HomeMy Public PortalAbout73-270 ORDINANCE NO. 73-270 AN ORDINANCE OF THE CITY OF CARSON AMENDING THE CARSON MUNICIPAL CODI (ZONING ORDINANCE) BY AMENDING SECTIONS PERTAINING TO HIGHWAY DEDICA- TION AND IMPROVEMENT REQUIREMENTS THE CITY COUNCIL OF THE CITY OF CARSON DOES ORDAIN AS FOLLOWS: Section 1 . The Zoning Ordinance and the Carson Municipal Code are hereby amended y adding Section 9138 to the Carson Municipal Code to read: Section 9139. Notwithstanding the provisions of Section 910 , t� a Zoning Ordinance is hereby amended by adding Sections thereof as follows: Section 492. DEDICATION STANDARDS. Except as otherwise provided in Sections 491 and 497, a building or structure shall not be used on any lot or parcel of land, any portion of which abuts upon a parkway, major or secondary highway, or street unless the one-half (1/2) of the highwayoor street which is ocT ate-Ton the same side of the center line as such of or parcel of land has been dedicated and improved as provided in this Article. .Section 493. DEDICATION STANDARDS. Parkways, major highways, and secondary highways and streets shall be dedicated to the width from the center line specified ➢in subsections (a), (b), (c) and (d) of Section 467 and including comer cutoffs specified in subsection (b) of Section 468, except that dedication in any case shall not be required to such an extent as to reduce the area or width of any lot or parcel of land to less than that specified in Sections 722.3 or 737. Section 494. IMPROVEMENTS. Before a structure subject to the provisions of this Article may be used, curbs, gutters, sidewalks, and drainage structures where required shall be constructed at the grade and at the location specified by the Director of Public Works unless there already exists within the present right of way, or on property the owner has agreed to dedicate, curbs, gutters, sidewalks or drainage structures which are adequate and the Director of Public Works so finds. Sidewalks shall be not less than four (4) feet in width unless the available portion of the highway or street=is less, in which case they shall be the width specified-Fy--tFe Director of Public Works. Curbs, gutters, drainage structures and sidewalks shall comply with the standards of the Director of Public Works. j All construction with the existing or proposed road rights of way shall be done under provisions of Ordinance 3597 entitled "Highway Permit Ordinance of the County of Los Angeles, " adopted May 28, 1940. Section 498. MODIFICATIONS. a (a) The Director of Planning may grant a modification to the provisions of this Article and relieve the applicant either from j compliance with all or a portion of the provisions thereof if he finds: (1) Property adjoining on both sides of the subject property is developed with lawfully existing buildings or structures which, were they not already existing would be subject to the provisions of this Article, and Ord. No. 73-270/Page 2 of 2 the requirement to dedicate, pave or improve would require a greater width than is the highway or street in front of the said existing buildings or structures on the said adjoining properties, or (2) The lot or parcel of land adjoins a parkway, major or secondary highway or street for a distance of one hundred (100) feet or more and on(y a portion of said lot or parcel of land is to be used forsuch building or structure or occupied by such use.
