Gulick, Associate Planner SUBJECT: ESTABLISH TWO NEW COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) PROJECTS THAT WILL BRING EXISTING CITY PUBLIC PARKING LOTS AND A PORTION OF THE TEMPLE CITY BOULEVARD SIDEWALK INTO COMPLIANCE WITH THE AMERICAN WITH DISABILITIES ACT (ADA) ACCESSIBILITY STANDARDS RECOMMENDATION: The City Council is requested to: a) Hold a public hearing to establish two new CDBG projects relating to ADA accessibility improvements to existing public parking lots and sidewalk improvements on Temple City Boulevard; b) Consider adopting CDBG-funded Programs: Public Parking Lot ADA Accessibility Improvement project in the amount of $115,000 and an ADA Accessibility Improvement Temple City Boulevard project in the amount of $105,000; c) Appropriate $220,000 of City's current unallocated CDBG balance of $323,089 (i.e., from previous fiscal years and recycled CDBG program funds); and d) Authorize the City Manager to release plans and specifications for bid upon receiving approval from the Los Angeles County Community Development Commission (CDC). BACKGROUND: In 1974, the CDBG Program was enacted through the Housing and Community Development Act of 1974. The CDBG Program was established to provide communities with resources to address a wide range of unique community City Council June 18, 2013 Page 2 of 4 development needs, including but not limited to: addressing slum and blighted conditions, assisting or benefiting low- and moderate -income families, or to meet the needs of special -population groups, such as the disabled or senior citizens. 2. During Fiscal Year (FY) 2011-12, the City worked with the CDC in trying to address housing rehabilitation program issues that were identified during an annual review of the City's CDBG Programs. As a result, the City had to delay some of its CDBG Programs resulting in an accumulation of CDBG funds. 3. On May 21, 2012, the City was notified that the City needed to expend $412,755 by December 31, 2012 to meet the CDC's drawdown requirement, which limits a City's CDBG balance to no more than 150% of its annual allocation. The CDC's policy states that if a city fails to expend funds in excess of 150% of its annual allocation by March 30 of each year, that city is required to participate in an appeal hearing process with the CDC to make a case that the excess CDBG funds are needed on a program or project and will be expended within six months. 4. On July 17, 2012, in an effort to reduce the City's excess CDBG funds the City Council increased program allocations for the City's Housing Rehabilitation Loan Program (increased from $150,000 to $299,015) and the ADA Barrier Removal Project (increased from $100,000 to $384,000) for FY 2012-13. 5. On January 15, 2013, the City Council conducted a public hearing and approved the following allocation of CDBG funding to programs for FY 2013-14: A. Housing Rehabilitation Loan Program: $100,000 B. Asbestos Testing and Removal Program: $ 25,000 C. Youth Scholarship Program: $ 26,862 D. ADA Barrier Removal Program: $ 75,000 6. On March 11, 2013, the CDC issued a CDBG Bulletin (Attachment "A") notifying City staff that $611,565 needed to be expended by March 30, 2013 or the CDC could recapture some of the City's CDBG funds. 7. On March 12, 2013, the City, Willdan and CDC staff met to discuss the current status of City's FY 2012-13 CDBG Programs, the City's FY 2013-14 CDBG Programs and two potential out of cycle projects (i.e., Public Parking Lot ADA Accessibility Improvements and the Temple City Boulevard ADA Accessibility Improvements), which would assist in reducing the City's CDBG fund balance. The CDC requested that the City provide additional information relating to the specific work and estimated costs. 8. On May 8, 2013, the CDC issued a letter (Attachment "B") informing the City that we would not be required to go through the normal appeal hearing process and they would defer the decision on whether or not the City would have to go through City Council June 18, 2013 Page 3 of 4 an appeal hearing process until September 30, 2013. Additionally, the CDC would require that the City submit a work out plan and schedule outlining monthly CDBG Program expenditures through September 30, 2013. 9. On May 15, 2013, City staff received notification from the CDC that the two new projects were initially approved, and the City could proceed with publishing the required 30 day notice to establish the two new projects and conduct the required public hearing. 10. On May 17, 2013, a public notice regarding the establishment of two new projects utilizing CDBG funds to bring existing public parking lots and part of Temple City Boulevard into compliance with ADA accessibility standards was published in the Temple City Tribune. Since 1974, the City has received CDBG funds from the CDC as a sub -recipient. For the past 20 years the City has primarily used CDBG funds on housing rehabilitation loans, asbestos and lead-based paint testing and abatement grants, youth scholarships grants, and various ADA improvements to public facilities. Currently, the City has excess CDBG funds that need to be allocated by September 30, 2013 or risk losing funds. In an effort to avoid this outcome, City staff recommends creating two new CDBG-funded projects to bring existing public parking lots and a section of Temple City Boulevard into compliance with ADA accessibility standards. Public Parking Lot Improvements To assess needed improvements on public parking lots, the City's Engineer conducted a walking survey of the City's public parking lots in the downtown area and provided a list of items (Attachment "C") that were not in compliance with ADA requirements. The items included existing curb ramps that needed to be modified since some are currently too steep or do not provide sufficient landings for required ADA path of travel. Additionally, the handicap spaces and associated loading zones were identified as being substandard. The City Engineer has provided an estimate of $115,000 for the public parking lot improvements. The public parking lot improvements may temporarily provide an inconvenience during construction for the employees and customers that normally utilize the City's public parking lots. However, the improvements will bring the City public parking lots in the downtown area into compliance with ADA accessibility requirements and provide necessary access for elderly and disabled people. Temple City Boulevard Sidewalk Improvements During the walking survey of the public parking lots, the City Engineer also noted sidewalk improvements