A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARSON IN THE MATTER OF THE PROPOSED IMPROVEMENT
OF KINARD AVENUE AND OTHER RIGHTS OF WAY,
INSTITUTING PROCEEDINGS, ACKNOWLEDGING WAIVER
OF DEBT LIMIT INVESTIGATION PROCEEDINGS AND
DIRECTING PREPARATION OF RESOLUTION OF
INTENTION (CARSON ASSESSMENT DISTRICT NO. 69-5)
WHEREAS, a petition for the acquisition of rights of way and the construction
of curb, gutter, walk, pavement, drainage structures and appurtenant work in Kinard Avenue
and other rights of way, signed by persons representing ownership of 68% of the area of lands
in the district hereinafter proposed to be assessed for the improvement, has been presented to
the City Council of the City of Carson; and
WHEREAS, said petition contains a waiver of debt limit investigation pro-
ceedings, signed by all the owners of more than 60% of the area of the property subject to
assessment for said proposed improvement, whose names appear on the assessor's roll, as provided
in Section 2804 (3), Division 4, Streets and Highways Code; and
WHEREAS, the intent of the City Council is to acknowledge the waiver of
debt limit investigation proceedings pursuant to said Section 2804, institute proceedings and
direct preparation of a resolution of intention for the proposed improvement.
RESOLVE THAT: THE CITY COUNCIL OF THE CITY OF CARSON DOES THEREFORE
Section 1. The public interest and convenience require the proposed
acquisition of rights of way and construction of curb, gutter, walk, pavement, drainage
structures and appurtenant work in Kinard Avenue and other rights of way within the assess-
ment district proposed therefor, substantially as indicated on the map attached to the petition.
Section 2. The district of lands to be assessed for the improvement shall
include, in general, the area within the boundary of the district as shown on said map.
Section 3. The petition filed with the Clerk of the City Council is adequate
and signed by the required number of owners to waive the debt limitations prescribed by
Division 4, Streets and Highways Code. Therefore, the provisions of said Division 4 do not apply.
Section 4. The proceedings for the improvement shall be conducted under
and in accordance with provisions of Division 12 of the Streets and Highways Code of the State
of California.
Section 5. This project shall be known as Carson Assessment District No.
69-5, Kinard Avenue and other rights of way.
Section 6. The City Engineer is hereby requested to provide all necessary
resolutions, reports, plans, specifications, estimates, maps, notifications, proposal forms,
contract forms, bond forms and any other acts, services or forms necessary to assist the City of
Carson in completing this project.
Section 7. The City Clerk is directed to forward a certified copy of this
resolution to the County Engineer.

that the whole number of members of the City Council of said City is five; that the foregoing
resolution, being Resolution No. 69-139, was duly and regularly adopted by the City Council
of said City at a regular meeting of said Council, duly and regularly held on the 17th day of
November, 1969, and that the same was so passed and adopted by the following vote:
