HomeMy Public PortalAbout70-143RESOLUTION NO. 70-143 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON GRANTING A ZONE EXCEPTION: ZONE EX- CEPTION CASE NO. 41-70 ON APPEAL THE CITY COUNCIL OF THE CITY OF CARSON HEREBY RESOLVES AS FOLLOWS: Section 1. The City Council hereby finds that an application was duly filed by John D. Colas Sr. in ehalf of Leo David of Music Distributors, requesting a zone ex- ception with respect to the real property described on Exhibit A hereto attached, from the provisions of Article IX, Chapter 1 of the Carson Municipal Code and the Zoning Ordinance thereby adopted, and in particular from the outdoor advertising regulations in Section 255 (h) of said zoning ordinance; that following a public hearing thereon the Planning Commission of the City of Carson duly adopted its Resolution No. 116 on September 15, 1970, denying the requested exception. Section 2. The City Council further finds that on September 25, 1970, an appeal was duly tarn from the aforesaid action of the Planning Commission; that the City Council duly ordered a public hearing on said appeal to be held on November 2, 1970; that notice of the time, date, place and purpose of said hearing was duly given and a public hearing was duly held before the City Council pursuant to said notice. Section 3. The City Council hereby finds and determines that there are special circumstances applicable to the subject property and the advertisement of the business conducted therein which would result in substantial and unnecessary hardship if the strict requirements of the zoning ordinance with respect to outdoor advertising were applied, and that the applicant has demonstrated that the requested exception is necessary for the preservation of a substantial property right; that facts do exist as required by Article IX, Chapter 1 of the Carson Municipal Code justifying the granting of a zone exception as requested, on the conditions herein provided. Section 4. Based on the foregoing findings, the City Council hereby grants an exception with respect to the real property described on Exhibit A hereto attached, from the a- foresaid outdoor advertising requirements, so as to permit erection and maintenance of the sign described in the application not to exceed 108 sq. ft. in area on each side thereof, or a total of 216 sq. ft., subject to and on the following conditions: (1) That 128 sq. ft. of signs presently located on the building on the subject property be removed from said building be- fore said sign shall be installed; (2) That the exception herein granted expire and terminate five (5) years from date hereof, and in the event that construc- tion of a municipal building should commence in the pro- posed civic center zone prior to expiration of said five years, that said exception shall be, subject to review and modifica- tion or termination by the City Council; (3) That the applicant accept the conditions hereof in writing within ten days after transmission of a copy of this reso- lution to the applicant. Section 5. The City Clerk shall certify to the adoption of this resolution and shall transmit a copy of tFie same to the applicant and to the Director of Planning within five (5) days after adoption hereof.
