP Dune Restoration Suney Report: Coastal Systems will prepare and submit the as -built survey data in standard DEP survey format, including the range files. ASCII XYZ data_ plots of data on the aerials with range monuments identified, etc. A surveyor report will he prepared to document all of the field work conducted. This fee proposal is valid for sixty (60) days. Services will be provided as an addendum to the Beach Nourishment contract dated August I. 2006. Coastal Systems is not responsible for circumstances beyond our immediate control. including but not limited to. rule or legal interpretation changes. Client or agency staff delays, and litigation or other legal actions. The Client shall make payment to Coastal Systems upon receipt of an invoice. Invoices not paid within thirty (30) days and not in dispute shall incur interest at a rate of 1.5 percent per month, The Client agrees to pay any cost of collection including reasonable attorneys fees incurred whether or not a suit is commenced or an appeal is taken. We look forward to working with the Village to finalize plans and authorization for this mitigation project.
