ORDINANCE NO. 14-2009-A
AN ORDINANCE TO AMEND THE 1 ODE OF ORDINANCES
SECTION 42 -60(5) PERTAINING TO LITTE G AND PENALTIES THEREFOR
FOR THE CITY OF TYBEE IS AND, GEORGIA
WHEREAS, the duly elected governing autho ty for the City of Tybee Island, Georgia,
is authorized under Article 9, Section 2, Paragraph 3 f the Constitution of the State of Georgia
to adopt reasonable ordinances to protect and improv the public health, safety, and welfare of
the citizens of Tybee Island, Georgia, and
WHEREAS, the duly elected governing autho ty for the City of Tybee Island, Georgia,
is the Mayor and Council thereof, and
WHEREAS, the governing authority desires to adopt ordinances under it police, zoning,
and home rule powers, and
WHEREAS, it is necessary to amend the Co e of Ordinances pertaining to disorderly
conduct as it relates to litter so that the following charily shall be made to Section 42- 60(5), and
WHEREAS, it is necessary to add a Code Section, 42.64, as to penalties; and.
NOW, THEREFORE, be it ordained by the governing authority of the City of Tybee
Island that the Code be amended so that hereafter Section 42.60(5) shall read as follows:
(5) Throwing or otherwise permitting, bottl s, cans, paper or rubbish, including
cigarette butts, to be deposited on parks, sidewalks, I -ets, beaches, lanes, highways or other
public properties, or on private property of another. In. luded would be the removal by wind or
otherwise of such items from pick -up trucks or other v- .'cles due to having such items
unsecured on such vehicles. Parking lot and park users must keep trash in a container at all
times. "Rubbish" as used herein shall include any matt that does not occur naturally in the area
and specifically includes garbage, food items, peels, shy lls, etc., whether or not biodegradable.
and to add a new section to be designated as Section 42 64:
Section 42 -64. Penalty for littering
Anyone convicted of violating Section 42 -60(5) shall be fined not less than $100.00 for
the first offense plus applicable court fees, and not less than $200.00 for subsequent offenses
plus applicable court fees for any subsequent offense occurring within a 12 month period of a
preceding offense.
It is the intention of the governing body, and it is hereby ordained, that the provisions of
this ordinance shall become and be made a part of the Code of Ordinances, City of Tybee Island,
Georgia, and the sections of this ordinance may be renumbered if necessary to accomplish such
intention.
This Ordinance shall become effective on 4
day of 2009.
