ORDINANCE NO. 81-5530
AN ORDINANCE OF THE CITY OF CARSON
CONCERNING PEDDLING ON OR FROM CITY
STREETS AND SIDEWALKS AND AMENDING
THE CARSON MUNICIPAL CODE AND DECLARING
THE URGENCY THEREOF.
THE CITY OF CARSON DOES ORDAIN AS FOLLOWS :
Section 1 . Section 4118 of Chapter 1 , Article IV
of the Carson Municipal Code is amended to read as follows:
"4118 . Street' Vendors Near Schools. No person
shall sell any product other than written materials or
other products protected by the First Amendment of the
United States Constitution on any public street,
sidewalk , parkway, way, alley, or highway within 1500
feet of the boundaries of any public or private
school between the hours of 6 : 30 a.m. and 5 : 30 p.m. on
any day when such school is in session. "
Section 2 . Section 4125 of Chapter 1 , Article IV
of the Carson Municipal Code is amended to read as follows:
"4125 . Vendors on Streets. No person shall
sell any product from a vehicle parked on any public
street, alley, or highway when:
"A. The posted speed limit on the public street,
alley, or highway where the vehicle is parked exceeds
35 mph; or
"B. The vehicle from which the products are
sold is not lawfully parked; or
"C . Any part of the vehicle from which the
products are sold is open to prospective customers
other than the side of the vehicle facing away from the
street; or
"D. The products are sold to persons within a
vehicle or standing in the portion of the roadway open
to motor vehicles; or
"E. The vehicle is not parked on the right
side of the street; or
"F. There is not a clear view of the vehicle
from the street at a distance of 200 feet in front of
and 200 feet behind the vehicle. "
Section 3 . Section 4126 of Chapter 1, Article IV
of the Carson Municipal Code is repealed.
Section 4 . The existing ordinances regulating the
sale of products from streets and on sidewalks within the
City of Carson are constitutionally suspect under recent
court decisions and, in certain instances, not do adequately

prevent safety hazards relating to such sales . Unregulated
sale of products in such locations would lead to the creation
of traffic and other safety hazards . This ordinance will
establish constitutionally sound regulations that will
prevent such traffic and other safety hazards . This ordinance
is therefore necessary for the immediate preservation of the
public peace, safety and general welfare and shall take
effect immediately upon its adoption.
PASSED, APPROVED AND ADOPTED this 19th day of
January, 1981.

adopted by the City Council of said City on an urgency basis at a regular meeting
of said Council , duly and regularly held on the 19th day, of Jonuary, 19ffil
and that the same was so passed and adopted by the following role call vote:
