CITY COUNCIL WORK MEETING
IONA CITY BUILDING
JULY 16, 2019 6:00 P.M.
PRESENT: Mayor Dan Gubler, Council President Rob Geray, Council Member Michael
Thompson, Council Member Kathy McNamara, Council Member Peter Wadsworth, City
Attorney Andrew Rawlings, Public Works Director Zech Prouse, Treasurer Amy Sullivan and
City Clerk Keri West.

ITEMS OF BUSINESS:
Discussion of Fiscal Year 2020 Preliminary Budget – Treasurer Sullivan distributed copies of
the preliminary budget to the Council. Mayor Gubler stated he talked to Bonneville County and
they informed him properties in our area increased by 14% this year. That information should
help Treasurer Sullivan when setting the numbers for the upcoming fiscal year. Mayor Gubler
also recommended the City Council consider a 1½ or 2% increase on property taxes this year.
Mayor Gubler also stated he has informed Treasurer Sullivan to leave the budget for the Police
Department as is, even though the City may be contracting with Bonneville County Sheriff’s
Office (BCSO), to allow future changes as necessary. Council President Geray stated if the City
contracts with BCSO that does not eliminate all other police expenses. He continued saying the
City would still be paying approximately $9,000 for Dispatch through the City of Idaho Falls,
and there is one final payment on the Durango that would remain on the budget. Mayor Gubler
stated another item that needs to be addressed on the budget pertains to the Idaho Falls Animal
Shelter. He stated this is something the City is hoping to include in the BCSO contract, but there
are logistical challenges that need to be addressed. No other items on the budget were discussed.
Discussion of Amendments to the Iona City Code Sections 11-1-5 and 11-11-12, Pertaining
to Home Occupations – Mayor Gubler stated Attorney Rawlings is working to amend the City
Code pertaining to Home Occupations, due to discussions and conflicts that have come up in
recent City Council Meetings. Council Member Wadsworth questioned what the benefit to the
City would be for requiring business owners to obtain a business license and Conditional Use
Permit to run a clerical business out of their home. Attorney Rawlings stated the way he is
proposing to change the business license requirements is to base it off annual revenue. For
example, the City would not require a business license for businesses that gross less than
$6,000/year. Council President Geray stated even if a business is purely clerical, it is good for
the City and other residents to know what types of businesses are being conducted within the
City limits. Council President Geray stated the City should be allowed input on what types of
businesses are allowed in the City. Mayor Gubler stated he does not like the idea of requiring
business licenses based on revenue. He continued and stated he thinks the requirements should
be based on traffic and how the business impacts the neighborhood. Director Prouse stated traffic
is not the only factor that should be considered to determine if a business is hazardous or has
negative effects on a neighborhood. Council President Geray reiterated the need to set up
parameters for the City to be involved in allowing only certain types of businesses in a
residential zone. Attorney Rawlings stated the $6,000/year is an arbitrary number and can be

discussed further. He also stated as of right now the Conditional Use Permit chapter is connected
to the Business License chapter of the Iona City Code. The City Council can decide to keep those
two chapters connected or make them independent from each other. Council Member
Wadsworth stated he does not think the City should be micromanaging residents by telling them
what they can and cannot do in their homes, as long as it does not negatively affect the
neighborhood. Council President Geray stated he does not believe it is micromanaging to require
a business license. Council President Geray also recommended Attorney Rawlings and Council
Member Wadsworth work together directly to come up with a good compromise to amend the
City Code to benefit the City and residents who desire to have a home based business. Council
Member Wadsworth and Attorney Rawlings agreed.
Discussion of Amendments to the Iona City Code Sections 4-1-1, Pertaining to Business
Licenses – This item was discussed in conjunction with the previous agenda item discussion.

CONSENT AGENDA: City Council Work Meeting and City Council Meeting Minutes of June
25, 2019 were reviewed. Town Hall Meeting Minutes of June 13, 2019 were reviewed. Special
City Council Meeting Minutes of July 11, 2019 were reviewed. Council reviewed the finance
reports for the period ending June 30, 2019 (75% of the fiscal year elapsed). The City had
$843,908.39 in the bank and routine bills had been paid, “Exhibit A”.
Mayor Gubler entertained a motion. Council President Geray made a motion to approve the
consent agenda as presented. Council Member Wadsworth seconded the motion. All in favor.
Motion carried.
ITEMS OF BUSINESS:
Appointment of Gary Elliott to Planning & Zoning Commission – Mayor Gubler introduced
Gary Elliott from the audience and asked if Mr. Elliott was able to attend this month’s Planning
& Zoning Meeting to introduce himself to the Planning & Zoning Commission. Mr. Elliott
confirmed.
Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to appoint
Gary Elliott to the Planning & Zoning Commission for the City of Iona. Motion was seconded by
Council President Geray. All in favor. Motion carried.
Appointment of Dave Noel as City Engineer – Mayor Gubler stated the City has removed Paul
Scoresby of Schiess & Associates as the City Engineer due to multiple deadline conflicts. Mayor
Gubler has proposed to appoint Dave Noel as the temporary City Engineer, until the City is
ready to open the position up to bid.

