A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, APPROVING A
SITE PLAN FOR A 10 UNIT APARTMENT BUILDING AT 285
SUNRISE DRIVE, KEY BISCAYNE, FLORIDA; PROVIDING
FOR RECORDING; PROVIDING AN EFFECTIVE DATE.
WHEREAS, 285 Sunrise LLC (the "Applicant") has applied for approval of a site plan for
a 10 unit apartment building at 285 Sunrise Drive, which property is legally described in attached
Exhibit "A" hereto; and
WHEREAS, the Village Council has held the properly noticed public hearings required
under the Village of Key Biscayne, Florida, Zoning and Land Development Regulations; and
WHEREAS, the Village Council finds that the proposed site plan, with certain conditions,
meets each of the applicable review criteria for approval in Section 30-80(g) of the Zoning and Land
Development Regulations.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. Recitals Adopted. That the recitals set forth above are hereby adopted and
confirmed.
Section 2. Site Plans Approved. The Site Plan entitled The Lanai Townhouses consisting
of 19 sheets as prepared by Wilfredo Borroto Architects, P.A. dated September 20-21, 2007 and
October 22, 2007 as reflected on Exhibit "B" hereto is hereby approved, subject to the following
conditions in Section 3 below.
Section 3. Conditions. The approvals granted by this Resolution are subject to the
Applicant's compliance with the following conditions, to which the Applicant stipulated at the public
hearing:
1. The patio areas shall be 100% in landscaping as shown on the plans. Any material
other than landscaping is prohibited including but not limited to pavers, stepping
stones, bricks, concrete, etc.
2. Patios and balconies shall not have any type of enclosure.
3. The perimeter wall facing Sunrise Drive shall have a 2 ft. of CBS wall, a 4 ft. picket
railing for a total height of 6 ft. The railing shall match the balcony railings or
window trim.
4. Prior to the issuance of a building permit, these conditions shall be recorded in the
public records of Miami -Dade County and be included in the Condominium
Documents, (if any).
5. The applicant shall bury all on and offsite power and utility lines servicing the
property and shall be reimbursed by the Village for 50% of the cost. fbut-not-ntere
6. The Site Plan shall be modified prior to permitting and to the satisfaction of the
Building, Zoning, and Planning Director in order to accommodate the burying of the
power and utility lines.
Section 4. Recording. This Resolution shall be recorded, prior to the issuance of a
building permit, by the Applicant at its expense in the public records of Miami -Dade County. A
copy of the proof of recordation shall be submitted to the Building, Zoning and Planning Department
prior to the issuance of any building permits.
Section 5. Effective Date. That this resolution shall become effective upon its adoption.
