HomeMy Public PortalAbout69-010RESOLUTION NO. 69-10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, CONFIRMING ASSESSMENT AND ORDERING IMPROVEMENT AND REIMBURSEMENT MADE, CARSON IMPROVEMENT NO. 3, PERRY STREET WHEREAS, the City Council of the City of Carson, State of California, did on December 16, 1968, adopt a Resolution of Intention under the Municipal Improvement Act of 1913 for the construction of sanitary sewers under Carson Improvement No. 3; and WHEREAS, the "Report" containing Plans and Specifications, an Estimate of Cost, a Diagram and Assessment, has been presented to and con- sidered by the Council; and WHEREAS, this Council has heard all protests in relation to the proposed improvement: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carson as follows: 1. That the "Report" and the Assessment and Diagram are hereby confirmed. 2. That the improvement be made in accordance with the Resolution of Intention and the "Report" for Carson Improvement No. 3. 3. That the City Treasurer.is hereby authorized and directed to establish a special fund account to be known as the "Improvement Fund for Carson Improvement No. 3." 4. That reimbursement for portions of the costs of existing sewers shall be made in accordance with the Resolution of Intention in the amount of EIGHT HUNDRED THIRTY-EIGHT DOLLARS AND EIGHTY-SIX CENTS ($838.86) and that when Improvement Bonds, for subject improvement, have been sold and assessments collected, the City Treasurer is hereby authorized and directed to deduct the following portions of said amount from the above-named improve- ment fund and cause them to be redeposited to the following County of Los Angeles special accounts as designated: $386.55 to "Deferred Accounts Receivable Reimbursement to the Subdividers for Sewer Construction, Tract No. 29360, Private Contract No. 7093"; $452.31 to "Deferred Accounts Receivable Reimbursement to the Subdividers for Sewer Construction, Tract No. 27430, Private Contract No. 6458". 5. That it is hereby determined that because damages would be very difficult to ascertain, in the event the contractor does not complete the work within the time specified in the contract or within such further time as this Council shall have authorized, the contractor shall pay to the City of Carson liquidated damages. The liquidated damages for this improve- ment are fixed in the amount of FIFTY DOLLARS ($50.00) per day. Money received by the City of Carson on account of such liquidated damages shall be disbursed as provided in Section 10503.1 by reference to Section 5254.5, all of the Streets and Highways Code. 6. That the assessment is hereby levied upon the respective subdivisions of land in the assessment district. PASSED, APPROVED and ADOPTED this 3rd day of February, 1969. Res.
