HomeMy Public PortalAbout84-683U ORDINANCE NO. 84- 683 U AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARSON DECLARING A MORATORIUM ON THE DEVELOPMENT OF SINGLE FAMILY PLANNED UNIT DEVELOPMENTS AND SINGLE FAMILY CONDOMINIUM PROJECTS AND DECLARING THE URGENCY THEREOF. THE CITY COUNCIL OF THE CITY OF CARSON DOES ORDAIN AS FOLLOWS: Section 1. Notwithstanding any provision of the Carson Municipal Code or other ordinance of the City of Carson, no building permit for new construction (unless the proposed development has already received from the City design review approval or a conditional use permit) , design review approval, conditional use permit or other permit or entitlement for use for the development of single family planned unit developments or single family condominiums , shall be issued and no application therefor shall be accepted for filing, and no application presently on file shall be processed or approved. Section 2: Any person violating any of the provision of this ordinance is guilty of a misdemeanor. Such violation is punishable by a fine not to exceed five hundred dollars or by imprisonment in the County jail not to exceed six months or by both such fine and imprisonment. Each day or any portion thereof during which any such violation occurs or continues shall constitute a separate offense. Section 3: If any provision or clause of this ordinance or the application thereof to any person or circumstances is held to be unconstitutional or to be otherwise invalid by any court of competent jurisdiction, such invalidity shall not affect the other- provisions or clauses or applications thereof which can be implemented without the invalid provision or clause or application, and to this end the provisions and clauses of this ordinance are declared to be severable. Section 4: This ordinance shall expire and terminate forty-f ve (45) days after the date of adoption hereof unless extended by the City Council, at a regularly noticed public hearing. Section 5: The development of single family condominiums and single family planned unit developments have recently been proliferating. . The recent surge in single family condominium projects and planned unit develop- ments, and their impact upon surrounding residential neighbor- hoods have placed into question the sufficiency of existing regulations. The Planning Commission is conducting studies, and intends to conduct further studies, to determine and establish permanent regulations on planned unit developments and condominiums. Planned unit developments and condominiums projects under the existing zoning ordinance will be under-taken that may conflict with the zoning and land use Ord. No. 84-683U/Page 2 of 2 QMB45-29A classifications and regulations presently being studied. The construction of any development that would conflict with future regulations would be highly detrimental to the welfare of the community. Due to the foregoing circumstances, there is a current and immediate threat to the public health, safety and welfare. The issuance of building permits, conditional use permits, design review approval, or any other applicable entitlement for use for planned unit developments and condominiums under the zoning ordinance would result in a threat to public health, safety, or welfare. This ordinance will insure that no such use will be approved prior to the adoption of permanent regulations, and without due consideration by the planning commission of the potential impact .of said uses and the imposition of conditions. Therefore, this ordinance is necessary for the immediate preservation of the public peace, health, safety and welfare, is an urgency interim ordinance adopted pursuant to Section 65858 of the California Government Code, and shall take effect immediately. _ PASSED, APPROVED, AND ADOPTED this 21st day of May —, 1984.
