HomeMy Public PortalAbout71-028RESOLUTION NO. 71-028 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON ACCEPTING THE WORK PERFORMED BY JACKSON ELECTRIC COMPANY FOR STREET LIGHTING ON MAIN STREET AND ON SEPULVEDA BOULEVARD (CITY OF CARSON CASH CONTRACT NO. 7.1) WHEREAS, the City Council did on the 20th day of July, 1970, adopt Resolution No. 70-099, awarding the contract for street lighting on Main Street, Sepulveda Boulevard to 223rd Street, and a signal installation at 234th and Main Streets (City of Carson Cash Contract No. 7.1); and WHEREAS, said work has been duly performed and completed by said contractor; and WHEREAS, said work has been inspected by the Public Works Director and by him approved as constructed and completed in its entirety, in accordance with the plans and specifications for such improvement project and the authorized revisions therein; and WHEREAS, said Director does now recommend and request the acceptance of the work and the filing of a Notice of Completion thereof;: and WHEREAS, the final contract price for said work is the sum of $47,539.12 which said sum the Director has approved as just and fair; and WHEREAS, the contract documents provide that a total of 10% of said total contract price shall be retained until thirty-five (35) days after the recording of the Notice of Completion of said improvement project. NOW, THEREFORE, BE IT RESOLVED that the City of Carson does hereby accept the work performed bysaid contractor and approve the same as being completed in accordance with the plans and specifications for said project and authorized revisions therein, and the City Administrator is hereby authorized to file Notice of Completion of said project in the office of the Los Angeles County Recorder; and BE IT FURTHER RESOLVED that the City Treasurer is authorized and directed to pay to said contract, JACKSON ELECTRIC COMPANY, the sum of $47,539.12, in full payment for said work performed by said contractor, less any sums heretofore paid. Ten per cent (10%) of said final contract price shall be held until the expiration of thirty-five (35) days following the filing of said Notice of Completion, and then paid contingent upon the absence of the filing of any stop notice against said project within thirty (30) days after the filing of the Notice of Completion; and BE IT FURTHER RESOLVED that upon expiration of said thirty-five (35) days following the filing of said Notice of Completion, without any claim being filed against said project, that all bonds filed by the contractor in said project shall be exonerated and discharged, excepting that the faithful performance bond shall remain in force until the expiration of one year from the date of filing said notice unless a substitute bond approved by the Director of Public Works and the City Attorney shall have been filed. Cortina, City Clerk of the City of Carson, California, do hereby certify that the whole number of members of the City Council of said City is five; that the foregoing resolution, being Resolution No. 71-028, was duly and regularly adopted by the City Council of said City at a regular meeting of said Council, duly and regularly held on the 16th day of February, 1971 and that the same was so passed and adopted by the following vote: AYES: COUNCILMEN: Leahy, Marbut, Spence and Smith.
