ORDINANCE NO. 99-116SU
AN ORDINANCE OF THE CITY OF CARSON, CALIFORNIA,
RELATING TO CLASSIFICATIONS EXCLUDED FROM THE
PERSONNEL SYSTEM, AMENDING THE
CARSON MUNICIPAL CODE, AND
DECLARING THE URGENCY THEREOF
THE CITY COUNCIL OF THE CITY OF CARSON DOES ORDAIN AS FOLLOWS:
Section 1. Code Amendment. Section 2903 (Competitive Service) of Chapter 9
(Personnel System), Article II (Administration) of the Carson Municipal Code is amended
to read:
"2903. Competitive Service. The provisions of this Chapter shall apply to
all offices, positions and employments in the service of the City, except:
(a) Elective officers;
(b) Individuals serving on boards, commissions, committees and agencies;
(c) Individuals performing services under contract;
(d) City Attorney;
(e) Individuals performing services during a declared emergency;
(f) Individuals appointed to part-time or seasonal employment;
(g) City Manager and Assistant City Manager;
(h) Director of Community Development; Director of Engineering Services;
Director of Facilities and Maintenance; Director of Finance; Director of
Human Resources; Director of Public Safety; Director of Recreation and
Community Services;
(i) All volunteer personnel; and
0) Individuals performing services on a temporary basis."
Section 2. Code Amendment. Section 2905 (Appointments) of Chapter 9 (Personnel
System), Article II (Administration) of the Carson Municipal Code is amended to read:
"2905. Appointments. Appointments, demotions, dismissals, reductions in
pay, suspensions or other actions regarding an employee shall be made in
accordance with the Personnel Rules except as to those persons listed in Section
2903. The Assistant City Manager and persons holding those positions listed in
Section 2903, subsection (h) shall serve the City at the pleasure of the City

Manager and such persons may be discharged, demoted or otherwise disciplined
without notice, hearing or stated cause."
Section 3. Declaration of Urgency. The City Council has authorized the City
Manager to employ an Assistant City Manager. It is desirable to employ such an individual
at the earliest possible date in order to assist the City Manager with numerous urgent
projects which require attention on behalf of the City and its citizens. In order to employ
an Assistant City Manager who will serve at the pleasure of the City Manager, it is
necessary to amend the Municipal Code to place this new position outside the scope of
the City's classified or competitive service. These amendments must be in effect before
the position can be filled. Unless these amendments are adopted on an urgency basis,
it will be necessary to forego filling this position until the effective date of a regular
ordinance. This delay will negatively impact the City Manager's ability to attend to these
urgent projects to the detriment of the City and its citizens. This Ordinance is therefore
necessary for the immediate preservation of the public peace, health, safety and welfare
and shall take effect immediately.
