HomeMy Public PortalAbout93-1010 ORDINANCE 93-1010 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARSON REGARDING THE PARKS AND RECREATION COMMISSION AND THE HUMAN RELATIONS COMMISSION AND AMENDING CHAPTER 7 OF ARTICLE 2 OF THE CARSON MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF CARSON HEREBY ORDAINS AS FOLLOWS: SECTION 1. In order to serve the people of the City of Carson better, the Council desires to solicit the input and participation of young people who use City services and particularly services relating to parks and recreation programs and human relations. To that end, the Council desires to expand the City's Parks and Recreation Commission and Human Relations Commission each to include two Youth Commissioners. The Youth Commissioners will be selected according to the criteria set forth herein. SECTION 2 . Section 2736 of Chapter 7 of Article 2 of the Carson Municipal Code, is hereby amended to read: "Members. The Parks and Recreation Commission shall consist of nine (9) members, seven (7) general members and two (2) youth members, each of whom shall be a resident of the City of Carson. The members shall be appointed as follows. (a) General Members. Each Councilmember shall appoint one (1) general member of the Commission. The other two (2) general members shall be appointed by the Mayor, subject to approval by the City Council. Subject to the provisions of this Section 2736, the tenure of the first general members appointed after the effective date hereof shall expire April 30, 1994. Thereafter, all general members shall be appointed biennially for two (2) year terms expiring at midnight on April 30 of each regular municipal election year (each even-numbered year) . (b) Youth Members. The two (2) youth members shall be appointed by the Mayor, based upon the recommendation of the general members, and subject to approval by the City Council. Subject to the provisions of this Section 2736, the tenure of the first youth members appointed after the effective date hereof shall expire October 31, 1993 . Thereafter all youth members shall be appointed semi-annually for six (6) month terms expiring at midnight on October 31 and April 30 of each year. The two (2) youth members shall meet all of the following qualifications. (1) Youth members shall be in grades 7 , 81 9, 10, or 11 at the time of appointment. One (1) youth member shall be in grade 7 or 8 and one (1) youth member shall be in grade 9, 10, or 11 at the time of appointment; (2) Youth members shall have maintained at least a 2 . 0 grade point average in the previous school year; and (3) Youth members shall have participated in a City park activity or park program in the previous year. (c) Appointing Authority, Termination, Vacancies. The Councilmember, or Mayor and City Council, making an appointment to a position, shall be the 'appointing 930524 C1380-00999 afs 0961264 0 ORDINANCE NO. 93-1010/PAGE 2 OF 4 authority' for such Commission member or position. The tenure of any member of the Commission shall be terminable at any time by the appointing authority for such Commission member. Each Commission member shall continue to serve until a successor has been appointed by the appointing power for such position and has qualified. Should any vacancy exist on the Commission, an appointment shall be made by the appointing authority for that position. If a vacancy should occur in the office of a Councilmember, the tenure of the Commission member appointed by such Councilmember shall expire when the vacancy on the City Council has been filled, at which time the successor Councilmember shall be the successor appointing authority. All appointments shall be made in an open meeting of the City Council. Action taken by the Commission shall only be valid if a majority of the general members present, and in no event less than three (3) general members, have voted for it. " SECTION 3 . Section 2762 of Chapter 7 of Article 2 of the Carson Municipal Code, is hereby amended to read: "Members. The tenure of any member of the Commission shall be terminable at any time by the appointing authority for such Commission member. The City Clerk shall advertise the youth member vacancies in the Recreation and Community Services Guide, in school flyers for all the junior high and high schools in the City of Carson, as well as for Banning High School, Gardena High School, and Compton High School, and in such other newspapers as the City Clerk deems appropriate. The City Clerk will also contact the principals of the schools referred to in the previous sentence to seek their assistance in helping to recruit applicants for youth member positions. The Parks and Recreation Commission (or such subcommittee thereof as it deems appropriate) shall review the applications for the Parks and Recreation Commission youth member positions, shall interview a reasonable number of the applicants, and shall recommend no less than two (2) and no more than six (6) eligible applicants to the Mayor for appointment. The Human Relations Commission (or such subcommittee thereof as it deems appropriate) shall review the applications for the Human Relations Commission youth member positions, shall interview a reasonable number of the applicants, and shall recommend no less than two (2) and no more than six (6) eligible applicants to the Mayor for appointment. SECTION 5. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this ordinance or any part hereof is for any reason held to be invalid, such invalidity shall not affect the validity of the remaining portions of this ordinance or any part hereof. The City Council of the City of Carson hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases be declared invalid.
