HomeMy Public PortalAbout01/16/96 CCM13 MEDINA CITY COUNCIL MEETING MINUTES OF JANUARY 16, 1996 The City Council of Medina, Minnesota met in regular session on January 16, 1996, at 7:30 p.m. in the City Hall Council Chambers. Mayor Anne Theis presided. Members present: John Ferris, Jim Johnson, Ann Thies, Phil Zietlow, and Mayor Theis. Members absent: None. Also present: Public Works Director Jim Dillman, City Engineer Shawn Gustafson, Zoning Administrator Loren Kohnen, City Attorney Ron Batty, and Clerk -Treasurer Jeff Karlson. 1. Adoption of the Agenda MOVED BY ZIETLOW, SECONDED BY THIES, TO ADOPT THE PUBLISHED AGENDA WITH THE FOLLOWING ADDITIONS: • HAMEL ATHLETIC CLUB — REQUEST FOR TEMPORARY SIGN • DISCUSSION OF CITY HALL IMPROVEMENTS FOR LOWER LEVEL • BILL WAYTAS — REPORT ON ELM CREEK WATERSHED ACTIVITIES • DISCUSSION REGARDING MCWD COOPERATIVE AGREEMENT MOTION PASSED UNANIMOUSLY. 2. Consent Agenda MOVED BY THIES, SECONDED BY MAYOR THEIS, TO APPROVE THE CONSENT AGENDA, AS FOLLOWS: • RESOLUTION NO. 96-2, "RESOLUTION GRANTING CONDITIONAL USE PERMIT REGARDING ACCESSORY STRUCTURES TO WES SCHROEDER AND DIANE SCHROEDER" • APPROVAL OF GAMBLING LICENSE FOR TURN IN POACHERS, INC. FOR A RAFFLE TO BE HELD MARCH 3, 1996 MOTION PASSED UNANIMOUSLY. 3. Bill Wavtas — Report on Elm Creek Watershed Activities Outgoing Elm Creek Watershed Commissioner Bill Waytas talked about how the Watershed District could assist the city in reviewing Hennepin County's water runoff plan in connection with their proposed public works facility. Waytas recommended that the Watershed District review the plans to minimize the liability to the city. Shawn Gustafson said he had already informed the county that it would have to obtain approval for their construction plans from the Watershed District. Mayor Theis thanked Waytas for his years of service on the Elm Creek Watershed Commission. 14 4. Approval of Minutes MOVED BY THIES, SECONDED BY MAYOR THEIS, TO APPROVE THE MINUTES OF THE SPECIAL MEETING OF DECEMBER 15, 1995, AS SUBMITTED. MOTION PASSED UNANIMOUSLY. MOVED BY ZIETLOW, SECONDED BY THIES, TO APPROVE THE MINUTES OF THE REGULAR MEETING OF JANUARY 2, 1996, AS AMENDED, AS FOLLOWS: • PAGE 3, ITEM 8, ADD, "25. HIGHWAY 12 POLICY COMMITTEE ANN THIES" • PAGE 5, ITEM 15, TO READ, "WALNUT PARK' • PAGE 6, ITEM 16, PARAGRAPH 2, TO READ, "...ANYONE HUNTING WITHIN..." MOTION PASSED UNANIMOUSLY. 5. Update on Hennepin County PUD Agreement Ron Batty informed the council that he would have a complete draft of Hennepin County's PUD agreement within the next two weeks. Ann Thies implied that the PUD agreement could not be approved until the council decided what should be done with Hamel Road. Batty replied that the agreement would merely be a draft until the council was ready to approve the final draft. Mayor Theis pointed out that there was a petition in the council packet which supported the paving of Hamel Road from Pinto Drive west to the driveway of Harold Laurent, 2235 Hamel Road, and also supported the paving of Pioneer Trail to Highway 55. Shawn Gustafson said the county indicated that it would be happy to use any kind of gravel the City wanted. The county also said it would try to widen the shoulders by using offset shoulders wherever it was feasible to do so. Gustafson said it was difficult to talk about the design specifications because the survey had not yet been completed. Jim Dillman said the council should meet with the county. He noted that the county knew exactly what the residents wanted. Ann Thies said other issues had also been raised such as the timeline for paving the roads, whether the county would pave Hamel Road without taking it over, or whether the county would maintain Hamel Road if it remained a city road. Dillman said the county agreed to pave Pioneer Trail in 1996 and was prepared to accept Hamel Road, Pinto Drive and Arrowhead Drive. The paving schedule proposed by the county was as follows: • Arrowhead Drive from south of Prairie Drive to Hamel Road — 1996 • Hamel Road from Arrowhead Drive to Willow Drive — 1997 • Hamel Road from Willow Drive to Parkview Drive — 1998 15 Construction of the roads to state -established standards would likely not occur for 10 to 15 years. Mayor Theis asked Thies what the advantage was of leaving Hamel Road a city road. Thies remarked that this would keep Hamel Road from becoming a through street from Delano to Plymouth sometime in the future. Dillman pointed out that county could not make it an Minnesota State Aid (MSA) highway without city approval. Loren Kohnen said, for example, the county could not redo County Road 6 without first getting approval from the City of Independence. Dillman suggested that he stake the road out and then drive it out with each council member. The council agreed to the suggestion. 6. David Raskob — Request to Vacate a Portion of Beechnut Street In a memo to the council, David Raskob, 2864 Ardmore Avenue, detailed that he was building a home at 3050 Lakeshore Avenue. He revealed that after preliminary excavation he found out that the house would be lower than Lakeshore Avenue which meant that the sewer line would run up hill. Raskob made a request that the council vacate 290 feet of Beechnut Street between Lakeshore Avenue and Cedar Avenue. He said this would allow him to raise the elevation of the house and eliminate the need to remove all the trees from the lot and excavate the hill. Raskob was present at the meeting and told the council that he would move everything north toward Beechnut but would not crowd the homeowners to the south. Ron Batty said the council would have to hold a public hearing. He said the essential issue was whether there was a public reason to retain the 40 foot easement. Batty asked how people would gain access to the lots north of Beechnut. Loren Kohnen said none of the property owners north of Beechnut needed access from Beechnut because their homes fronted on Walnut Street. Batty pointed out that it was difficult to determine what lots were combined according to the map that was provided in the packet. John Ferris suggested that the council call for the public hearing, subject to the access issue being resolved. 16 Batty agreed that calling the hearing was appropriate. He said, in the meantime, staff could research the road access issue. MOVED BY MAYOR THEIS, SECONDED BY ZIETLOW, TO CALL FOR A PUBLIC HEARING ON TUESDAY, FEBRUARY 20, 1996, TO CONSIDER THE VACATION OF BEECHNUT STREET. MOTION PASSED UNANIMOUSLY. 7. Discussion of Stop Signs Along Hamel Road Jim Dillman informed that he had talked to the sign people at Hennepin County about stop signs. Dillman said that what the county does when taking over a road is to sign it properly. He said it was possible that the county would eliminate existing stop signs along Hamel Road unless the City had a valid reason for keeping certain stop signs in place. Dillman said he and Rick Rabenort had discussed where the stop signs should be placed and were recommending a three-way stop at Parkview Drive and a three-way stop at Arrowhead Drive. MOVED BY ZIETLOW, SECONDED BY THIES, TO APPROVE THE PLACEMENT OF STOP SIGNS ALONG HAMEL ROAD AT THE INTERSECTIONS OF PARKVIEW DRIVE AND ARROWHEAD DRIVE. MOTION PASSED UNANIMOUSLY. Shawn Gustafson mentioned that MnDOT did not want a temporary signal light at Arrowhead Drive and Highway 55 during Hennepin County's construction project and westbound vehicles would not be allowed to turn left unto Arrowhead. He said the county had suggested that all the construction equipment and the employees would have to take a different route. Phil Zietlow remarked that vehicles would find the shortest route possible --Pinto to Hamel Road. Gustafson said he would stress to MnDOT the importance of putting up the permanent signal light as soon as possible, but that it was unlikely that it would go up before construction began. 8. Hamel Athletic Club — Request for Temporary Sign Loren Kohnen said he had been approached by Patty Gregor who requested a temporary banner advertising the Hamel Athletic Club's first annual winter golf tournament on February 24, 1996. Kohnen said the banner would be placed over Hamel Road in downtown Hamel 14-16 feet above the street. The Athletic Club also asked the City to waive the $20 sign permit fee since this was a fund raiser for the Hamel Memorial Park. MOVED BY FERRIS, SECONDED BY THIES, TO GRANT A TEMPORARY SIGN PERMIT TO THE HAMEL ATHLETIC CLUB ADVERTISING THEIR WINTER GOLF TOURNAMENT, AND TO WAIVE THE $20 PERMIT FEE. MOTION PASSED UNANIMOUSLY. 17 9. Discussion of City Hall Improvements for Lower Level John Ferris said he would like the council to establish priorities in regard to improvements that needed to be done in the lower level of city hall. Ferris said he would provide a list of recommended improvements that should be undertaken in 1996. 10. Discussion Regarding MCWD Cooperative Agreement Phil Zietlow provided a draft copy of the "Cooperative Agreement for the Long Lake Improvement Project." Zietlow said there were two parts that the council needed to pay particular attention to. One was that the City agree to prepare a local water management plan and the second part was that the City agree to contribute to a maintenance fund to cover the sediment removal costs of the wet detention ponds/wetlands in an amount not to exceed $7,000 per year. Zietlow said the City should put a cost limit on the preparation of a water management plan. He said the City should try to keep the cost below $20,000. Shawn Gustafson noted that it would be more efficient to do the entire city as opposed to one watershed district at a time. Ron Batty suggested that he review the cooperative agreement and write his comments before the council discussed the agreement any further with the MCWD. 11. Payment of Bills MOVED BY JOHNSON, SECONDED BY MAYOR THEIS, TO APPROVE PAYMENT OF ORDER CHECK NUMBERS 15448-15497 FOR $45,899.49 AND PAYROLL CHECK NUMBERS 14651-14664 FOR $12,824.12.
