HomeMy Public PortalAbout82-592 ORDINANCE NO. 82-592 AN ORDINANCE OF THE CITY OF CARSON CHANGING THE ZONING OF CERTAIN PROPERTIES AND AMENDING THE CARSON MUNICIPAL CODE (ZONE CHANGE CASE NO. 79-81) THE CITY COUNCIL OF THE CITY OF CARSON DOES ORDAIN AS FOLLOWS: Section 1 . That certain property in the City of Carson identified as Property 2 in the February 16, 1982 , Staff Report for Zone Change Case No. 79-81, attached hereto as Exhibit A, and more particularly described in Exhibit B, is hereby classified and zoned to the RM-12 (Residential , Multiple Dwelling-12 units per acre) zoned district. Section 2. That certain property in the City of Carson identified as Property 4 in the February 16 , 1982, Staff Report for Zone Change Case No. 79-81, attached hereto as Exhibit A, and more particularly described in Exhibit C, is hereby classified and zoned to the ML (Manufacturing, Light) zoned district. Section 3. The Zoning Map of the City of Carson as adopted by Section 9114. 1 of the Carson Municipal Code is hereby amended by changing the classification of the property referred to in Section 1 to RM-12 and by changing the classification of the property referred to in Section 2 to ML, and said map shall have noted thereon "Amended to March 15 , 1982. Section 4. The City Clerk is directed to enter the date of adoption of this ordinance in the appropriate space in Section 3 hereinabove. PASSED, APPROVED and ADOPTED this 15th day of March 1982 . STATEMENT ON THE SUBJECT On January 26 , 1982 , the Planning Commission considered Zone 'Change Case No. 79- 81, a proposal to rezone 42 properties throughout the City in order to make the zoning consistent with recent amendments to -the Land Use Element of the City's General Plan. The City Council will recall that on December 11 , 1981', the Council adopted changes to the land- use designations of certain properties. This action then set the stage for the rezoning of these pro- perties . The rezoning is necessary because the California Government Code (Section 65860) requires that zoning must be consistent with land use desig- nations. To correct the inconsistency between the General Plan .and zoning, Staff offered for the Planning Commission ' s consideration a series of 42 zone changes. The Commission favorably considered 37 of the 42 rezonings and recommended that Council concur with their findings . The Commission deferred action on five (5) sites , and for this reason the sequential numbering of pro- perty descriptions and maps has five omissions . The sites are described belo�•: and illustrated in a series of maps contained in Exhibit No. 1. Property 1 : A 12 . 1- acre -site located at the southwest corner of Victoria Street and Central Avenue. The existing zoning is MH (Manu- facturing, Heavy) . The proposed zoning is ML (Manufacturing, Light) . Property 2 : - A 64 . 1- acre site located at the northeast corner of Central Avenue and 190th Street. ENVIRONMENTAL ASSES.SMENT The City Council will recall that an Environmental Impact Report was prepared . for the Update and revision of the City's General Plan including all changes to land use designations . The rezoning being proposed by Staff merely imple- ments the General Plan amendments. Accordingly, a Negative Declaration for Zone Change Case No. 79- 81 was prepared on January 11 , 1982 . POLICY ISSUE The City Council must consider . all proposed changes in zoning. BUDGET IMPACT Indeterminable. Rezoning of properties will affect property taxes which will have an indirect City impact. Also , 'rezoning to a commercial district may generate sales tax revenues if future development is retail oriented (vis- a- vis office space) . Similarly, rezoning from a commercial district may result in a potential loss of sales tax. This budget impact analysis , however, is dependent upon many unknown variables . Staff conclusion is that the zone changes will result in minimal fiscal impacts . RECOMMENDATION That the City Council concur with the recommendation of the Planning Commission and favorably consider the proposed changes in zoning outlined in the .Staff Re ort and instruct the City Attorney to prepare the necessary ordinance.
