AN ORDINANCE OF THE CITY OF CARSON DECLARING
A MORATORIUM ON THE ISSUANCE OF ANY PERMITS
FOR CEMETERIES AND SIMILAR USES AND PROHIBITING
INTERMENTS IN REDEVELOPMENT PROJECT AREA NO. 1
AND DECLARING THE URGENCY THEREOF
THE CITY COUNCIL OF THE CITY OF CARSON DOES ORDAIN AS FOLLOWS:
Section I . No building permit, plumbing permit, electrical permit, grading
permit or other permit for the construction or development of a cemetery, or any improvement
related to cemetery, mausoleum, columbarium, mortuary or related use within Carson Redevelop-
ment Project Area No. 1 shall be issued for a period of four (4) months from date hereof.
Section 2. No interment, burial, entombment or other disposition of human
remains, whether permanent or temporary, shall be made under, upon or within any of the real
property described in Cemetery Permit Case No. 34-(4) for a period of four months from date
hereof.
Section 3. Any violation of this ordinance shall be a misdemeanor punishable
by imprisonment in the county jail for not more than six months, or a fine not to exceed $500,
or both such fine and imprisonment.
Section 4. If any section, clause, provision, sentence or part of this ordinance
shall be held to be invalid or unenforceable for any reason, all of the remainder hereof shall be
valid and enforceable, and the City Council hereby declares that it would have adopted such
remainder without regard to any portion held to be invalid or unenforceable.
Section 5. The Planning Commission has been instructed to conduct a public
hearing on the question of possible revocation or other status of the cemetery permit heretofore
granted with respect to the real property referred to in Section 2 hereof. Any issuance of a
permit for any development of such land pending completion of such hearing and the study
incident threto, any any interment or other use for cemetery-related purposes may result in
conflict with and be inimical to the general plan, redevelopment plan and use of adjacent
properties. This ordinance therefore is necessary for the immediate preservation of the public
peace, health, safety and welfare, is an urgency ordinance and shall take effect immediately.