Mayor Gubler entertained a motion. Council Member Thompson made a motion to temporarily
appoint Dave Noel as the City Engineer for the City of Iona. Motion was seconded by Council
Member Wadsworth. All in favor. Motion carried.
Approval of Legal Services Proposal, Fiscal Year 2020 for Holden, Kidwell, Hahn &
Crapo, P.L.L.C. – Council President Geray asked Attorney Rawlings if any of the rates had
changed in this contract from the previous year. Attorney Rawlings stated his rate did increase
from $175/hour to $180/hour, but no other rates changed.
Mayor Gubler entertained a motion. Council President Geray made a motion to approve the
Legal Services Proposal for Fiscal Year 2020 with Holden, Kidwell, Hahn & Crapo. Motion
seconded by Council Member Thompson. All in favor. Motion carried.
Approval of Fiscal Year 2020 Preliminary Budget – Mayor Gubler stated the Preliminary
Budget was discussed in the Work Meeting. The tentative budget has been set at $5,952,514.
This is an increase in the General Budget from last fiscal year in the amount of $44,000. The
total budget includes all the monies being used for the water project.
Mayor Gubler entertained a motion. Council President Geray made a motion to approve the FY
2020 Preliminary Budget of $5,952,514. Motion was seconded by Council Member Thompson.
All in favor. Motion carried.
Iona Days – Clerk West announced Iona Days will be held Saturday, July 20th. She continued
and stated the City Council will need to be at Iona Elementary at 9:15am to participate in the
parade.
General Water System Discussion – Mayor Gubler stated the water tank project has been
progressing and the floor for the tank should be poured in the next 1-2 weeks. He also stated the
transmission line has already been installed under the railroad track and the two canals. Mayor
Gubler continued and said the timing has been pushed back due to a conflict with scheduling of
the rock saw required on the hill. He confirmed the transmission line will be completed by the
fall of 2019.
Public Hearing- Conditional Use Permit Application, Ken Baldwin, Car Sales on R-1 Lot –
Clerk West stated this was denied by the Planning & Zoning Commission due to the fact it did
not meet the requirements set forth in the Conditional Use Permit section of the R-1 Zone, in the
Iona City Code. Clerk West also stated she has received five comments of concern for this
application from various Iona residents. Mayor Gubler stated if the current version of City Code
does not allow this type of Conditional Use in the R-1 Zone, the Council cannot approve this
application at this time. Council Member Wadsworth informed the audience that the City
Council is currently working with the City Attorney to make some changes to the Conditional
Use Permit guidelines and requirements to make them more accessible, while still protecting the
City.
Ken Baldwin (5026 Rockwood Avenue) approached the podium and introduced himself as the
owner of Mr. Suds and the applicant for this agenda item. Mr. Baldwin stated he had a car
dealership at his home many years ago and he never had complaints from neighbors. He

continued and said he already has a business license for his auto detailing company, Mr. Suds.
He now wants to sell a few cars at a time there also. Mr. Baldwin stated he has a shop that he
will put the cars in, so it won’t affect the visual aspect of the neighborhood.
Mayor Gubler stated this application will be tabled until the revisions to the City Code are
complete.
Ordinance to Amend Sections 1-5-8 and 1-6-5 of the Iona City Code to Revise the Annual
Salaries for the Mayor and City Council – Mayor Gubler introduced this item and stated the
City is proposing to raise the Mayor’s annual salary from $6,000 to $12,000. He also stated the
City is proposing to raise the annual salary of each City Council Member to $3,600 from $2,400.
Mayor Gubler also stated the state requires these amendments to be done prior to an election and
do not take effect until January 1st, after the election.
Mayor Gubler asked for all those in the audience who oppose this change to approach the
podium. No response. However, Mayor Gubler read aloud a letter received from previous Mayor
Brad Andersen, who expressed his opposition to this action but could not attend the meeting.
After reading the letter, Mayor Gubler addressed several concerns presented in Mayor
Andersen’s letter. Mayor Gubler stated the salary increases that are being proposed tonight were
determined after reviewing comparable cities in a statewide salary survey completed by the
Association of Idaho Cities. Resident Cody Merrill asked if these increases are already included
in the Preliminary Budget that was just approved and when the increases go into effect. Mayor
Gubler confirmed the increases are already included in the Preliminary Budget and the increases
will not go into effect until January 1, 2020.
Mayor Gubler asked for all those in the audience who are in favor of this change to please
approach the podium. No response. Mayor Gubler did state he has received two handwritten
letters in support of this increase.
Mayor Gubler once again asked for all those in the audience who oppose this increase to
approach the podium and voice their concern. No response. Mayor Gubler then closed the Public
Hearing portion of this agenda item.
Mayor Gubler entertained a motion. Council President Geray made a motion to approve an
Ordinance of the City of Iona, Idaho amending Sections 1-5-8 and 1-6-5 of the Iona City Code,
revising annual salaries for the Mayor and City Council, preserving prior Ordinances in each
instance, providing for severability, and establishing an effective date. Council President Geray
also moved to dispense with the rule of reading the proposed ordinance in full and on three
separate occasions. Motion was seconded by Council Member McNamara. A roll call vote was
taken:

