HomeMy Public PortalAbout1999-02 City CodeOrdinance 1999 -2 AN ORDNANCE ESTABLISHING SECTION 8 -90 OF THE GREENCASTLE CITY CODE REGULATING THE USE OF BICYCLES AND SKATEBOARDS UPON THE CITY STREETS N THE DESIGNATED BUSINESS DISTRICT BE IT ORDAINED AND ADOPTED by the Common Council of the City of Greencastle, Indiana, that Section 8 -90 of the Greencastle City Code is hereby established as follows: Section 8 -90 Bicycles and Skateboards use upon City Streets in the Designated Business District a. For the purpose of this section the designated business district is the area bordered by and inclusive of Walnut Street, Vine Street, Columbia Street and Market Street. b. No person shall ride a bicycle or skateboard upon any sidewalk located within the ® designated business district or adjacent to any governmental facility. c. No person shall ride a bicycle or skateboard in or into any marked pedestrian crosswalk in the designated business district, except for the purpose of riding across said crosswalk. d. Any person operating a bicycle shall obey the instructions of official traffic- control signals, signs and other control devices applicable to vehicles unless otherwise directed by a police officer. Whenever authorized signs are erected indicating that no right or left turn or U- turn is permitted, no person operating a bicycle shall disobey the direction of any such sign, except where such person dismounts from the bicycle to make such turn, in which event, such person shall then obey the regulations applicable to pedestrians. e. No person shall park or leave any bicycle or skateboard on any street or alley, nor upon any sidewalk in the designated business district or adjacent to any governmental facility in such manner as to obstruct or hinder the free passage of pedestrians or other vehicles or devices permitted to use the same. Any bicycle or skateboard found in violation of this section may be impounded by the Police Department and returned to the owner under such reasonable conditions as may be established by the Police Chief. f. P � hael, Mayor E 11 N0. 1 ® RESOLUTION OF THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF GREENCASTLE, INDIANA APPROVING A SEWER RATE ORDINANCE, RECOMMENDING ITS ADOPTION TO THE COMMON COUNCIL OF THE CITY OF GREENCASTLE, INDIANA, AND OTHER RELATED MATTERS WHEREAS, the City of Greencastle, Indiana (the "City "), has previously established and now owns and operates through its Board of Public Works and Safety (the "Board of Public Works "), a sewage works system pursuant to IC 36 -9 -23 (the "Act "); and WHEREAS, in order to finance the cost of the construction of a new wastewater treatment plant and other improvements to the City's sewage works system, it will be necessary to issue sewage works revenue bonds (the "Revenue Bonds ") in the approximate amount of Twelve ® 1vlillion Dollars ($12,000,000) payable out of the revenues of the sewage works of the City; and WHEREAS, a proposed form of a sewer rate ordinance increasing the rates and charges to an amount sufficient to pay all expenses incidental to the operation of the sewage works, including legal expenses, maintenance costs, operating charges, repairs, and principal and interest charges on the Revenue Bonds, has been duly considered by the Board of Public Works and found satisfactory, a copy of which proposed form of sewer rate ordinance is attached hereto as Exhibit "A and WHEREAS, the Board of Public Works desires to recommend the adoption of the proposed ordinance to the Common Council of the City (the "Common Council "); NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF GREENCASTLE BOARD OF PUBLIC WORKS AND SAFETY AS FOLLOWS: The Board of Public Works hereby requests the Common Council to adopt the proposed sewer rate ordinance increasing the rates and charges as provided in the form of rate ordinance presented at this meeting. 2. Prior to issuance of the Revenue Bonds, revenues collected from the increase in rates shall be set aside and accumulated in a separate fund for the establishment of a debt service reserve fund for the Revenue Bonds. The Clerk- Treasurer of the City is hereby directed to present a copy of this Resolution and said proposed ordinance to the Common Council as soon as may be done. 4. This resolution shall be in full force and effect after its adoption by the Board of Public Works.
