HomeMy Public PortalAbout70-131RESOLUTION NO. 70-131 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON FOR THE ACQUISITION OF NECESSARY RIGHTS OF WAY AND THE CONSTRUCTION OF CURB, GUTTER, WALK, PAVEMENT AND DRAINAGE STRUCTURE CARSON ASSESSMENT DISTRICT NO. 69-5 KINARD AVENUE RESOLUTION ORDERING EMINENT DOMAIN PROCEEDINGS WHEREAS, the City Council of the City of Carson, State of California, did on July 6, 1970, adopt a Resolution of Intention under the Improvement Act of 1911 declaring its intention to order the acquisition of necessary rights of way and the construction of curb, gutter, walk, pavement and drainage structure under Carson Assessment District No. 69-5 (KINARD AVENUE); and WHEREAS, the Council did on August 17, 1970, adopt a resolution ordering that rights of way be acquired and that the improvement be made. NOW, THEREFORE, BE IT RESOLVED, and the City Council of the City of Carson, does hereby find and determine: of: Section 1. That the public interest and necessity require the acquisition — A permanent easement for public road purposes in, upon, over and across Parcel 1 - 42. All of said parcels being more particularly described hereinafter, for any public uses and purposes authorized by law, and for use and in connection with and in accordance with the Resolution of Intention for Carson Assessment District No. 69-5 (KINARD AVENUE); Section 2. That the taking of said parcels of land is necessary for such public uses; Section 3. That the proposed public improvements thereon and there- under have been planned and located in a manner which is and will be, most compatible with the greatest public good and the least private injury; Section 4. That the City Attorney of the City of Carson be and he is hereby authorized and directed to institute eminent domain proceedings in the Superior Court of the State of California for the County of Los Angeles for the purpose of acquiring said easements in, upon, over and across said parcels of land, said parcels being more particularly hereinafter described, for any public uses and purposes hereinabove set forth, and to take all action necessary to complete the acquisition thereof in the name of the City of Carson; Section 5. That the public interest and necessity require the taking of immediate possession, and the said City Attorney is directed to institute proceedings for the taking of immediate possession and use of the property herein ordered to be acquired, upon complying with the requirements of the law applicable thereto, and he is ordered and directed to report to the City Council the amounts of money required as soon as the same may be ascertained. That the said real property is located in the City of Carson, State of California and is more particularly described as follows: Parcel 1-42: (Kinard Avenue) The easterly 15 feet of the westerly 88 feet of the southerly 67.77 feet of the northerly 135.55 feet of Lot 92, Tract No. 3612, as shown on map recorded in Book 40, pages 5 and 6, of Maps, in the office of the Recorder of the County of Los Angeles. Cortina, City Clerk of the City of Carson, California do hereby certify that the whole number of members of the City Council of said City is five; that the foregoing resolution, being Resolution No. 70-131, was duly and regularly adopted by the City Council of said City at a regular meeting of said Council, duly and regularly held on the 19th day of October, 1970, and that the same was so passed and adopted by the following vote: AYES: COUNCILMEN: Junk, Leahy, Marbut, Spence and Smith.
