AN ORDINANCE OF THE CITY OF CARSON
DESIGNATING CERTAIN PROPERTY AS ORL
(ORGANIC REFUSE LANDFILL) AND AMENDING
THE REGULATIONS PERTAINING THERETO
THE CITY COUNCIL OF THE CITY OF CARSON DOES ORDAIN AS
' FOL LOWS
Section 1. The ORL (Organic Refuse Landfill)
zoning designation provided by Section 9113 . 2 of the Carson
Zoning Ordinance is hereby placed upon the real property
which is delineated on the map attached hereto as Exhibit "A" .
Said property is more particularly described in Exhibit "B"
attached hereto.
Section 2. Sections 9121 .12 (C) (2) and (3) ,
9131. 12 (C) (2) and (3) , 9141 . 12 (C) (2) and (3) , and 9151 .12
(C) (2) and (3) of the Carson Municipal Code are hereby
amended to read:
2. All measures finally approved by the
Council to eliminate or mitigate the hazards and
environmental risks associated with the site shall
be incorporated into the project. Such measures shall
include monitoring and controlling of methane gas
produced by the site as the Commission or the
Council on review shall determine to be necessary to
protect the public health, safety or welfare with
respect to the production or migration of methane
gas.
' 3 . Independent consultant monitoring
and regular inspections and reports shall be
done and filed with the Council from time to time
as directed by the Council at the applicant' s
cost.
Section 3 . This ordinance shall expire and terminate
ninety (90) days after the date of adoption hereof unless
extended by the City Council following a public hearing with
respect to such extension.
Section. 4 . The City of Carson has within its
boundaries a number of properties that were former organic
refuse landfill sites . The development of such sites , which
are characterized by certain hazards and environmental risks,
is potentially dangerous to the public health, safety, and
welfare. The City has amended its Zoning Ordinance to
include special regulations to control the development of
properties containing former organic refuse landfill sites so
that the dangers potentially created by said hazards and
environmental risks can be avoided. By the terms of the
Zoning Ordinance as amended, such regulations do not apply
to the numerous properties containing former organic refuse
landfill sites until these properties are given the ORL
' (Organic Refuse Landfill) designation. Rezoning proceedings
have been initiated to accomplish this result, but these
proceedings will not be completed for several more weeks .

The special regulations that will be imposed
on all properties designated as ORL on an interim basis
by this ordinance provide that any conditional use permit
granted for a development on ORL designated property must
contain a condition requiring any methane gas produced
by the site to be monitored and controlled so that it
does not migrate to surrounding properties. The City' s
consultant has found that in certain cases the installation
of a costly methane gas migration control system is not
' needed to protect the public health, safety and welfare.
Since imposing such a requirement in these cases would be
unreasonable and economically burdensome and wasteful,
proceedings will be conducted to amend the Zoning Ordinance
so that the kind of mitigation measures required to be
incorporated into a particular development will be deter-
mined on a case by case basis depending upon the particular
circumstances present. Such proceedings will take several
weeks to complete.
,, This ordinance affects the public peace, health
and safety and shall take effect immediately.