Bonneville County Sheriff’s Office Contract Proposal – Mayor Gubler stated the City is
deciding tonight whether they keep the Iona Police Department (IPD) or contract with
Bonneville County Sheriff’s Office (BCSO) for full-time policing in the City of Iona. Mayor

Gubler acknowledged a petition has gone around the City to support keeping the IPD. Council
President Geray counted the signatures and confirmed a total of 46. Mayor Gubler also stated
this is the fourth meeting the City has held to discuss this proposal. One of those meetings was a
Town Hall Meeting where 28 people were in attendance to oppose the contract. Mayor Gubler
continued and stated the main concern that was brought up was regarding the amount of police
presence the City of Iona needs. The majority of the people that have attended the meetings and
that he has spoken to personally have stated they want more police presence. Mayor Gubler
highlighted what the proposed contract with BCSO would include; 175 hours of patrol, an
additional full-time officer that would work a 40 hour work week in the City of Iona, Code
Enforcement and Animal Control. Mayor Gubler also stated the City will maintain ownership of
all police equipment. He continued and stated the contract includes an option to cancel the
contract at any time. Mayor Gubler also stated he understands the desire to have an officer in the
City that has a relationship with the residents. He continued and said BCSO requires their
officers to make contact with residents each shift and develop a relationship with the community.
In addition, he stated there are currently 9 officers with BCSO that live in the City of Iona.
Resident Cody Merrill (3330 N. Dayton Street) stated he has lived in Iona for 16 years. He
continued and stated the City bears a large amount of liability by having its own police force. If
an IPD officer causes an accident or handles a situation incorrectly, the City is 100% liable for
that. He also stated if a higher crime happens in Iona, BCSO would have to take it over as the
City doesn’t have sufficient resources to handle a situation like that. In addition, in a domestic
dispute, an officer is not supposed to enter alone. The IPD never has two officers on shift at the
same time, so this either creates a dangerous situation for the officer, or they would need to call
BCSO for backup. Mr. Merrill stated he is very opposed to keeping the IPD due to the unseen
liability involved. However, he did state BCSO is already obligated to answer our calls if we
don’t have the IPD. He continued and said the only reason for a contract is for the City of Iona to
help pay more of the service for all of Bonneville County.
Attorney Rawlings stated BCSO is obligated to provide a base service to the City of Iona,
because we reside in Bonneville County. However, the contract being proposed goes over and
above the base services required. This includes the 40 hour full-time officer, shift work, Code
Enforcement, Animal Control, lesser crimes, etc. Those services are not requirements for BCSO
to cover without a contract.
Dennis McArthur (3652 N. Dayton Street) stated he would like to find a way to have both the
IPD and have BCSO help cover. He values the presence and community feeling of having the
IPD. Mr. McArthur continued and stated the history with BCSO was not a great experience.
Mayor Gubler stated he understands the negative history with BCSO. That is why the City is not
getting rid of any police equipment and why the contract has a cancellation option at any time.
Mayor Gubler stated if BCSO does not fulfill their contractual agreement or the City is unhappy
with their service, the City can cancel the contract and reinstate the IPD.
Shayna Stanger (5357 E. Scoresby Avenue) voiced her concern that those opposing the contract
with BCSO are not being heard by the City Council and Mayor. Mayor Gubler stated he
appreciates those that have attended the meetings. However, from his personal experience, those
people do not represent the whole community. He continued and said he has spoken with many
people in the community and the majority is in favor of a contract with BCSO.

John Stanger (5357 E. Scoresby Avenue) stated this is too big of an issue to allow 5 people to
decide. He strongly believes this is an item that needs to be voted on by the City at a City
Election. Mayor Gubler stated the City Council and Mayor are voted on by the City to represent
the community as a whole. They are elected to make important decisions, including this and the
annual budget that involves millions of dollars. Mr. Stanger stated he will gather more signatures
and get a ballot initiative on this November’s City Election. Mayor Gubler stated there is not
enough time at this point to add an initiative to the ballot. Mr. Stanger stated he has called the
Bonneville Elections Office and they told him he only needs 30 days before the election to
submit an initiative. Mayor Gubler encouraged him to pursue it.
Chelsie Moore (3053 N. Sagebrush Avenue) asked what the cost difference is for the IPD to hire
another officer, rather than contracting with BCSO. Council Member Geray stated the Police
Budget in the Preliminary Budget is approximately $270,000 and includes 2.5 officers. That
includes the cost of the vehicles, equipment and payroll. Each full-time officer costs the City
approximately $100,000/year for the full benefit package, payroll and gear.
Fred Blood (5185 E. Hansen Avenue) stated they moved to Iona from California last year. One
of the reasons they chose Iona was because of the presence and friendliness of the IPD. Mr.
Blood also expressed concern for having a contract with BCSO and losing that control.
Lieutenant Kevin Casper (BCSO) spoke regarding the police necessities required for a small city.
Some days the City of Iona may only have a couple of calls that require one officer. However,
there are other days when the City of Iona has heavy call volume and requires many officers due
to the type of infractions. Lt. Casper responded to a question regarding BCSO being short-staffed
by saying they currently have officers in training. He also stated by policing the City of Iona full-
time, they will be able to more efficiently cover more ground because they are already covering
all the area surrounding Iona. Lt. Casper also stated the IPD has gone through 7 full-time
employees in the last 5 years. With each turnover, BCSO has to pick up the pieces and that has
been very difficult for them. Lt. Casper encouraged the residents to give the BCSO a chance with
an open mind. He also stated Officer Hinton has alread y begun the hiring process with BCSO
and can possibly be the full-time officer for Iona after he completes the 12 week mandatory
training.
Resident Jolyn Louk (5428 E. Rockwood Avenue) voiced concern that BCSO has previously
stated they will not be able to have the 40 hour full-time officer in Iona for up to 6 months
because of transition and staffing. She encouraged the City Council to consider that when voting.
Mayor Gubler stated he has heard all of the concerns talked about at this and previous meetings.
However, he believes that a contract with BCSO will provide more police coverage for the City
at a significant savings. He encouraged the residents to have an open mind and patience with the
transition.
Council President Geray stated he has provided feedback regarding the contract to Attorney
Rawlings pertaining to police presence and the expectation the City has in the amount of
presence provided by BCSO. Attorney Rawlings said they are attempting to address that in the
contract by adding an objective to measure that presence. He referenced a section in the contract
that has a target for presence. Attorney Rawlings stated the City can add to the contract specific

