AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF CARSON, CALIFORNIA,ADDING
SECTION 3252.4 TO THE CARSON MUNICIPAL CODE
RELATING TO THE LOADING OR UNLOADING OF
PASSENGERS NEAR SCHOOLS
WHEREAS, the City Council has the authority to react when the potential exists for
jeopardy to the public health, safety and general welfare and convenience of its citizens; and
WHEREAS, the City Council finds and determines that the loading and/or unloading of
passengers at or near schools within the City can, if not properly regulated, pose a threat to the
quality of life of residents throughout the City and may increase the potential pedestrian and
vehicle conflicts at or near such schools; and
WHEREAS, the City Council finds and determines that this ordinance will facilitate the
orderly and safe drop off and pick up of passengers in our about schools within the City.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CARSON,
CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Anew Section 3252.4 is hereby added to the Carson Municipal Code to
read, in its entirety, as follows:
"3252.4 Stopping, Parkin, or Standing Vehicles Near Schools to Load or
Unload Passengers.
(a) It shall be unlawful for the driver of any vehicle to stop, park, or leave
standing any vehicle in order to load or to unload any school pupil at or below the
12`h-grade level upon any street or highway, as defined in Vehicle Code §§ 590 to
592, at any location that is across such street or highway from any public or
private school, or related school facility(ies), or the athletic and other grounds
thereof, where the school pupil must cross the roadway either to travel from the
vehicle to the school or from the school to the vehicle, unless any of the following
circumstances exist: (i) pedestrian traffic at the point of crossing is controlled by
any peace officer, as defined in Chapter 4.5 (commencing with Section 830) of
Title 3 of Part 2 of the Penal Code, any member of the Traffic Enforcement
- Agency, as defined in Municipal Code § 3202, a school crossing guard, or a traffic
! control device; or (ii) there is a marked pedestrian crosswalk at the point of such
crossing.

(b) Any person who violated this section is guilty of an infraction and is
subject to the provisions of Municipal Code § 1200(b).'.'
SECTION 2. SeverabiliLy. If any section, subsection, sentence, clause, phrase, or
portion of this Ordinance is, for any reason, held to be invalid or unconstitutional by the decision
j of any court of competent jurisdiction, such decision shall not affect the validity of the remaining
portions of this Ordinance. The City Council of the City of Carson hereby declares that it would
have adopted this Ordinance and each section, subsection, sentence, clause, phrase, or portion
thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses,
phrases, or portions thereof may be declared invalid or unconstitutional.
-- SECTION 3. Publication; Effective Date. The City Clerk shall certify to the passage
and adoption of this ordinance, and shall make a minute of the passage and adoption thereof in
the records of and the proceedings of the City Council at which the same is passed and adopted.
This ordinance shall be in full force and effect thirty (30) days after its final passage and
adoption, and within fifteen (15) days after its final passage, the City Clerk shall cause it to be
published in a newspaper of general circulation and shall post the same in the manner required
by law and the municipal code.

number of members of the City Council of said City is four; that the foregoing ordinance, being Ordinance
No. 04-1313, passed first reading on March 16, 2004, was duly and regularly adopted by the City Council of
said City at an adjourned regular meeting of said Council, duly and regularly held on the 7th day of April,
2004, and that the same was passed and adopted by the following roll call vote:
