HomeMy Public PortalAbout92-997 ORDINANCE NO. 92-997 AN ORDINANCE OF THE CITY OF CARSON RELATING TO PAYMENT OF CITY EMPLOYEES FOR EMPLOYMENT DURING AN EMERGENCY AND AMENDING THE CARSON MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF CARSON DOES ORDAIN: Section 1. Article III, Chapter 7, Section 3705, paragraph (a) (6) of the Carson Municipal Code is hereby amended to read as follows: 113705. Powers and Duties of the Director and Assistant Director of Emergency Preparedness. (a) The Director is hereby empowered to: (6) In the event of the proclamation of a "local emergency" as herein provided, the proclamation of a "state of emergency" by the Governor or the Director of the State Office of Emergency Services, or the existence of a "state of war emergency, " the Director, or in the Director's absence, the Assistant Director or other person so designated in the City of Carson Emergency Plan, is hereby empowered: (i) To make and issue rules and regulations on matters reasonably related to the protection of life and property as affected by such emergency; provided, however, such rules and regulations must be confirmed at the earliest practicable time by the City Council; (ii) To obtain vital supplies, equipment, and such other properties found lacking and needed for the protection of life and property and to bind the city for the fair value thereof and, if required immediately, to command the same for public use; (iii) To require emergency services of any city officer or employee and, in the event of the proclamation of a "state of emergency" in the county in which this city is located or the existence of a "state of war emergency, " to command the aid of as many citizens of this community as he or she deems necessary in the execution of his or her duties; such persons shall be entitled to all privileges, benefits, and immunities as are provided by state law for registered disaster service workers; (iv) To requisition necessary personnel or material of any city department or agency; (v) To authorize payment of additional compensation to employees who are not otherwise entitled to overtime pay pursuant to the provisions of the City of Carson's personnel rules or a memorandum of understanding. The additional compensation shall be in recognition of services performed and authorized hours worked by such employees due to the emergency. The additional compensation shall not exceed the employee's daily rate of pay for each day worked during the emergency; and (vi) To execute all of his or her ordinary powers as City Administrator, all of the special powers conferred upon him or her by this ordinance or by resolution or emergency plan pursuant hereto adopted by the City Council, all powers conferred upon him or her 921202 mbb 0850712 (3) ORDINANCE NO. 92-997/PAGE 2 OF 2 by any statute, by any agreement approved by the City Council, and by any other lawful authority. " Section 2. Article III, Chapter 7, Section 3705 of the Carson Municipal Code is hereby amended by adding thereto a new paragraph (d) to read as follows: 113705. Powers and Duties of the Director and Assistant Director of Emergency Preparedness. " (d) In the event of the proclamation of a "local emergency" as herein provided, the proclamation of a "state of emergency" by the Governor or the Director of the State Office of Emergency Services, or the existence of a "state of war emergency, " the City Council may authorize additional compensation to be awarded to the Director of Emergency Preparedness for services performed and hours worked due to the emergency, based on the Director's daily rate of pay for each day worked during the emergency.
