KOCH, JR. COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD, GULF STREAM, FLORIDA. I. CALL TO ORDER Chairman Murphy called the meeting to order at 8:00 A.M. II. Regular Meeting of January 24, 2023 Board Member Roach made a motion to approve the minutes of the January 24, 2023, regular meeting. Vice Chairman Dockerty seconded the motion with all voting AYE at roll call. IV. Additions, withdrawals, deferrals, arrangement of agenda items There were none. V. Announcements A. Meeting Dates 1. No August meeting Chairman Murphy noted that there would be an ARPB Workshop held on Thursday, March 16, 2023, at 8:30 A.M. Assistant Town Attorney explained some of the items that would be covered at the workshop and added that the meeting probably would not last more than an hour. VI. Public Hearing A. Declaration of Ex-Parte Communication Minutes of ARPB Regular Meeting & Public Hearing Held 1-24-2023 @ 8:30 A.M. There was none. B. Administer Oaths Town Clerk swore in Mark Marsh, Mark and Yvonne Templeton. C. Application for Development Approval 1. An application submitted by Mark Marsh of Bridges & Marsh Architects, as Agent for 14 Driftwood Landing Revocable Trust, owners of property located at 14 Driftwood Landing, Gulf Steam, FL, legally described as Lot 2, Driftwood Landing, according to the Plat thereof, as recorded in Plat Book 30, Pages 231 and 232, of the Public Records of Palm Beach County, Florida. a. Major Modification to Approved Landscape Plan A Landscape Plan was approved on April 8, 2022, with the condition that any major modifications to the approved landscape plan be brought back to the ARPB for review and approval prior to commencement of landscaping. The architect is seeking approval to remove a large existing Banyan and replace it with a Seagrape. Assistant Town Attorney explained that due to the Banyan being such a large tree, staff did not feel the Seagrape was a sufficient replacement, thus recommended denial. Town Manager Dunham stated that Mark Marsh had called and asked if they could replace a tree in kind to which Mr. Dunham agreed he could, but in the meantime before submitting the new landscape plan the tree had been trimmed. Mr. Dunham added that a neighbor made a complaint and then Mr. Marsh submitted the new landscape plan, to which the staff did not feel comfortable approving it on a Level One Application and determined it needed to go back before the ARPB as a major modification. Mr. Mark Templeton, Town resident, stated he and his wife, Yvonne, had lived on Driftwood Landing since 1996 and added their home was adjacent to this property on the east side. He stated the builder had communicated with them what was going on at 14 Driftwood Landing and they were in support and understood that the Banyan could not be saved. Board Member Roach stated he was reluctant to have the tree removed because it was a signature tree and he was upset at the cutting that had already happened. Mr. Templeton agreed and added that to save the tree, the entire construction would have had to be re -worked. He added that when his personal landscaper agreed that the Banyan couldn't be saved, they all succumbed to the fact that it needed to come down and he hoped there would be a suitable replacement. The Board agreed that the replacement needed to be a mature tree that was at least 25' tall. Mrs. Templeton stated in Woodside, before anyone could build on any property, they had to hire an arborist to tag every tree over a certain size on the lot and the fines for destroying a tree that has been tagged were astronomical. 2 Minutes of ARPB Regular Meeting & Public Hearing Held 1-24-2023 @ 8:30 A.M. Assistant Town Attorney explained that the State of Florida pre- empted certain types of regulations regarding trees. Mr. Templeton suggested that in the future, when looking at applications, a more in depth look at the types of trees and sizes of trees on the property be a concern before approving. Mark Marsh, Architect, stated that the roots of the Banyan were going to encroach on the proposed structure and the tree must be removed. He stated they were proposing a 20' high Seagrape. Board Member Roach stated that trimming the tree as much as they did was a point of asking for forgiveness instead of permission and he was not pleased with how Mr. Marsh had proceeded in this manner. The Board agreed that there wasn't enough information, and they would like to see detailed plans, elevations, sizing of the tree or multiple trees that would make a replacement and wanted to defer this item until the next meeting and have the Landscape Architect make a presentation. Alternate Board Member Greene made a motion to defer this item to the March 23, 2023, regular meeting, with the recommendation that the applicant bring back detailed plans, elevations, and size of tree or trees to replace the Banyan. In summary, the Musselmans are intending to preserve the quality and character of the historic home originally designed by Marion Sims Wyeth in 1939 with some limited additions to reflect today's program requirements. The key features of the Main House, including the central mass and carriage wing, will be restored to original form. The existing two-story east wing will be expanded north by i0 feet with a single -story wing expanding further east by another IO feet. Additional improvements to the Main House include an expanded sun porch to the south, along with a reconfigured and expanded addition containing family room, kitchen space, and outdoor covered terrace space to the southwest — all matching the original feel and character of the home. The Existing accessory buildings will also maintain their original form and character except for a re -built front porch at the pool house and a rear covered porch addition at the Guest House.