needed (Attachment "D") along Temple City Boulevard, City Council June 18, 2013 Page 4 of 4 between Woodruff Avenue and Live Oak Avenue. The City Engineer identified 10 curb ramps that need to be modified as well as other improvements/modifications (e.g., relocating bus shelters/benches, relocating trash receptacles, relocation of poles, tree planter improvements, etc.) that are necessary to provide a clear ADA path of travel for the sidewalk. The City Engineer has provided an estimate of $105,000 for the Temple City Boulevard sidewalk improvements. The sidewalk improvements may also cause a temporary inconvenience to pedestrians that utilize the Temple City Boulevard sidewalk between Woodruff Avenue and Live Oak Avenue during construction. However, after the work is completed, the sidewalk will be in full compliance with ADA accessibility standards and provide a safe path of travel for elderly and disabled people. CKQ 61, MK1,61ld1! G The City Council is requested to establish two new CDBG projects relating to ADA accessibility improvements to existing public parking lots and sidewalk improvements on Temple City Boulevard to utilize the City's excess CDBG funds that need to be allocated by September 30, 2013 to avoid losing these funds. FISCAL IMPACT: The two proposed new CDBG projects will have no affect on the City's General Fund or CDBG Programs for FY 2012-13. The new CDBG projects would utilize a portion of the City's current CDBG unallocated balance of $323,089. This action will appropriate $220,000 in the FY 2012-13 City Budget by designating the expenditure of CDBG funds as follows: Temple City Boulevard ADA Accessibility Improvements: $105,000 Public Parking Lot ADA Accessibility Improvements: $115,000 ATTACHMENTS: A. This will be the final Bulletin before final funding requests are due. Since the deadline of March 30"' falls on a Saturday, final funding requests will be due by 12 noon, Monday, April 1, 2013. Cities must submit complete and accurate funding requests equaling the amount showing in the "Additional Expenditure Required" column of the attached Report or be subject to recapture of funds. Cities that have amounts exceeding $10,000 in the "Additional Expenditure Required" column after the deadline, will receive a letter outlining the appeals process, and may have any portion of that amount recaptured. The amount in the "Adjustments" column reflects program income received between January and March and is not included in the "Additional Expenditure Required" calculation. Per the City's Reimbursable Contract with the Community Development Commission of the County of Los Angeles, funding requests "must be submitted on a minimum of a bi-monthly basis as specified and provided by the County." As of the April 1, 2013 deadline, the City exceeded its drawdown requirement by $463,894. We acknowledge that the management oversight of your CDBG program is one (1) of your top priorities. On March 12, 2013, Mark Persico, your new Community Development Director, and other City representatives met with members of my staff. During this meeting, Mr. Petslco presented a draft work out plan that outlined the actions to be taken to accelerate the City's CDBG drawdown performance, including projected expenditures of costs totaling $664,000 within the next six (6) months. Given your commitment, we will not require the City's participation in an administrative appeals hearing, and we will defer our decision on the recapture of excess funds until September 30, 2013. In the meantime, please respond to this letter by submitting the following information by May 30, 2013: • A work outplan that formalizes the actions stated in the aforementioned draft plan; and • A milestone expenditure schedule that projects monthly CDBG expenditures through September 30, 2013. Please use the attached Excel spreadsheet template to develop this plan. We will also require your staff to submit monthly status reports, from June 30, 20L3 through September 30, 2013, to Linda Hamill, CDBG Program Manager, and Tom Crabson, CDBG Contract/Labor Compliance Officer. Using the Excel format, these submittals should report how the City is pacing, comparing the projected expenditure against the actual expenditure for the monthly milestone and include a narrative to explain any variances and mitigating measures to ultimately meet the drawdown requirement. As a result, CDBG funds can be used to make existing facilities compliant with the Americans with Disabilities Act (ADA). Presented below is a scope of work for a proposed ADA project that will serve to remove material and architectural barriers for elderly and severely disabled in public parking lots in the City of Temple City. The project will provide for curb cuts, or the correction of existing curb cut ramps that are too steep or do not provide a sufficient landing for pedestrian path of travel, to be in compliance with ADA requirements. The project will also provide for handicap spaces and loading zones and required signage, where appropriate, to be in compliance with ADA requirements. These ADA improvements will provide accessibility to elderly and severely disabled persons by providing a clear path of travel from their automobiles by ensuring sufficient loading and unloading areas to adjacent commercial buildings and other public facilities. Lot 513 — will be brought into compliance with improvements to Lot 5A. Lot 8B — correct existing mid -lot ramp for ADA compliance. Improvements may require re -location of existing tree. Correct parking stall width, provide for 8' loading zone and relocate handicap signage. Lot 8A — mid -lot ramp looks to meet ADA requirements, but check slope for compliance. Lot 7A — add two handicap parking stalls with required signage and cut handicap walkway from parking lot to sidewalk to provide safe path of travel. Lot 4 — add two handicap parking stalls and cut handicap walkway from parking lot to sidewalk to provide safe path of travel. These improvements will be made along north and south bound Temple City Boulevard from about Woodruff Avenue on the north to Live Oak Avenue on the south near public bus shelters. The ADA accessibility improvements are targeted for this area in one of the City's main downtown commercial districts and along a bus transportation line. CDBG funds will be used for the construction of the ADA accessibility improvements, as well as for engineering design, survey, project inspection, construction management and labor compliance. CDBG funds will also be used to pay for City staff and/or consultant costs for project administration.
