HomeMy Public PortalAbout73-271 ORDINANCE NO. 73-271 AN ORDINANCE OF THE CITY OF CARSON AMENDING THE BUSINESS LICENSE ORDINANCE REGARDING PERMIT REQUIREMENTS FOR ALARM SYSTEMS. THE CITY COUNCIL OF THE CITY OF CARSON DOES ORDAIN AS FOLLOWS: " Section I . The Business License Ordinance and the Carson Municipal Code are hereby amended by adding Sections 63102-1/4 and 63102-1/2 to the Carson Municipal Code to read: 63102-1/4. Alarm Agent. Permit Fee $5.00 "Alarm Agent" means any person employed by or engaged in an alarm system. 63102-1/4.1 . Same, Application. In addition to those items otherwise required by this Chapter, said application for an a arm agent permit shall contain the following: (a) The name and address of the applicant; (b) A statement of all businesses and occupations engaged in for the last five years, and the names and addresses of not less than three persons able to verify the statement; (c) A statement of what offenses, if any, the applicant has been convicted of, and the time, place and circumstances thereof; (d) A complete set of fingerprints of the applicant taken by the Chief of Police; (e) The name and permit number of the alarm system by whom he will be employed, or of which he is to be an owner or officer. If no such permit has been granted, the applicant shall state when an application for such permit was filed. (f) Such other information as either the Chief of Police or City Council may require; (g) With every application for an alarm agent's permit, the applicant shall also file a letter from an alarm system permittee, certifying that such permittee desires to employ such alarm agent or that such alarm agent is, or will be an owner or officer of such alarm system. i Upon receipt of the application for a permit, the Finance Director shall refer said application to the Chief of Police, who shall investigate the character and qualifications of said person. He shall transmit said application to the Finance Director and recommend that he: (a) Grant the permit applied for; or (b) Grant the permit subject to certain conditions; or (c) Deny the permit. 63102''-1/2. Alarm System: Permit Fee $50.00 � "Alarm System" means any private service, private system or person who for any consideration whatsoever manages, conducts or engages in the business of maintaining, repairing, altering, replacing or installing in or on any' building or premises, adjacent to or abutting a public street, any device known as a burglar alarm or fire security system. Ord. No. 73-271/Page 2 of 3 "Alarm Agent" means any person employed by or engaged in an Alarm System. 631M-1/2.1 Some, Application. In addition to those items otherwise required by this CC aptersaisaid application foran alarm system permit shall contain the following: (a) The name and address of the applicant; (b) If the applicant is a partnership, the name and address of all partners; (c) If the applicant is a corporation, the names and addresses of the corporate officers and manager, and a certified copy of the resolution authorizing such application; (d) The districtoor territory proposed to be served by the alarm system; (e) A description of the methods of operation. (f) The names and addresses of all alarm agents connected with the applicant; (g) A statement as to what offenses, if any, any person mentioned in paragraphs (a), (b), or (c) hereof, has been convicted of, and the time, place and circumstances thereof; (h) Such other information as either the Finance Director or the Chief of Police may require. 63102-1/2.2. Same, Evidence to be Submitted. With every application for a permit to con uuct�arm system the applicant shall pro uce the following evidence: (a) If a corporation, that it is authorized to do business in the State of California, and has appointed a local agent upon whom process may be served. (b) If the alarm system applicant is authorized to use tear gas, a copy of the State License authorizing such use must be pre- sented. 63102-1/2.3. Same, Investigation by Chief of Police. Upon receipt of an application for a permit to conductan alarm system, the Chief of Police shall investigate the character, fitness and qualifications of every person whose name appears on such applica- tion. He shall transmit such application to the Finance Director and recommend that he: (a) Grant the permit as applied for; or (b) Grant the permit subject to certain conditions or for less territory than applied for, or both; or (c) Deny the permit. He shall also inform the Finance Directoras to what persons in his opinion should be permitted to act as alarm agents. 63102-1/2.4. Same, Terms of Permit'. Every permit to conduct an alarm system shall contain, among other t ings, an accurate description of the area in which operations are permitted and the names of all alarm agents permitted to use such permit. A permit to conduct an alarm system shall not authorize any person to operate within any territory outside of the area so specified in the permit. i Ord. No. 73-271/Page 3 of 3 63102-1/2.5. Same, Application to Modify. The holder of a permit to conduct an alarm system may file an application at any time with the Finance Director either to change or increase the territory of operation or to change the authorized alarm agents or both. 63102-1/2.6. Same, Personnel. The operator of an alarm system shall neither employ nor ut�e in any way the services of an alarm agent whose name is not on the permit of such operator, or who does not possess a valid, subsisting permit. The holder of a permit to conduct an alarm system shall inform the Finance Director within five (5) days after any alarm agent no longeris connected with such permittee, and shall return the permit of such alarm agent to the Chief of Police. The Finance Director shall remove such alarm agent's name from the permit of such alarm system. 63102-1/2.7. Same," Permit Not To Be Sold. The holder of an alarm system permit sha not se or offer to sell, transfer or relinquish the privilege to operate an alarm system in territory granted to him or for any consideration whatever agreed to advocate, or not to oppose a granting of any other alarm system permit. Section 2. The regulation and control of alarm systems within the City of Carson are necessary for the immediate preservation of the public peace, health and safety. Due to the influx into the City of Carson of commercial and industrial businesses requiring the services of alarm systems, there has been and will continuecao be for some time a substantial growth in alarm systems within the City of Carson. Because of the sensitive nature of alarm systems and the sensitive position of alarm agents in relation to their access to a client's property, it is essential to regulate alarm systems and their agents in an effort to prevent dishonest practices. This ordinance is therefore an urgency ordinance and shall take effect immediately.