hours per shift. Lt. Casper stated the City and BCSO will need to work together on the wording
to align with the goals of both entities.
Mayor Gubler entertained a motion. Council President Geray made a motion to approve the
Bonneville County Sheriff’s Office contract proposal as it will be amended to address stated
issues, not to exceed the identified $212,000 for a one year contract. Motion was seconded by
Council Member Thompson. A roll call vote was taken:
Council Member Wadsworth: No Council President Geray: Yes
Council Member Thompson: Yes Council Member McNamara: No
Tie breaker vote, Mayor Gubler: Yes. Motion carried.
STAFF REPORTS:
Director Prouse stated the Walking Path on Denning Avenue is about 35% complete and should
be finished the second week of August.
Treasurer Sullivan stated nothing to report.
Officer Hinton stated nothing to report.
Clerk West stated the City will have two open City Council seats for this year’s City Election.
She continued saying all candidates’ paperwork needs to be turned in to the City Office Monday,
August 26th- Friday, September 6th. Clerk West also informed the City Council there have been
changes with the Planning & Zoning Commission, including a new Chairman. James West, the
new P&Z Chairman, has expressed concern regarding inconsistencies in the City Code.
Chairman West has requested permission for the Planning & Zoning Commission to begin
reviewing various chapters of the City Code monthly and provide recommendations for the City
Council to then review.
Council Member Wadsworth, Council President Geray and Council Member Thompson all
stated nothing to report.
Council Member McNamara stated the Iona Historical Museum will be in charge of the Silent
Auction at Iona Days this year. She encouraged support for the museum by participating in the
Silent Auction.

Jacob Hancock of H&H Properties approached the podium and stated his address as 3166
Beckler Dr. in Bonneville County. He stated that said property is current with City Code
and it meets the improvements required by the City Engineer. Member Johnson moved to
recommend the approval of this request to the City Council. Member Elliott seconded the
motion. All in favor, motion carried.
b. Appointment of Gary Elliott: Gary Elliott was appointed as the new Planning and
Zoning Commission Member, previously approved by the City Council.
c. Introduction of City Engineer Dave Noel: Dave Noel approached the podium and
introduced himself as the City Engineer and met each Planning and Zoning Commission
Member.
d. Public Hearings:
i. Approval of Preliminary Plat & Annexation – Heaton Addition, Harper-Leavitt
Engineering: Kevin Murray approached the podium and stated his address as 3525
Merlin Dr. in Idaho Falls. Mr. Murray stated he would like said property annexed as all
properties surrounding it are annexed into the city. He stated the preliminary plat is for
sixteen half acre lots to be put on the ten acre parcel with a Cul-de-sac at the North end.
The property would have a stub at the West side of the Cul-de-sac. Chairman West stated
the Commission received a letter from Mr. Noel and his team that stated there were some
deficiencies in the proposed preliminary plat. Members discussed the deficiencies and
decided that the Preliminary Plat and Annexation should go to the City Council to
approve the Final Plat after all deficiencies can be met. Chairman West entertained a
motion. Member Lott moved to recommend the approval of this request to the City
Council. Member Elliott seconded the motion. All in favor, motion carried.
ii. Approval of Amendments to Iona City Code 11-1-5, 11-11-12, 11-3-3, 11-4-3, 11-
4A-3, and 11-5-3, pertaining to Home Based Businesses and Conditional Use

Permits in Residential Zones: Chairman West entertained a motion. Member Elliott
made a motion to recommend approval to the City Council with a review for grammatical
errors. Member Lott seconded the motion. All in favor, motion carried

