HomeMy Public PortalAbout32 Easement Abandonment ElychovTOWN OF TRUCKEE California RESOLUTION NO. 2000-32 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE FOR ABANDONMENT OF A PUBLIC EASEMENT ON LOTS 111~ 112, 113~ 114 OF THE ARMSTRONG SUBDIVISION (SIEGFRIED ELYCHOVA) WHEREAS, the Town of Truckee has received a request to vacate and abandon a existing public easement (per 403/O.R./439) located along the northerly portions of Lots 111, 112, 113, 114 of the Armstrong Subdivision (APN 18-530-25, 24, 21, & 20) commonly owned by Siegfried Elychova; and WHEREAS, said easement to be abandoned has not been used or has not been necessary for the purpose for which it was dedicated or acquired for five consecutive years immediately preceding this proposed abandonment; and WHEREAS, the Community Development Director, Town Engineer and the Public Works Director have reviewed the proposed abandonment and find the easement is no longer necessary for public purposes; and WHEREAS, there are no public utility facilities located in the portions of the easement to be abandoned and the Town has not received any objections to the proposed abandonment from any public utility or special district; and WHEREAS, Chapter 4 of Part 3 of Division 9 of the Streets and Highway Code, Section 8335, et seq., provides a procedure for summary abandonment of easements; NOW, THEREFORE, BE IT RESOLVED BY THE TRUCKEE TOWN COUNCIL that The easement for the purpose of ingress and egress for the installation, construction, reconstruction, maintenance, repair and operation of a slope easement and appurtenances located along the northerly (15') fifteen feet of Lots 111, 112, 113, 114 of the Armstrong Subdivision is hereby summarily vacated and abandoned. It is hereby declared that from and after the date that this Resolution is recorded, the subject easement as described in Paragraph 1 no longer constitutes a public easement, as shown on Exhibits A (Lot 111), B (Lot 112), C (Lot 113), & D (Lot 114). The Town Clerk is hereby instructed to record this Resolution upon compliance with all the conditions, pursuant to Section 8336 of the Streets and Highways Code. Resolution 2000-32 Page 2 The foregoing Resolution was introduced at a Regular Meeting of the Truckee Town Council, held on the 20th day of July, 2000, by Councilmember Drake, who moved its adoption, and which motion was duly seconded by Councilmember Florian, was upon roll call carried and the Resolution adopted by the following vote: AYES: Councilmembers Drake, Florian, Susman & Mayor Pro Tempore McCormack NOES: None ABSTAIN: None ABSENT: Mayor Schneider Donald C.
