CALL TO ORDER Mayor Chavez called the City Council Regular Meeting to order at 7:30 p.m. in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 2. ROLL CALL PRESENT: Councilmember -Blum, Sternquist, Vizcarra, Chavez ABSENT: Councilmember -Yu ALSO PRESENT: City Manager Pulido, City Attorney Vail, Parks & Recreation Director Burroughs, City Clerk Flandrick, Assistant to City Manager Haworth, Community Development Manager Lambert, Public Safety Officer Ariizumi Councilmember Blum moved to excuse Mayor Pro Tem Yu for cause, seconded by Councilmember Sternquist and unanimously carried. 3. INVOCATION Pastor John Aitken of Temple City Seventh Day Adventist Church provided the Invocation. 4. PLEDGE OF ALLEGIANCE Mayor Chavez led those present in the Pledge of Allegiance to the Flag. 5. CEREMONIAL MATTERS — PRESENTATIONS A. PRESENTATION REGARDING THE GERALD FITZGERALD FUND Rabbi Alan Lachtman of Temple Beth David in Temple City presented information on the founding of the Gerald Fitzgerald Camellia Fund and its progress over the last 20 years. Mr. Fitzgerald, a long -time resident of the City, upon his death, bequeathed his worldly possessions to a trust fund to aid the City's underprivileged children. Rabbi Lachtman was one of the original trustees and is still active on the Board that oversees disbursement of the funds. Parks and Recreation Director Burroughs, via a power point presentation, provided information on the guidelines of the trust fund and the process for applying for aid through the fund. The public was also asked to consider donating to the fund to help the youth of the City. 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Jerry Jambazian, Temple City businessman, spoke of the 15th anniversary of the performing arts pavilion, and his work as a committee member in establishing the pavilion for this purpose. He complimented Parks and Recreation Director Cathy Burroughs and Administration Coordinator Debbie Ingram for the successful park events and summer concert series and presented to them a photo album and DVD of all the events and also a photo of one of the concerts. CONSENT CALENDAR City Manager Pulido removed Item I (Amendment to AT &T Land and Building Lease) to be continued to the next Council meeting in order to obtain additional information from AT &T. Councilmember Blum moved to approve the remainder of the Consent Calendar, seconded by Councilmember Vizcarra and unanimously carried by the following roll call vote: AYES: Councilmember -Blum, Sternquist, Vizcarra, Chavez NOES: Councilmember -None ABSENT: Councilmember -Yu ABSTAIN: Councilmember -None A. APPROVAL OF MINUTES Approved as presented: 1) Minutes of the City Council Regular Meeting of August 16, 2011; 2) Minutes of the City Council Special Meeting of August 23, 2011; and 3) Minutes of the City Council Special Meeting of August 31, 2011. B. PARKS AND RECREATION COMMISSION ACTIONS — MEETING OF AUGUST 17, 2011 Received and filed the Parks and Recreation Commission actions of their meeting of August 17, 2011. C. PUBLIC SAFETY COMMISSION ACTIONS — MEETING OF AUGUST 24, 2011 Received and filed the Public Safety Commission actions of their meeting of August 24, 2011. E. RELEASE OF GRADING SECURITY FOR PARCEL MAP NO. 68247 AT 5007 TO 5015 FARAGO AVENUE Authorized release of security in the amount of $9,100.00 for grading improvements completed at 5007 — 5015 Farago Avenue, Parcel Map No. 68247. F. APPROVAL OF PROGRESS PAYMENT NO. 8 TO HIRSCH & ASSOCIATES, INC. FOR WORK PERFORMED ON THE LIVE OAK PARK CIRCULAR PLANTER RENOVATION PROJECT Approved progress payment No. 8, in the amount of $360.00, to Hirsch & Associates, Inc. for professional architectural services performed for the Live Oak Park Circular Planter Renovation Project (P10 -03). FIRST AMENDMENT TO CONSULTANT SERVICES AGREEMENT WITH TEMPLE CITY CHAMBER OF COMMERCE Approved the First Amendment to Consultant Services Agreement by and between the city of Temple City and the Temple City Chamber of Commerce J. ADOPTION OF RESOLUTION NO. 11 -4773 — APPROVAL OF PAYMENT OF BILLS Adopted Resolution No. 11 -4773, a RESOLUTION OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $347,453.82 DEMAND NOS. 32593 THROUGH 32720. 8. UNFINISHED BUSINESS A. SECOND READING AND ADOPTION OF ORDINANCE NO. 11 -945 ADOPTING BY REFERENCE TITLES 26 THROUGH 31 OF THE LOS ANGELES COUNTY CODE, WHICH ADOPT BY REFERENCE THE 2010 CALIFORNIA BUILDING CODE, THE 2010 CALIFORNIA ELECTRICAL CODE, THE 2010 CALIFORNIA PLUMBING CODE, THE 2010 CALIFORNIA MECHANICAL CODE, THE 2010 CALIFORNIA RESIDENTIAL CODE, AND THE 2010 CALIFORNIA GREEN BUILDING STANDARDS CODE, AND ADOPT LOCAL AMENDMENTS THERETO Community Development Manager Lambert reviewed his staff report, stating on August 16, 2011, the City Council conducted a public hearing to consider adoption of Ordinance No. 11 -945 and introduced the ordinance for first reading. It was now presented for second reading and adoption. Ordinance No. 11 -945 will adopt by reference the 2010 Building Codes as amended by the Los Angeles County Board of Supervisors. The amended 2010 Building Codes have been codified as the Los Angeles County Code as follows: Title 26 — Building Code; Title 27 — Electrical Code; Title 28 — Plumbing Code; Title 29 — Mechanical Code; Title 30 — Residential Code; and Title 31 — Green Building Standards Code. At the request of Council, City Clerk Flandrick read the title of Ordinance No. 11 -945. SECOND READING AND ADOPTION OF ORDINANCE NO. 11 -946, AMENDING SECTION 3100 OF THE TEMPLE CITY MUNICIPAL CODE AND ADOPTING THE City Council Minutes September 6, 2011 Page 4 CONSOLIDATED FIRE PROTECTION DISTRICT OF LOS ANGELES COUNTY FIRE CODE Community Development Manager Lambert stated Ordinance No. 11 -946 was considered by the City Council at a public hearing on August 16, 2011 and introduced for first reading. It was now presented for second reading and adoption. This ordinance will adopt the District Fire Code as the City's Fire Code and ratify the building standards relating to fire and panic safety that are more restrictive than those contained in the portions of the 2010 California Fire Code and 2009 International Fire Code adopted by the District. At the request of Council, City Clerk Flandrick read the title of Ordinance No. 11 -946. Councilmember Blum moved to: waive further reading adopt Ordinance No. 11 -946, an ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING SECTION 3100 OF THE TEMPLE CITY MUNICIPAL CODE AND ADOPTING THE CONSOLIDATED FIRE PROTECTION DISTRICT OF LOS ANGELES COUNTY FIRE CODE, RATIFYING THE MORE RESTRICTIVE BUILDING STANDARDS CONTAINED IN THAT CODE, AND DELEGATING ENFORCEMENT OF THE FIRE CODE IN THE CITY TO THE FIRE CODE, seconded by Councilmember Vizcarra and unanimously carried by the following roll call vote: AYES: Councilmember -Blum, Sternquist, Vizcarra, Chavez NOES: Councilmember -None ABSENT: Councilmember -Yu ABSTAIN: Councilmember -None 9. NEW BUSINESS — None 10. COMMUNICATIONS — None 11. RECESS TO COMMUNITY REDEVELOPMENT AGENCY MEETING At 8:00 p.m., the City Council recessed to the Community Redevelopment Agency Meeting. Minutes of the Agency Meeting are set forth in full in the Agency's records. RECONVENE AS CITY COUNCIL The City Council meeting was reconvened at 8:02 p.m. with all Councilmembers present, except Mayor Pro Tem Yu. 12. ACTION ON REQUEST BY CRA — None 13. UPDATE FROM CITY MANAGER City Manager Pulido updated the City Council on several matters, stating that a report issued by the County Assessor indicates that Temple City experienced a 4% increase in assessed property valuations over the past year, which shows the city as a community worth investing in. An article in today's Pasadena Star News reports on a comparison of benefit packages of several cities, including Temple City, whose benefits were described as very generous. The City Council will be reviewing the City's benefit package when the actuarial study is completed. 1 1 1 1 1 City Council Minutes September 6, 2011 Page 5 14. MATTERS FROM CITY OFFICIALS — None 15. COUNCIL REPORTS REGARDING AD HOC OR COMMISSION MEETINGS Councilmember Blum presented the final report of the Communications Ad Hoc Committee formed in September 2010 "to determine the information that citizens /businesses want or should know, and define the best vehicles to disseminate that information ". The Ad Hoc Committee consists of Councilmember Blum, Councilmember Sternquist and Committee Members: Janice Helmer, Tim Huang, Jerry Jambazian and Linda Payne. The Committee met seven times and resolved or moved toward resolution significant items, including: • Hiring a staff member to address communication issues • Implementing an annual State of the City Report • Developing focused Town Hall meetings • Upgrading the City's Website • Posting a summary of Council decisions /actions the day after the Council meetings • Posting the weekly City Managers Report on the City Website • Displaying information on electronic screens during Council meetings for audience viewing • Facilitating the reinstitution of a Ministerial Council in the City • Communicating effectively and appropriately with the Chinese population • Developing a Radio Station prior to the start of the Rosemead Project • Developing a Citizens Academy • Revamping the City's Quarterly Newsletter With the key items either in place or under way, it was recommended that the Ad Hoc Committee be terminated. Mayor Chavez so ordered. Councilmember Vizcarra reported on a recent meeting of the Public Art Advisory Ad Hoc Committee and its recent effort to finish up with the design and color palettes and other details involved with installing the bust of Walter Temple in Temple City Park near the corner of Golden West and Las Tunas. The Committee is also scheduled to meet to discuss possibilities of public art connected to the Rosemead Boulevard Improvement Project. 16. COUNCIL ITEMS SEPARATE FROM THE CITY MANAGER'S REGULAR AGENDA A. COUNCILMEMBER BLUM — None B. COUNCILMEMBER STERNQUIST Councilmember Sternquist reported that she attended the Senior Lunch Program last Thursday and thanked all of the volunteers who help to make this program a success. There were approximately 70 -80 people in attendance which has exceeded expectations. She encouraged all to attend. C. COUNCILMEMBER VIZCARRA Councilmember Vizcarra suggested an additional strip of concrete in front of the bandstand at Temple City Park might be considered for those people who wish to dance during the summer concert series. City Manager Pulido indicated staff would look into that possibility. D. MAYOR PRO TEM YU - Absent City Council Minutes September 6, 2011 Page 6 E. MAYOR CHAVEZ Mayor Chavez, as requested by Council, provided details of his office hours at City Hall meeting with residents, indicating the nature of the issue(s) discussed and if or how they were resolved. 17.