AN ORDINANCE ENTITLED THE ANNUAL APPROPRIATION ORDINANCE FOR
THE FISCAL YEAR BEGINNING OCTOBER 1, 2019, AND ENDING ON
SEPTEMBER 30, 2020, APPROPRIATING THE SUM OF $ 5,939,821.00 TO
DEFRAY EXPENSES AND LIABILITIES OF THE CITY OF IONA FOR SAID
FISCAL YEAR, AUTHORIZING A LEVY OF A SUFFICIENT TAX UPON THE
TAXABLE PROPERTY AND SPECIFYING THE OBJECTS AND PURPOSE FOR
WHICH SAID APPROPRIATION IS MADE.
BE IT ORDAINED by the Mayor and City Council of the City of Iona, Bonneville
County, Idaho.
Section 1: That the sum of $ 5,939,821.00 be, and the same is appropriated to defray the
necessary expenses and liabilities of the City of Iona for the fiscal year beginning
October 1, 2019.
Section 2: The objects and purposes for which such appropriation is made, and the
amount of each object and purpose is as follows:
ESTIMATED EXPENDITURES:
GENERAL FUND $ 1,081,301
WATER FUND $ 4,858,520
TOTAL EXPENSES: $ 5,939,821
Section 3: That a general tax levy on all taxable property within the City of Iona be
levied in an amount allowed by law for the general purposes for the said City, for the
fiscal year beginning October 1, 2019.
Section 4: All ordinances and parts of ordinances in conflict with this ordinance are
hereby repealed.
Section 5: This ordinance shall be in full force and effect from and after its passage,
execution and publication in the manner required by law.

I have reviewed the plat on behalf of the City of Iona for the Heaton Addition, proposing to subdivide the
existing 10.7-ac parcel (zoned irrigated ag land) into 16 residential lots (zoned R-1). The following actions
are required in order for the application for the plat to be completed.
REQUIRED ACTIONS:
13)Per City Code of Iona Title 10-1-5.C, the scale on all plats shall be 1” = 100’. Please revise.
19)Individual water and sewer service connections must be provided and shown for each lot. It is
understood that water/sewer services are pendingapproval of the annexationapplication. However,
if annexation is granted, water service connections/plans must be approved by the City of Iona &
Idaho Department of Environmental Quality (IDEQ). Sewer service connections/plans must be
approved by the City of Iona, IDEQ, and Iona-Bonneville Sewer District.
23)Identify if proposed roads are public or private.
ADDITIONAL CORECTIVE ACTIONS REQUIRED:
•Per City Code of Iona Title 10-1-16.B, all lots shall have at least 85-ft of frontage upon a dedicated
street. Frontage for lots located on a cul-de-sac shall be measured at the front setback line (see
Title 11-4-5.A). Show that Lots 8 & 9 have the minimum 85-ft frontage as measured fromthe front
setback line.
•Per City Code of Iona Title 10-1-17.B.4, permanent dead-end streets shall not be longer than 400-
ft. The proposed Wayne Drive has a proposed ± 437-ft dead-end. Please revise.
•City Code of Iona Title 10-1-17.B.4 outlines requirements for temporary dead-end streets such as
the one proposed on this plat extending to the west property line. Length of the proposed dead-end
street must be labeled. The length of this segment appears to be less than 400-feet, which is not
permitted. Even if the street is lengthened to 400-feet, additional platting of the adjacent lot may
be required prior to approval per City Code.
•Per City Code of Iona Title 10-1-17.D.2, ensure there is adequate room for stormwater storage
onsite. Please indicate planned location of future stormwater storage.
•Per City Code of Iona Title 10-1-22.C, no plat shall be accepted by the City or recorded unless the
plat bears the necessary water and sewer certificates required by Idaho Code.
Please note that the Developer shall provide the City of Iona with a set of detailed improvement plans
outlining the design of the proposed subdivision. Approval of the improvement plans must be obtained
prior to Final Plat approval. Please follow all guidelines and design criteria set forth in the City Code of
Iona Title 10-1 in design of the proposed subdivision.
ANNEXATION REVIEW:The revised plat proposes 16 residential 0.5-acre lots. Annexation will
require the City to provide water service to the property, including 16 additional residential connections.
In municipal water planning, IDEQ requires that municipalities project growth out 20 years for future

planning of infrastructure improvements and water right acquisition. Therefore, growth is anticipated and
accounted for in the sizing and design of water infrastructure improvements. City of Iona water
improvements currently under construction will increase the City of Iona’s capacity to service a larger
customer base. Furthermore, the proposed annexation and development border current Iona city limits.
Adjacent properties are serviced by City of Iona water. Therefore, the City Engineer would recommend
this property as a good candidate for annexation and can confirm that the City of Iona has adequate
municipal water to service the proposed lots.
The sewer service for the City of Iona is provided by Iona-Bonneville Water District. Therefore, the
developer must obtain approval from them for the annexation, including a will-serve statement.
ZONING REVIEW:The proposed zoning change for the Heaton Addition is from A-1 to R-1. Except
for a small parcel to the east, all adjacent properties are zoned R-1. This appears to be an area of residential
growth and is not outside the reasonable limits of residential development.

I agree with everything that Dave has said in regards to the Heaton plat review. Just a few additional comments, the road
cross section does not show the five foot wide sidewalk within the right of way, and at the north end of the proposed
subdivision they need to plat a utility easement to allow connection to an existing ten inch water line.

AS A PERMITTED USE OR A NEW CONDITIONAL USE TO
ALL RESIDENTIAL ZONES BY AMENDING SECTIONS 11-3-
2, 11-3-3, 11-4-2, 11-4-3, 11-4A-2, 11-4A-3, 11-5-2, AND 11-5-3;
PRESERVING PRIOR ORDINANCES IN EACH INSTANCE;
PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF IONA,
IDAHO THAT:
Section 1. Amendment of Section 11-1-5 of the Iona City Code. The definition of
Home Occupation in Section 11-1-5 of the Iona City Code is amended as follows:
HOME OCCUPATION. Any gainful business, operation, profession, or craft which that: (a) is
conducted in a residential use zone established under Chapter 3, 4, 4A, or 5 of this Title; and in
which the use (b) is incidental and secondary to the use of one building as a dwelling for dwelling
purposes;, and (c) which occupation is carried on onlyprimarily by the immediate members of the
family residing on that lotwithin the dwelling place.
Section 2. Methodology. Text that is underlined in the preceding section means new
text added to the former Ordinance or City Code Section, and text that is stricken through means
text that is being deleted from the former Ordinance or Code Section. Text that is moved from
one location in the former Ordinance or Code Section to another location is similarly shown as
underlined text, being stricken through in its prior position.

Section 3 . Repeal and Reenactment of Section 11-11-12 of the Iona City Code.
Section 11-11-12 of the Iona City Code is hereby repealed, and a new Section 11-11-12 of the Iona
City Code is reenacted as follows:
11-11-12: HOME OCCUPATION CLASSIFICATIONS. Every Home Occupation, as
defined in this Title, shall be classified into one of the following classifications:
(A) Clerical Home Occupations. A “Clerical Home Occupation” is a Home Occupation that,
regardless of the nature of the underlying business conducted, only uses one building for
office, clerical, planning, file storage, or similar uses.
(B) Service Home Occupations. A “Service Home Occupation” is a Home Occupation that
provides services, documents, or intangible products. Examples include: professional
skills, expertise, advice, salons, repair shops, schools, banks.
(C) Small Service Home Occupations. A “Small Service Home Occupation” is a Service
Home Occupation that is physically visited at the lot by fewer than ten individuals
(regardless of whether such individuals are employees, vendors, customers, clients, or
otherwise) per calendar month.
(D) Merchandising Home Occupations. A “Merchandising Home Occupation” is a Home
Occupation that buys and sells products without changing the form of the products.
Examples include: retail merchants, distributors, and resellers.
(E) Small Merchandising Home Occupations. A “Small Merchandising Home Occupation”
is a Merchandising Home Occupation that is physically visited at the lot by fewer than ten
individuals (regardless of whether such individuals are employees, vendors, customers,
clients, or otherwise) per calendar month.
(F) Manufacturing Home Occupations. A “Manufacturing Home Occupation” is a Home
Occupation that consists only of one or more uses that are light industrial (as defined in
this Title).
(G) Industrial Home Occupations. An “Industrial Home Occupation” is a Home Occupation
that includes a use that is heavy industrial (as defined in this Title).
Section 4 . Repeal and Reenactment of Section 11-11-13 of the Iona City Code.
Section 11-11-13 of the Iona City Code is hereby repealed, and a new Section 11-11-13 of the Iona
City Code is reenacted as follows:
11-11-13: RESTRICTIONS UPON HOME OCCUPATIONS. It shall be an infraction if any
person fails to comply with the restrictions upon any Home Occupation contained in this Section
or to fail to obtain a conditional use permit if one is necessary for the operation of a Home

Occupation. Notwithstanding any other provision of this Code, no more than two Home
Occupations shall be permitted on the same lot and each Home Occupation (as defined in this
Title) is subject to the following restrictions, based on the classifications described and defined in
this Chapter.
(A) Clerical Home Occupations. A Clerical Home Occupation is a permitted use within any
residential zone (i.e., R-A, R-1, R-T, and R-2 zones, as established in this Title), subject to
the following provisions:
(1) The outside appearance of the lot shall not be altered in any way to attract customers
or signify the undertaking of the Clerical Home Occupation and there shall be no
visible evidence of the conduct of such Clerical Home Occupation.
(2) No significant traffic shall be generated by such Clerical Home Occupation and the
dwelling shall only rarely, if ever, be visited by any customer.
(3) No equipment or process shall be used in such Clerical Home Occupation that
creates noise, vibration, glare, fumes, odors, or electrical interference detectable to
the normal senses at any point outside the lot on which the dwelling is located.
(4) No equipment or process shall be used which creates visual or audible interference
in any radio or television receivers off the lot on which the dwelling is located, or
which causes fluctuations in line voltage off the premises.
(5) The business shall not create a nuisance to the surrounding neighborhood in the
form of noise, odors, traffic generated, or in any other manner.
(B) Small Home Occupations. A Small Service Home Occupation or a Small Merchandising
Home Occupation (together referred to in this Section as “Small Home Occupations”) is a
permitted use within any residential zone (i.e., R-A, R-1, R-T, and R-2 zones, as established
in this Title), subject to the following provisions:
(1) The outside appearance of the lot shall not be altered in any way to attract customers
or signify the undertaking of the Small Home Occupations and there shall be no
visible evidence of the conduct of such Small Home Occupations.
(2) The business shall continually satisfy the limitation of being visited by no more
than ten individuals per calendar month, as specified in the definition of the Small
Home Occupations in Section 11-11-12.
(3) No equipment or process shall be used in such Small Home Occupations that create
noise, vibration, glare, fumes, odors, or electrical interference detectable to the

