HomeMy Public PortalAbout07-1393ORDINANCE NO. 07 -1393 AN ORDINANCE OF THE CITY OF CARSON, CALIFORNIA, APPROVING ZONE CHANGE CASE NO. 156 -07 CHANGING PROPERTIES LOCATED ON THE SOUTH SIDE OF SEPULVEDA BOULEVARD FROM 240 FEET EAST OF MARBELLA AVENUE TO 400 FEET WEST OF AVALON BOULEVARD (402 TO 532 SOUTH SEPULVEDA BOULEVARD) FROM CG (COMMERCIAL, GENERAL) TO MU -SB (MIXED USE - SEPULVEDA BOULEVARD) THE CITY COUNCIL OF THE CITY OF CARSON DOES ORDAIN AS FOLLOWS: Section 1. An application was duly filed by the applicant, the City of Carson, for Zone Change Case No. 156 -07. The zone changes involve properties located on the south side of Sepulveda Boulevard from 240 feet east of Marbella Avenue to 400 feet west of Avalon Boulevard as shown on the attached Exhibit "A ". The zone changes include CG (Commercial, General) to MU -SB (Mixed -Use, Sepulveda Boulevard). Section 2. The Planning Commission held duly noticed public hearings on June 26, 2007 and July 10, 2007 at 6:30 P.M. at the City Hall Council Chambers, 701 East Carson Street, Carson, California to hear testimony on the proposed zone changes. After consideration of the evidence and testimony, the Planning Commission voted to recommend approval of Zone Change Case No. 156 -07. Section 3. Evidence, both written and oral, was duly presented to and considered by the Planning Commission at the aforesaid meetings. Section 4. The City Council held a public hearing on the Zoning Change Case No. 156 -07 on October 16, 2007, at 6:00 P.M. and November 6, 2007 at the City Council Chambers, 701 East Carson Street, Carson, California. A notice of time, place and purpose of the aforesaid meeting was duly given. Section 5. Evidence, both written and oral, was presented to and considered by the City Council at the aforesaid meeting, including but not limited to staff reports, along with testimony received by members of the public. Section 6, The property under consideration is located in Redevelopment Project Area 2. Section 7. The proposed zone change is subject to provisions of CEQA. An environmental impact report (EIR) was prepared pursuant to Section 15161 of the CEQA Guidelines to analyze and disclose potential environmental effects associated with the General Plan SCH #2001091120. The General Plan designated areas appropriate for mixed -use development anticipating a corresponding zone district would be adopted to implement the designated land use. The Final EIR was certified by the City Council on October 11, 2004. An Initial Study was prepared for the Mixed Use - Sepulveda Boulevard Zone District including the proposed zone change and it was determined that there would Ordinance No. 07 -1393 Page 2 of 4 not be any additional impacts which were not anticipated in the General Plan EIR. A Negative Declaration was certified by the City Council. Section 8. The City Council finds: a) The General Plan designated certain properties along Sepulveda Boulevard for Mixed -Use Residential development. State law requires that the zoning for property be in conformance with the General Plan. The proposed changes from CG (Commercial - General) to MU -SB (Mixed- Use - Sepulveda Boulevard) zone will bring these properties into conformance with the General Plan. b) The General Plan Land Use Element Policy LU -8.1 states that the Zoning Ordinance will be amended to provide for those mixed use areas identified on the General Plan Land Use Plan. The property under consideration is designated Mixed -Use Residential on the General Plan Map. c) The proposed Mixed -Use — Sepulveda Boulevard zone district allows commercial, residential and a mix of commercial and residential uses as anticipated by the General Plan. d) The proposed zone change will further the public health, safety and welfare through the development of this major corridor with mixed uses including commercial and residential uses. The redevelopment of the Sepulveda Boulevard corridor with livable, pedestrian oriented mixed -use will assist the city and the Carson Redevelopment Agency in meeting the housing and shopping needs of city residents. e) The General Plan designates this section of Sepulveda Boulevard as appropriate for Mixed -Use Residential. f) Pursuant to Carson Municipal Code 9172.13, the Planning Commission and the City Council determined that the proposed zone change is consistent with the General Plan. g) The proposed project is subject to the provisions of CEQA. An environmental impact report (EIR) was prepared pursuant to Section 15161 of the CEQA Guidelines to analyze and disclose potential environmental effects associated with the General Plan SCH #2001091120. The changes included in the Mixed - Use Sepulveda Boulevard zone district were part of the EIR. The Final EIR was certified by the City Council on October 11, 2004. An Initial Study was prepared for the Zone Change No. 156 -07 and it was determined that there would not be any additional impacts which were not anticipated in the General Plan EIR. A Negative Declaration was prepared, noticed and sent to the County Recorder's office for posting. The property owners and tenants within the affected area and those within 500 feet of the corridor were noticed 20 days prior to the hearing. Ordinance No. 07 -1393 Page 3 of 4 h) The Planning Commission reviewed the Negative Declaration and recommended that the City Council adopt the Negative Declaration. Section 9. Based on all evidence presented at the meetings and the aforementioned findings the City Council approves Zone Change Case No. 156 -07. Section 10. This Ordinance No. 1393 is approved for introduction and first reading on November 6, 2007 and adoption on November 20, 2007. Section 11. The City Clerk shall certify to the adoption of this Ordinance and shall transmit copies of the same to the applicant. The City Clerk shall publish the adopted Ordinance pursuant to California Government Code 36933 within fifteen days of its adoption. Section 12.
