HomeMy Public PortalAbout75-345U ORDINANCE NO. 75-345U AN ORDINANCE OF THE CITY OF CARSON EXTENDING THE MORATORIUM ON AND REGULATING AUTOMOBILE SERVICE STATIONS IN THE CITY OF CARSON AND DECLAR- ING THE URGENCY THEREOF THE CITY COUNCIL OF THE CITY OF CARSON DOES HEREBY ORDAIN AS FOLLOWS: Section I . The City of Carson heretofore adopted Ordinance No. 75-327U , declaring a moratorium on the issuance of building, electrical, grading or other permits for any new automobile service station use in any redevelopment project area or in any zone in the City of Carson. Section 2. Pursuant to Section 65858 of the Government Code, Ordinance 75-327U is hereby extended for a period of eight (8) months from the date of the expiration of said Ordinance and notwithstanding any other provision of the Carson Municipal Code or the ordinances of the City of Carson, no new automobile service station use shall be established or permitted in any redevelopment project area or in any zone in the City of Carson and no building, electrical, grading or other permit shall issue for any such use for said eight (8) months period. This ordinance shall not apply to the improvement or expansion of an existing service station use, or to the construction of any service stations for which permits may have issued prior to the date hereof. Section 3. The Planning Commission of the City of Carson and the City Council are now undertaking studies with reference to the locations, control and regulation of service stations within redevelopment project areas within the City, and throughout the various zones in the City of Carson generally. Pending the completion of such studies and in order to prevent during such period the development of properties in a manner incompatible with zoning classifications and such regulations as may be proposed for redevelopment areas and the various zones in the City, it is necessary and desirable that no further businesses be established. This ordinance is therefore declared to be interim zoning ordinance and urgency ordinance necessary for the protection of the health, safety and welfare of the City of Carson and shall take effect immediately upon adoption. Section 4. The City Clerk is instructed to file,along with the Negative Declaration prepared by Staff, a Notice of Determination stating: a. That the City Council has passed Ordinance No. 75-345U; b. That the adoption of the Ordinance will not have a significant adverse environmental effect; and C. That an Environmental Impact Report was not prepared on this action.
