AN ORDINANCE OF THE CITY COUNCIL OF
CARSON AMENDING SECTIONS 9136.29, 9138.7.D, AND 9138.7.E
OF THE CARSON MUNICIPAL CODE RELATING TO THE CARSON
STREET MIXED USE RESIDENTIAL OVERLAY DISTRICT.
THE CITY COUNCIL OF THE CITY OF CARSON HEREBY ORDAINS AS FOLLOWS:
Section 1. Article IX (Planning and Zoning), Chapter 1 (Zoning), Part 3 -
COMMERCIAL ZONES, Division 6 - SITE DEVELOPMENT STANDARDS, Section 9136.29
(Encroachments) is hereby amended by adding the following subsection:
"K. Building encroachments may be permitted in the front yard setback subject
to the approval of a Development Plan by the Planning Commission pursuant
to Section 9172.23 (Site Plan and Design Review) for properties within the
Mixed-Use Residential (MUR) overlay zone district only. A building
encroachment shall not exceed 5 feet provided that the development
provides affordable housing opportunities as defined by this Chapter."
Section 2. Article IX (Planning and Zoning), Chapter 1 (Zoning), Part 3 -
COMMERCIAL ZONES, Division 6 - SITE DEVELOPMENT STANDARDS, Section
9138.7.D. is hereby amended by inserting the following language at the end of the paragraph:
" Deviations from the minimum or maximum commercial FAR may be allowed
subject to the approval of a Development Plan by the Planning Commission
pursuant to Section 9172.23 (Site Plan and Design Review) if the project includes
affordable housing opportunities as defined by this Chapter."
Section 3. Article IX (Planning and Zoning), Chapter 1 (Zoning), Part 3 -
COMMERCIAL ZONES, Division 6 - SITE DEVELOPMENT STANDARDS, Section
9138.7.E. is hereby by inserting the following language at the end of the second paragraph:
" Deviations from the parking requirements may be authorized subject to approval
of a Development Plan by the Planning Commission pursuant to Section 9172.23
(Site Plan and Design Review) if the project includes affordable housing
opportunities as defined by this Chapter."

ordinance, being Ordinance No. 95-1074 passed first reading on December 19 , 1995,
was duly and regularly adopted by the City Council of said City at an adjourned regular meeting
of said Council, duly and regularly held on the 9th day of January , 1996, and that the
same was passed and adopted by the following roll call vote:
