HomeMy Public PortalAbout74-294 ORDINANCE NO. 74=294 AN ORDINANCE OF THE CITY OF CARSON ESTABLISHING A COMMITTEE ON HUMAN RESOURCES; DEFINING DUTIES AND FUNCTIONS THEREOF AND AMENDING THE CARSON MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF CARSON DOES ORDAIN AS FOLLOWS: That Article ll, Chapter 7 of the Carson Municipal Code is hereby amended by adding thereto Part G to read as follows- . "PART G . HUMAN RESOURCES COMMITTEE Sectiin 2760. Declaration of Policy. The City Council recognizes and finds: That in an increasingly complex society it is necessary for local government to be concerned with the problems and needs of individuals and groups within that society if the Constitutional principles of democracy, freedom and equality of opportunity are to be achieved, preserved and protected; That the rights of individuals, regardfess of religious affiliation, national origin, political belief, economic status, cultural background, race, color, age or sex are identical under law, and should be equal in practice in our society and community; That the people of a community are that community's greatest resource; That it is therefore in the best interest of the community not only to protect and insure the legal rights of individuals and groups, but also to seek to provide opportunity for the full realization of the hopes, aspirations, abilities and ambitions of individuals of all religions, races, national origins, political beliefs, economic or social status, cultural background, ages or sex, thereby encouraging and devel oping the human resources of the community to their highest potential value, thereby improving the quality of our society and the richness of life. Section 2761 . Human Resources Committee Established. In order to work toward the fulfillment of the goals and objectives embodied in the foregoing statement of policy, a committee of citizens of the City of Carson is hereby established to be designated and known as the Human Resources Committee. a Section 2762. Members. The Human Resources Committee shall consist of members to be appointed by the City Council who represent all ethnic groups and interests within the City of Carson . Each member so appointed shall, subject to the pleasure of the City Council, serve for a term of three (3) years, except that the terms of the initial appointees hereunder shall be staggered in such a manner so that five (5) members' terms shall expire on the thirty-first (31st) day of March, 1975, five (5) members' terms shall expire on the thirty-first (31st) day of March, 1976, and five (5) members' terms shall expire on the thirty-first (31st) day of March, 1977. If vacancies should occur other than by expiration of term, they shall be filled by appokrttment for the unexpired portion of the term of the member whom they shat I succeed. Members of the Committee shall continue to serve, irrespective of expiration of their regular terms, until their successors have been duly appointed. Urd. No. 74�294/Page 2 of 4 The Committee may invite such sociologists, urban affairs,consultants or other persons versed in one or more areas within the Committee's concerns to meet with the Committee from time to time and to par- ticipate in the Committee's deliberations, without a vote. Section 2763. Organization. The Human Resources Committee shaljelect a Chairman, a Vice Chairman and a Secretary from among its members, for terms of one year, at its first regular meeting in April of each year. The Committee may d1so appoint such other officers as may be necessary or convenient for the administration of its business, at the some time and for like terms. Said officers shall enter in the duties of their office at the first regular meeting in May of each year. The Committee shalladopt rules and regu- lations for the transaction of its business and shall keep a record of all its minutes, resolutions, actions, findings and determinations, all of which shall be filed with the City Clerk. Minutes, resolutions and recommendations shall be filed with the City Clerk and the City Administrator. Section 2764. Meetings. The Human Resources Committee shall hold at least one regular meeting in each month at such time and date as designated in the rules and regulations of the Committee. The Committee shall further determine and provide in its rules and regulations the manner in which special meetings may be held and the notice to be given of such meetings. A majority of the members shall constitute a quorum. The Committee may hold its meetings in the Council Chambers or in such other suitable place as the Committee may designate. All meetings of the Committee shall be open to tle public. Section 2765. Absence from Meetings. If a member of the Human Resources Committee is absent from three successive regula r meetings without being excused by the Committee, or is absent for any reason for more than six regular meetings in any twelve-month period, the office of such member shot l be vacated and the Chairman shall immediately notify the City Administrator, who shall notify the City Council that said office is vacant. Upon such notification, the City Council shall appoint a successor for the remainder of the term of such member. Section 2766. Removal of Members. Notwithstanding any other provision of this Part, any member of the Human Resources Committee may be removed from office at any time, with or without cause, by the affirmative vote of at least three members of the City Council . Section 2767. Duties and Functions of Committee . The Carson Human Resources Committee shall have the following duties and responsibilities: (a) To advise and consult with the City Council, City Administrator, and the commissions, boards and officers of the City on all matters involving discrimination on the basis of race, religion, national origin, culture, economic status, age or sex; (b) To recommend such corrective or legislative action as may be appropriate to effectuate the policy of the City Council which is declared in this Flirt; (c) To invite and enlist the cooperation of racial, religious and ethnic groups, youth and senior citizen organizations, community organizations, fraternal and benevolent societies, veterans' organi- zations, professional and technical organizations and other groups in the City of Carson in carrying on its work; (d) To foster communication, mutal respect and understanding among all racial, religious and other groups in the community; Ord. No. 74-294/Page 3 of 4 (e) To make such stutries in any area of human relationship in the community cis in the judgment of the Committee will aid in effectuating its general purposes; (f) To cooperate with City, County, State and Federal agencies whenever it deems such action appropriate in effectuating the policy of this Part; (g) To initiate, conduct or recommend such educational programs as, in the judgment of the Committee, will increase good will among inhabitants of the community and open new opportunities into all phases of community Iife and society for all inhabitants of the City;. (h) To hold conferences, and other public meetings, in the interest of the constructive resolution of racial, religious or other group tensions, prejudice or discrimination; (i) To receive, hear and investigate complaints of tensions, practices, of discrimination and acts of prejudice against any person or group because of race, color, religion, ethnic origin, culture, economic status, age or sex, whether practiced by private persons, associations, corporations or public bodies, and shall seek to resolve such matters through consultation and advice; (j) To seek the best means of progressively improving human relations in the entire City; (k) To issue such publications and such special reports concerning its work and investigations it may consider desirable and in the public interest, subject to the approval of the City Council; (1) To referall findings of discrimination within the jurisdiction of any County, State or Federal boards, commissions or departments to such agencies; (m) To make recommendations and reports to the City Council on all matters within the duties and functions of the Committee; (n) To submit an annual report to the City Council and such other reports as may be requested by the City Council . Section 2768. Committee Status. The Committee shall not be a department, commission or agency of the City but shall be a committee of private ditizens organized and conducting its business with the maximum flexibility and freedom to pursue its objectives, duties and functions. Appointment by and reports to the City Council are designed to achieve the maximum communication with the City Council in order that the City Council may most effectively consider recommendations and develop and implement appropriate courses of action. The Committee is not authorized or empowered to take any action for or in the name of the City, to represent or purport to represent the City nor to incur any debt, obligation or liability against the City. Section 2769. Relations with City Departments and Officers. So for as practical and subject to the approval of the City Administrator, the services of all City departments and officers shall be made available to the Committee for the carrying out of the functions, powers and duties of the Committee. Compensation and Expenses. All members of the Committee shall serve without compensation. The City Council may from time to tfime authorize in advance expenditures for attendance at seminars, institutes or other meetings which the City Council finds beneficial to the Committee in the per- formance of its duties and in the best interests of the C"iity. Claims for such expenditures shall be filed with the Finance Director and shall be subje-e to audit and approval by the City Council . The City Council may from time to time provide funds for secretarial or other services to the Committee and for such supplies and materials as may, in the discretion of the City Council, be needed for the proper performance of the Committee's duties."
