HomeMy Public PortalAbout70-007RESOLUTION NO. 70-007 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT OF THE STATE OF CALIFORNIA TO ACCEPT ON BEHALF OF SAID DISTRICT A TRANSFER AND CONVEYANCE OF STORM DRAIN IMPROVEMENTS AND DRAINAGE SYSTEM KNOWN AS STORM DRAIN IN TRACT NO. 30538, PRIVATE DRAIN NO. 937, IN THE CITY OF CARSON, FOR FUTURE OPERATION, MAINTENANCE, REPAIR AND IMPROVEMENT, AND AUTHORIZING THE TRANSFER AND CONVEYANCE THEREOF WHEREAS, there have been dedicated unto, or the City of Carson has otherwise acquired, the storm drain improvements and drainage system known as Storm Drain in Tract No. 30538, Private Drain No. 937, described in Exhibit A attached hereto; and WHEREAS, the City of Carson is authorized and empowered to transfer and convey unto the Los Angeles County Flood Control District any storm drain improvements and drainage systems for future operation, maintenance, repair and improvement; and WHEREAS, the Board of Supervisors of the Los Angeles County Flood Control District is authorized and empowered under Section 13-3/4 of the Los Angeles County Flood Control Act, as amended, to accept on behalf of said District a transfer and conveyance of stone drain improvements and drainage systems lying within the territorial boundaries of said District whenever the governing body of any public agency owning or having jurisdiction over such storm drain improvements and drainage systems by resolution requests said Flood Control District to accept such improvements and systems, except that such Flood Control District shall not assume or be liable for any bonded indebtedness that may be against such stone drains or drainage systems; and WHEREAS, the best public interest will be served by transfer and conveyance of the storm drain improvements and drainage system described in Exhibit A, attached hereto, from the City of Carson to the Los Angeles County Flood Control District for future operation, maintenance, repair and improvement. NOW, THEREFORE, BE IT RESOLVED that the City of Carson, by and through its City Council, does hereby request that the Los Angeles County Flood Control District accept the transfer and conveyance to said Los Angeles County Flood Control District of the storm drain improvements and drainage system described in said Exhibit A. BE IT FURTHER RESOLVED that, subject to the acceptance thereof by resolution of the Board of Supervisors of the County of Los Angeles, the ex -officio governing body of said Los Angeles County Flood Control District, the City Engineer of the City of Carson is directed and ordered to prepare all necessary instruments and documents, including deed, to effectuate said transfer and conveyance and to obtain the approval thereof of the Chief Engineer of said District, and that the Mayor, acting on behalf of the City of Carson, is authorized and instructed to execute said deed and other instruments and documents. District shall have no obligation or responsibility to maintain said storm drain, improvements and drainage until all rights of way for said drain now vested in the City of Carson and all other necessary rights of way therefore have been conveyed to and accepted by District. Notwithstanding the foregoing, District may at its sole discretion maintain said improvements and drainage system upon written request by City prior to conveyance of said rights of way. Res. No. 70-007/P.2 of 3 Said transfer is limited to the drainage structure proper and does not include transfer of responsibility for the repair of paving resulting from backfill failure in public streets. Any liabilities created by construction of the facility remain the responsibility of the property owner or the City of Carson. Reference is hereby made to District Drawings Nos. 314-F25.1 through 25.6 and 314-F37. i through 37.3; the plan and profile of said storm drain improvements and drainage system on file in the office of the City Engineer and on file in the office of the Chief Engineer of said District for further data as to the exact location, extent and description of said storm drain improvements and drainage system. CORTINA, City Clerk of the City of Carson, California, do hereby certify that the whole number of members of the City Council of said City is five; that the foregoing resolution, being Resolution No. 70-007, was duly and regularly adopted by the City Council of said City at a regular meeting of said Council, duly and regularly held on the 19th day of January , 1970, and that the some was so passed and adopted by the following vote: AYES: COUNCILMEN: Smith, Marbut, Clark and Junk. No. 70-007/P.3 of 3 EXHIBIT A PRIVATE DRAIN,NO. 937 A reinforced concrete pipe storm drain system and appurtenant structures in Tract No. 30538, filed in Book 781, pages 70 and 71 of Maps, in the office of the Recorder of the County of Los Angeles, described as follows: LINE A Commencing at station 2+10 of Private Drain No. 674 -Unit 2 (transferred December 20, 1966), thence southerly across Del Amo Boulevard to a variable width ease- ment, thence southerly and easterly in said easement to Leapwood Avenue, thence southerly in Leapwood Avenue to a pair of catch basins. A total distance of 816 feet more or less. NOTE: That portion of Line A from station 0+00 (station 2+10.00, Private Drain 674 -Unit 2) to station 2+08.50 was constructed as Line A, Private Drain 674 -Unit 3. LINE B Commencing at station 11+30.00 of Private Drain 674 -Unit 2, thence southerly across Del Amo Boulevard to a variable width easement, thence southerly and easterly in said easement to Campaign Drive, thence easterly across Campaign Drive to a 20 -foot -wide easement adjacent to and parallel with Campaign Drive, thence southerly in said easement terminating in a catch basin. A distance of 544 feet more or less. NOTE: That portion of Line B from station 0+00 (station 11+30.00, Private Drain 674 -Unit 2) to 1+75.50 was constructed as Line B, Private Drain 674 -Unit 3. Line C is a connector pipe from a catch basin to Line B. The C.M.P. inlet structure at station 2+43.78, Line A, Line D and that portion of Line B from station 5+44 to 5+55.95 are not included in this transfer. All as shown on District Drawings Nos. 314425.1 through 25.6 inclusive and 314437.1 through 37.3 inclusive.