(C) Service Home Occupations. A Service Home Occupation is a conditional use within any
residential zone (i.e., R-A, R-1, R-T, and R-2 zones, as established in this Title), subject to
the following provisions and any other conditions imposed by the Council:
(1) The use of any building on the lot for the Service Home Occupation shall be clearly
incidental and subordinate to their use for residential purposes by the occupants.
Not more than 20% of the total square footage in the buildings shall be used in the
conducting of the Service Home Occupation, and no portion of the Service Home
Occupation shall occur on the lot outside the building in which the Service Home
Occupation is located.
(2) The outside appearance of the lot shall not be altered in any way to attract customers
or signify the undertaking of the Service Home Occupation and there shall be no
visible evidence of the conduct of such Service Home Occupation other than one
sign, not exceeding two square feet in area, indirectly illuminated and mounted flat
against the wall of the building in which the Service Home Occupation is located.
(3) No significant traffic shall be generated by such Service Home Occupation and any
need for parking generated by the conduct of such Service Home Occupation shall
meet the off-street parking requirements as specified in this Title and shall not be
located in a required front yard.
(4) No equipment or process shall be used in such Service Home Occupation that
creates noise, vibration, glare, fumes, odors, or electrical interference detectable to
the normal senses at any point outside the lot on which the dwelling is located.

(D) Merchandising Home Occupations. A Merchandising Home Occupation is a conditional
use within any residential zone (i.e., R-A, R-1, R-T, and R-2 zones, as established in this
Title), subject to the following provisions and any other conditions imposed by the Council:
(1) The use of any building on the lot for the Merchandising Home Occupation shall
be clearly incidental and subordinate to their use for residential purposes by the
occupants and not more than 20% of the total square footage in the buildings or
10% of the area of the lot on which the Merchandising Home Occupation is located
(whichever is less) shall be used in conducting of the Merchandising Home
Occupation.
(2) The outside appearance of the lot shall not be altered in any way to attract customers
or signify the undertaking of the Merchandising Home Occupation and there shall
be no visible evidence of the conduct of such Merchandising Home Occupation

within any residential zone (i.e., R-A, R-1, R-T, and R-2 zones, as established in this Title).
(F) Industrial Home Occupations. An Industrial Home Occupation is not allowed within any
residential zone (i.e., R-A, R-1, R-T, and R-2 zones, as established in this Title).
Section 5. Addition of Certain Classes of Home Occupation as a Permitted Use in
Residential Zones. Clerical Home Occupations are added as a permitted use in each of the
residential zones established under Title 11 of the Iona City Code by adding “Clerical Home
Occupations, Small Service Home Occupations, and Small Merchandising Home Occupations as
defined in this Title and subject to the restrictions of Chapter 11 of this Title.” as a new paragraph
(F) to Section 11-3-2 of the Iona City Code, while the current paragraph (F) is re-numbered as
paragraph (G); as a new paragraph (F) to Section 11-4-2 of the Iona City Code, while the current
paragraph (F) is re-numbered as paragraph (G); as a new paragraph (G) to Section 11-4A-2 of the
Iona City Code, while the current paragraph (G) is re-numbered as paragraph (H); and as a new
paragraph (E) to Section 11-5-2 of the Iona City Code, while the current paragraph (E) is re-
numbered as paragraph (F).

Section 6. Addition of Certain Classes of Home Occupation as a Conditional Use in
Residential Zones. Service Home Occupations and Merchandising Home Occupations are
added as a conditional use in each of the residential zones established under Title 11 of the Iona
City Code by adding “Service Home Occupations and Merchandising Home Occupations, each as
defined in this Title and subject to the restrictions of Chapter 11 of this Title.” as a new paragraph
(11) to Section 11-3-3(B) of the Iona City Code; as a new paragraph (8) to Section 11-4-3(B) of
the Iona City Code; and as a new paragraph (2) to Section 11-5-3(B) of the Iona City Code.
Further, Section 11-4A-3(b)(5) of the Iona City Code is hereby repealed and reenacted as follows:
“Service Home Occupations and Merchandising Home Occupations, each as defined in this Title
and subject to the restrictions of Chapter 11 of this Title.”
Section 7. Severability. The sections and subsections of this Ordinance are severable.
The invalidity of any section or subsection shall not affect the validity of the remaining sections
or subsections.
Section 8. Effective Date. This Ordinance shall become effective upon its passage,
execution and publication in the manner provided by law.

AMENDING SECTION 4-1-1 OF THE IONA CITY CODE;
CLARIFYING THE REQUIREMENT FOR A BUSINESS
LICENSE; AMENDING SECTION 4-1-4 OF THE IONA CITY
CODE; CLARIFYING REQUIREMENTS OF AN APPLICATION
FOR A BUSINESS LICENSE; PRESERVING PRIOR
ORDINANCES; PROVIDING FOR SEVERABILITY; AND
ESTABLISHING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF IONA,
IDAHO THAT:
Section 1. Amendment of Section 4-1-1 of the Iona City Code. Section 4-1-1 of the
Iona City Code is amended as follows:
4-1-1: LICENSE REQUIRED.
(A) Definitions. The following words and phrases when used in this Section shall have, unless
the context clearly indicates otherwise, the following meanings:
(1) BUSINESS: Any industry, vocation, occupation, trade,
profession, or craft.
(2) CLERICAL BUSINESS: A Business that is (a) a Home Occupation,
as defined in Section 11-1-5 of this Code,
and (b) regardless of the nature of the
underlying Business conducted, only uses
one building for office, clerical, planning,
file storage, or similar uses
(3) REGULAR SERVICE BUSINESS: A Business that provides services,
documents, or intangible products.
(4) SMALL SERVICE BUSINESS: A Regular Service Business that is (a) a
Home Occupation, as defined in Section
11-1-5 of this Code, and (b) is physically
visited at its location by fewer than ten
individuals (regardless of whether such
individuals are employees, vendors,
customers, clients, or otherwise) per
calendar month.

(5) REGULAR MERCHANDISING
BUSINESS:
A Business that buys and sells products
without changing the form of the products.
(6) SMALL MERCHANDISING
BUSINESS:
A Regular Merchandising Business that is
(a) a Home Occupation, as defined in
Section 11-1-5 of this Code, and (b) is
physically visited at its location by fewer
than ten individuals (regardless of whether
such individuals are employees, vendors,
customers, clients, or otherwise) per
calendar month.
(7) MANUFACTURING BUSINESS: A Business that consists only of one or
more uses that are light industrial (as
defined in Title 11 of this Code).
(8) INDUSTRIAL BUSINESS: A Business that consists only of one or
more uses that are heavy industrial (as
defined in Title 11 of this Code).
(B) General Requirement. No person shall operate, conduct, or engage in any industry,
vocation, occupation, trade or other bBusiness within the City subject to the provisions of
this Title without first obtaining an appropriate license from the City. Licenses shall be
issued upon payment of the fees specified in this Title, upon the applicant's compliance
with the applicable provisions of this Title, and upon approval of the City Council.
(C) Exceptions. Notwithstanding Subsection (B), above, no Business shall be required to
obtain a business license if it:
(1) is a sole proprietorship;
(2) is not subject to any of the other Chapters of this Title, and
(3) is either: (a) a Clerical Business, (b) a Small Service Business, or (c) a Small
Merchandising Business.
(D) Nature of Business License. All licenses shall be a personal privilege of the holder.
Except as expressly provided in this Title, a license shall become null and void if the holder
ceases to personally supervise, conduct, and operate the trade or bBusiness for which the
license has been issued. Unless otherwise provided in this Title, no license fee or any part
thereof may be refunded even though the licensee does not operate for the period or any
portion of the period for which the license was issued.
(E) Enforcement. The failure to obtain a business license when one is required is an
infraction.

Section 2. Amendment of Section 4-1-4 of the Iona City Code. Section 4-1-4 of the
Iona City Code is amended as follows:
4-1-4: APPLICATION FOR LICENSE. Any person desiring to obtain any license
provided for in this Title shall first apply in writing under oath to the City Council. The application
together with the license fee shall be delivered to the City Clerk. The City Clerk shall prescribe
the form of the application. The application shall contain the following information:
(A) Applicant’s full name, form of doing business, (i.e. sole proprietorship, partnership or
corporation) and the name under which the business is to be conducted;
(B) Applicant’s state of residence and principal place of business;
(C) Applicant’s business and residential mailing addresses and telephone numbers;
(D) The street address within the City where each place of business is to be conducted;
(E) The nature of the business to be licensed;
(F) The number of years the applicant has engaged in such business;
(G) The zoning of the property on which the business will be conducted;
(H) Whether the business is a Home Occupation and, if so, what category (as described in
Section 11-11-12) of Home Occupation the business is, along with the reasons for
Applicant’s asserted categorization; and
(HI) Any other information required by this Title or by the Clerk in order to determine the
applicant's fitness or qualifications for the license.
The City Clerk shall forward a copy of each business license application to the Chief of Police, the
Fire Chief, the Director of Planning and Building and the State of Idaho Department of Health, as
applicable, and other appropriate City Division Directors for their review and recommendation.
Section 3. Methodology. Text that is underlined in the preceding sections means new
text added to the former Ordinance or City Code Section, and text that is stricken through means
text that is being deleted from the former Ordinance or Code Section. Text that is moved from
one location in the former Ordinance or Code Section to another location is similarly shown as
underlined text, being stricken through in its prior position.

The recommendation letter noted deficiencies in the plat application. The developer has since addressed the deficiencies and has resubmitted the required revisions. With the exception of the scale on the plat, the plat application submitted meets the minimum requirements for a plat set forth in the City Code of Iona Title 10 Chapter 1.
