HomeMy Public PortalAbout2015.135 (08-04-15)RESOLUTION NO. 2015.135 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD APPROVING AN AGREEMENT BETWEEN THE CITY AND CONTRACTOR COMPLIANCE AND MONITORING, INC. (CCMI) TO PROVIDE A THIRD PARTY LABOR COMPLIANCE PROGRAM AT A COST NOT TO EXCEED $17,400 AND AUTHORIZING THE CITY MANAGER TO APPROVE ADDITIONAL SERVICES UP TO $3,000 FOR CCMI TO ASSIST THE CITY TO PREPARE AN ANNUAL REPORT TO THE DEPARTMENT OF INDUSTRIAL RELATIONS AND COVER THE COST OF EXTENDING CCMI'S SERVICES CAUSED BY CONSTRUCTION DELAYS OR CHANGE IN CONSTRUCTION BUDGET WHEREAS, in 2012, the City entered into a Grant Contract with the State of California Department of Parks and Recreation to receive $5 million in grant funds under the Proposition 84 2006 Bond Act to construct the Yvonne Burke -John D. Ham Park Community Center (Community Center); and WHEREAS, all Proposition 84 grantees must provide a Labor Compliance Program (LCP) before requesting a grant payment for construction costs; and WHEREAS, purpose of the LCP is to ensure that construction contractors comply with the prevailing wage and other applicable labor laws, and that payroll records follow generally accepted accounting practices; and WHEREAS, on October 21, 2015, the City Council adopted Resolution 2014.185 approving and adopting an LCP for Proposition 84 funded projects; and WHEREAS, the City's LCP calls for Contractor Compliance and Monitoring, Inc. to implement the City's LCP. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the City Council approve an award of contract to Contractor Compliance Monitoring, Inc. (CCMI) in an amount not to exceed $17,400 to provide a Third Party Labor Compliance Program. Section 2. That the City Council authorize the Mayor to execute the Agreement in a form approved by the City Attorney attached hereto as Exhibit A. Section 3. That the City Council authorize the City Manager to approve an additional not to exceed amount of $3,000 to pay for additional services such as the filing of an Annual Report to the State Department of Labor Relations and to cover costs relating to construction delays or change in scope. Section 4. That the City Council authorize the carry-over of the purchase order for CCMI to the following fiscal year. . Section 5.
